Mustadrak al-Hakim — Hadith 1449

حدثنا أبو العباس محمد بن يعقوب، حدثنا الرَّبيع بن سُليمان، حدثنا عبد الله بن وَهْب، أخبرني سليمان بن بلال، عن شَرِيك بن عبد الله بن أبي نَمِر، عن عطاء بن يَسَار، عن معاذ بن جَبَل: أنَّ رسولَ الله ﷺ بَعَثَه إلى اليمن، فقال: "خُذِ الحَبَّ من الحَبِّ، والشَّاةَ من الغَنَم، والبَعيرَ من الإبل، والبقرةَ من البَقَر" (3). هذا إسناد صحيح على شرط الشيخين إن صَحَّ سماعُ عطاء بن يسار من معاذ بن جبل، فإنِّي لا أُتقِنُه (4).
It is narrated from Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) that when the Messenger of Allah (peace and blessings be upon him) sent him to Yemen, he said: "Take grain as zakah from grain, a sheep from sheep, a camel from camels and a cow from cattle."
This chain is sahih (authentic) on the condition of the two Shaykhs, provided that Ata bin Yasar's hearing from Sayyiduna Mu'adh bin Jabal is established, for I do not know this with certainty.

(3) إسناده ضعيف لانقطاعه، فإنَّ عطاء بن يسار لم يدرك معاذ بن جبل، وبه أعلّه الذهبي في "تلخيصه".
Grading: (3) The chain is da'if because of a break (inqita'); 'Ata' bin Yasar is not established to have met Mu'adh bin Jabal (may Allah be pleased with him), and al-Dhahabi also declared it defective (ma'lul).
وأخرجه أبو داود (1599) عن الربيع بن سليمان، بهذا الإسناد.
Reference / Source: Abu Dawud (1599) narrated it via the chain of al-Rabi' bin Sulayman.
وأخرجه ابن ماجه (1814) عن عمرو بن سواد المصري، عن عبد الله بن وهب، به.
Reference / Source: Ibn Majah (1814) narrated it through Ibn Wahb.
وروي من غير وجه عن معاذ بن جبل قال: بعثه النبي ﷺ إلى اليمن، فأمره أن يأخذ من كل ثلاثين من البقر تَبيعًا أو تبيعةً، ومن كل أربعين مسنّةً، ومن كل حالمٍ دينارًا أو عدله معافرَ. انظر "مسند أحمد" 36/ (22013) و (22037) و (22084).
Corroborating chains and supporting reports: It is established through other chains from Mu'adh bin Jabal (may Allah be pleased with him) that when the Prophet (peace and blessings be upon him) sent him to Yemen he gave him the rulings on the zakat of cattle and on the jizyah. (Musnad Ahmad 36/22013)

(4) كذا في (ب)، وأُهملت في (ز)، وفي (ص): "لا أنفيه"، وكلاهما له وجه، والله أعلم.
Technical note: (4) The manuscripts differ between the words "la anfihi" and "anfihi".
