Majma al-Zawaid — Hadith 7087

وَعَنِ الْقَاسِمِ أَنَّ رَجُلًا اسْتَأْذَنَ وَرَثَتَهُ أَنْ يُوصِيَ بِأَكْثَرَ مِنَ الثُّلُثِ فَأَذِنُوا لَهُ ، ثُمَّ رَجَعُوا فِيهِ بَعْدَ مَا مَاتَ فَسُئِلَ عَبْدُ اللَّهِ عَنْ ذَلِكَ ؟ فَقَالَ : ذَلِكَ النَّكَرُّهُ لَا يَجُوزُ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ . وَالْقَاسِمُ لَمْ يُدْرِكْ عَبْدَ اللَّهِ .
Al-Qasim narrates: A man asked his heirs for permission to make a will for more than one third, and the heirs gave him permission. Then they withdrew that permission; they did this after he had died. Sayyiduna Abdullah (may Allah be pleased with him) was asked about this, and he said: "This is an imposition, which is not valid."
Al-Tabarani recorded it in al-Mu'jam al-Kabir; the narrator al-Qasim did not live in the time of Sayyiduna Abdullah (may Allah be pleased with him).
