📘 Ḥaqq al-Shuf‘ah: Linguistic & Shar‘i Definition, Legitimacy, and Juristic Rulings

✍️ Written by: Imran Ayyub Lahori

❖ Introduction

Shuf‘ah (Right of Preemption) is a Shar‘i provision that grants a partner the right to reclaim a property sold to an outsider, under certain conditions. The right is rooted in equity, protection of partnership, and removal of potential harm to co-owners.

◈ 1. Linguistic Explanation (لغوی وضاحت)

The term شُفْعَة is derived from شَفْع, which means:

  • Pairing
  • Addition
  • Strengthening
  • Joining together

📚 [Al-Qāmūs al-Muḥīṭ, p. 660 | Ad-Durar: 2/208]

◈ 2. Shar‘i Definition (شرعی تعریف)

“To transfer to the partner the sold portion of a commonly owned property from an outsider in return for the same price.”

📚 [Fatḥ al-Bārī: 5/192]

This means that if a partner sells his share to a third party, the remaining partner has the right to purchase that share at the same price, preventing intrusion by a stranger into the joint ownership.

◈ 3. Legitimacy of Shuf‘ah (مشروعیت)

Shuf‘ah is unanimously accepted among scholars for partners in undivided properties.

📚 [Al-Mughnī: 5/284 | As-Sayl al-Jarrār: 3/169]

Ibn Ḥajar (رحمه الله) states:
“There is no difference among scholars regarding the legitimacy of Shuf‘ah, except for Abū Bakr al-Aṣamm.”

📚 [Fatḥ al-Bārī: 5/192]

◈ 4. Prophetic Hadiths Affirming Shuf‘ah

➊ Hadith of Jābir (رضي الله عنه):

❝قَضَى رَسُولُ اللَّهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ❞
“The Messenger of Allah ﷺ ruled in favor of Shuf‘ah in everything that has not been divided.”

📚 [Bukhārī: 2257 | Muslim: 1608 | Aḥmad: 3/296 | Abū Dāwūd: 3514 | Tirmidhī: 1370 | Ibn Mājah: 2499 | Sharḥ Ma‘ānī al-Āthār: 4/122]

➋ Narration in Ṣaḥīḥ Muslim:

❝الشُّفْعَةُ فِي كُلِّ شِرْكٍ فِي أَرْضٍ، أَوْ رِبْعٍ، أَوْ حَائِطٍ❞
“Shuf‘ah applies to every shared ownership in land, house, or orchard.”

📚 [Muslim: 1608 | Abū Dāwūd: 3513 | Nasā’ī: 7/320 | Aḥmad: 3/316]

➌ General Hadith:

❝قَضَى النَّبِيُّ ﷺ بِالشُّفْعَةِ فِي كُلِّ شَيْءٍ❞
“The Prophet ﷺ ruled for Shuf‘ah in all things.”

📚 [Ṣaḥīḥ Abū Dāwūd: 3000 | Ṣaḥīḥ Ibn Mājah: 2499 | Ṣaḥīḥ Nasā’ī: 4646 | Sharḥ Ma‘ānī al-Āthār: 4/122 | Abū Dāwūd: 13513 | Tirmidhī: 1370]

◈ 5. Juristic Opinions (فقہی آراء)

➤ Opinion 1: Shuf‘ah Applies to Both Movable and Immovable Property

Supported by:

  • Imām Aḥmad
  • Imām Mālik
  • Ḥanafī scholars
  • Ahl al-Ẓāhir

🟢 Reason: Just as an outsider’s entry can cause harm in immovable property, the same harm and inconvenience can occur in movable items jointly owned.

📚 [Al-Mughnī: 7/441]

➤ Opinion 2: Shuf‘ah Limited to Immovable Property Only

Majority View (Jumhūr):
Shuf‘ah is restricted to immovable items, such as:

  • Land
  • Buildings
  • Structures

📚 [Sabil as-Salām: 3/96–97 | Al-Umm: 4/4 | Fatḥ al-Wahhāb: 1/238 | Al-Mabsūṭ: 14/95 | Al-Inṣāf fī Maʿrifat ar-Rājiḥ: various]

◈ 6. Preferred Opinion (الراجح)

✔ Shuf‘ah is based on shared ownership, regardless of the nature of the item.
✔ It applies to all types of jointly owned property, whether land, house, water canals, pathways, or movable goods.

📚 [As-Sabil al-Jarrār: 3/172]
