It is narrated from Ishaq, Yahya bin Sa'id al-Qattan and Abu Salamah that he asked Abu Ja'far, that is, Muhammad bin Ali bin al-Husayn (may Allah have mercy on him): "What is mukhabarah?" He replied: "It means the (mutual) sharing (of the produce)."

Jarir narrates from Abd al-Aziz bin Rufay', and he from Sayyiduna Rifa'ah bin Rafi' bin Khadij (may Allah be pleased with them both), that the two of them said: A man had some land, and another man said to him: "Would you like me to enter into a sharecropping arrangement (muzara'ah) with you, so that whatever crop Allah Almighty produces will be (shared) between me and you?" He replied: "Yes, but first let me ask the Messenger of Allah (peace and blessings be upon him)." Then he came to Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both), and they said: "Ask the Prophet (peace and blessings be upon him)." So he asked him (peace and blessings be upon him), but he (peace and blessings be upon him) gave him no answer (remaining silent). So he said to the two of them: "He (peace and blessings be upon him) gave me no reply!" The two of them said to him: "Go ahead with this arrangement, for if it were unlawful, he (peace and blessings be upon him) would have forbidden you from it." So he made the sharecropping arrangement with him, until, when his crop began to sway or became green and lush, and that land lay on the path of the Prophet (peace and blessings be upon him), one day he (peace and blessings be upon him) passed by it and asked: "Whose land is this?" The people said: "It belongs to so-and-so, who has made a sharecropping arrangement on it with so-and-so." He (peace and blessings be upon him) said: "Call the two of them!" So both of them came together, and he (peace and blessings be upon him) said to the owner of the land: "Give back to this man whatever he has spent on your land, and whatever your land has produced is yours!" The imams of hadith have not recorded this narration with this particular wording and context.

Abu Bakr narrates from Yahya bin Sa'id al-Qattan, and he from Abu Ja'far al-Khatmi, that he said: My paternal uncle sent me with a slave of his to Sa'id bin al-Musayyib (may Allah have mercy on him) to ask: What do you say about muzara'ah (sharecropping)? He replied: Sayyiduna Ibn Umar (may Allah be pleased with them both) used to see no harm in it, until he narrated a hadith about it from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him): "The Messenger of Allah (peace and blessings be upon him) came to Banu Harithah and saw crops on the land of Zuhayr, and said: 'How excellent is the land of Zuhayr!' The people said: (These crops) do not belong to Zuhayr. He (peace and blessings be upon him) asked: 'Is this not the land of Zuhayr?' They said: Yes indeed (the land is his), but he has made a sharecropping arrangement with so-and-so. So he (peace and blessings be upon him) ordered: 'Return his expenses to him and take your crops.'" Sayyiduna Rafi' (may Allah be pleased with him) said: "So we took our crops and returned his expenses to him."

Ishaq narrated through Jarir and Abd al-Aziz bin Rufay' from Rifa'ah bin Rafi' bin Khadij (may Allah be pleased with him) that he said: "The Messenger of Allah (peace and blessings be upon him) forbade sharecropping on land and renting it out, except that a man buys land or it is lent to him." The narrator said: Then my father lent a piece of land, and the man farmed it and also built a house on it. One day my father went out riding and saw that building, and asked: "What is this?" He was told: "The man to whom you lent your land built it." At this he said: "Is this in return for what I lent him?" So he gave orders concerning the building, and it was demolished. This chain is sahih (authentic); part of it is mursal and part of it is mawquf.

It is narrated from Abu Muhammad (may Allah have mercy on him) that a man obtained a piece of land from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), and he stipulated that he would not put human excrement on it. The man said: "Indeed, nothing but that improves this land (makes it fertile)." So he said: "If nothing but that improves it, then leave it."
