بَابٌ : فِيمَنْ دُعِيَ إِلَى الْحَاكِمِ فَامْتَنَعَ .

وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " مَنْ دُعِيَ إِلَى حَاكِمٍ مِنْ حُكَّامِ الْمُسْلِمِينَ فَلَمْ يَأْتِهِ فَهُوَ ظَالِمٌ " . - أَوْ قَالَ : " لَا حَقَّ لَهُ " .
رَوَاهُ الْبَزَّارُ ، وَفِيهِ رَوْحُ بْنُ عَطَاءِ بْنِ أَبِي مَيْمُونَةَ ، وَهُوَ ضَعِيفٌ ، وَقَدْ وَثَّقَهُ ابْنُ عَدِيٍّ .
رَوَاهُ الْبَزَّارُ ، وَفِيهِ رَوْحُ بْنُ عَطَاءِ بْنِ أَبِي مَيْمُونَةَ ، وَهُوَ ضَعِيفٌ ، وَقَدْ وَثَّقَهُ ابْنُ عَدِيٍّ .
Sayyiduna Imran bin Husayn (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "Whoever is summoned to one of the Muslim rulers and does not come to him is a wrongdoer." (The narrator is unsure; perhaps the words are:) He said: "He will have no right."

وَعَنْ سَمُرَةَ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - كَانَ يَقُولُ : " إِذَا طَالَبَ الرَّجُلُ الْآخَرَ ، فَدَعَا أَحَدُهُمَا صَاحِبَهُ إِلَى الَّذِي يَقْضِي بَيْنَهُمَا فَأَبَى أَنْ يَجِيءَ فَلَا حَقَّ لَهُ " .

Sayyiduna Samurah (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "When one man brings a claim against another, and one of the two asks the other to go to someone who can judge between them, and the other refuses to come, then he will not get his right."

وَعَنْ سَمُرَةَ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - كَانَ يَقُولُ لَنَا : " إِذَا خَاصَمَ الرَّجُلُ الْآخَرَ فَدَعَا أَحَدُهُمَا صَاحِبَهُ إِلَى الرَّسُولِ لِيَقْضِيَ بَيْنَهُمَا ، مَنْ أَبَى أَنْ يَجِيءَ فَلَا حَقَّ لَهُ " .

Sayyiduna Samurah (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said to us: "When a man has a dispute with another, and one of the two says to the other: 'Let us go to the Messenger so that he may judge between the two of us,' then whoever refuses to come will not get his right."
