Jarir narrates from Abd al-Aziz bin Rufay', and he from Sayyiduna Rifa'ah bin Rafi' bin Khadij (may Allah be pleased with them both), that the two of them said: A man had some land, and another man said to him: "Would you like me to enter into a sharecropping arrangement (muzara'ah) with you, so that whatever crop Allah Almighty produces will be (shared) between me and you?" He replied: "Yes, but first let me ask the Messenger of Allah (peace and blessings be upon him)." Then he came to Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both), and they said: "Ask the Prophet (peace and blessings be upon him)." So he asked him (peace and blessings be upon him), but he (peace and blessings be upon him) gave him no answer (remaining silent). So he said to the two of them: "He (peace and blessings be upon him) gave me no reply!" The two of them said to him: "Go ahead with this arrangement, for if it were unlawful, he (peace and blessings be upon him) would have forbidden you from it." So he made the sharecropping arrangement with him, until, when his crop began to sway or became green and lush, and that land lay on the path of the Prophet (peace and blessings be upon him), one day he (peace and blessings be upon him) passed by it and asked: "Whose land is this?" The people said: "It belongs to so-and-so, who has made a sharecropping arrangement on it with so-and-so." He (peace and blessings be upon him) said: "Call the two of them!" So both of them came together, and he (peace and blessings be upon him) said to the owner of the land: "Give back to this man whatever he has spent on your land, and whatever your land has produced is yours!" The imams of hadith have not recorded this narration with this particular wording and context.
