Qatadah (may Allah have mercy on him) asked Sayyiduna Anas (may Allah be pleased with him): O Abu Hamzah! Is the hand to be cut off for a theft of less than a dinar? He said that Sayyiduna Abu Bakr (may Allah be pleased with him) cut off the hand for something that I would not be pleased to have for three dirhams.
Hadith Reference
Sayyiduna Anas (may Allah be pleased with him) narrated that in the time of the Prophet (peace and blessings be upon him), or of Sayyiduna Abu Bakr or Sayyiduna Umar (may Allah be pleased with them both), a man stole a shield; it was valued at five dirhams, and his hand was cut off.
Hadith Reference
Sayyiduna Anas (may Allah be pleased with him) narrated that the Prophet (peace and blessings be upon him) cut off the hand for a shield whose price was five dirhams, and that Sayyiduna Abu Bakr (may Allah be pleased with him) cut off the hand for a shield worth five dirhams.
This is how he narrated it; what is preserved (mahfuz) from the hadith of Sa'id bin Abi Arubah is the narration that follows.
Hadith Reference
Sayyiduna Anas (may Allah be pleased with him) said that Sayyiduna Abu Bakr (may Allah be pleased with him) cut off the hand for a shield worth five or four dirhams.
Hadith Reference
Sayyiduna Anas (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him), Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both) cut off the hand for (the theft of) a shield. I asked: How much was it worth? He said: Five dirhams.
Hadith Reference
Sayyiduna Anas (may Allah be pleased with him) narrated that the Prophet (peace and blessings be upon him) cut off the hand for a shield worth five or four dirhams. (Abu Hilal said:) Then I met Sa'id bin Abi Arubah, and he said: It is from Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him). Then I met Hisham bin Abi Abdullah, and he said: It is from the Prophet (peace and blessings be upon him), or else from Sayyiduna Abu Bakr (may Allah be pleased with him), as though he was in doubt about it.
The correct view is that it is from Sayyiduna Abu Bakr (may Allah be pleased with him).
Hadith Reference
Amrah bint Abd al-Rahman (may Allah have mercy on her) said: In the time of Sayyiduna Uthman (may Allah be pleased with him), a man stole a citron (utrujjah) whose value was three dirhams, and at that time the dinar was worth twelve dirhams, so Sayyiduna Uthman (may Allah be pleased with him) cut off his hand for it.
Hadith Reference
A man who had stolen a garment was brought to Sayyiduna Umar (may Allah be pleased with him). Sayyiduna Umar (may Allah be pleased with him) told Sayyiduna Uthman (may Allah be pleased with him) (to assess it); its value was assessed and came to eight dirhams, and Sayyiduna Umar (may Allah be pleased with him) did not cut off his hand.
Hadith Reference
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him): "The hand is not to be cut off except for a dinar or ten dirhams." [Da'if]
Both of them are munqati' (disconnected).
Hadith Reference
Imam al-Shafi'i (may Allah have mercy on him) said: Some people said: We have narrated our view from Sayyiduna Ali (may Allah be pleased with him). Al-Shafi'i said: I said: Al-Za'afiri narrated it from al-Sha'bi from Sayyiduna Ali (may Allah be pleased with him), while the companions of Ja'far bin Muhammad informed us from his father that Sayyiduna Ali (may Allah be pleased with him) said: "Cutting off the hand is for a quarter of a dinar or more," and the hadith of Ja'far from Ali is more worthy of being established than the hadith of al-Za'afiri. He said: We have narrated from Sayyiduna Ibn Mas'ud (may Allah be pleased with him) that he said: "The hand is not to be cut off except for ten dirhams." We said: Al-Thawri narrated from Isa bin Abi Azzah, from al-Sha'bi, from Ibn Mas'ud, that "the Messenger of Allah (peace and blessings be upon him) cut off the hand of a thief for five dirhams," and this is closer to being authentic from Abdullah than the hadith of al-Mas'udi from al-Qasim from Abdullah. He said: Then why did you not adopt this? We said: This hadith does not contradict our hadith; if he cut off the hand for three dirhams, he would cut it off for five or more. He said: We have narrated from Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) that he did not cut off the hand for eight dirhams. Al-Shafi'i said: Its narration from Umar (may Allah be pleased with him) is not authentic. Ma'mar narrated from Ata al-Khurasani from Umar (may Allah be pleased with him): "Cutting off the hand is for a quarter of a dinar or more," yet we did not see fit to use it as proof, because it is not established. No one has any proof against the Messenger of Allah (peace and blessings be upon him), and the Muslims are obliged to follow his command. Al-Shafi'i (may Allah have mercy on him) said: The one who differed with us went neither to an authentic hadith, nor to the position of those who abandoned the hadith and acted on the apparent meaning of the Qur'an.
The Shaykh (al-Bayhaqi) (may Allah have mercy on him) said: As for the narration of Dawud al-Awdi al-Za'afiri from Amir al-Sha'bi from Ali (may Allah be pleased with him) about cutting off the hand, I have not yet come across it; his narration is only about the minimum dowry, and the scholars of his time rejected it from him. If he also narrated it about cutting off the hand, then it is munkar (rejected), and one like Dawud is not taken as proof. It has also been narrated from Ali (may Allah be pleased with him) through another, obscure route, and it is weak; one like it is not taken as proof.
Hadith Reference
Sayyiduna Ali (may Allah be pleased with him) said: The hand is not to be cut off except for ten dirhams, and the dowry (mahr) is not less than ten dirhams.
This chain combines unknown (majhul) and weak (da'if) narrators. As for the hadith of Ibn Mas'ud (may Allah be pleased with him), it is munqati' (disconnected); it has been narrated from Abu Hanifah, from al-Qasim bin Abd al-Rahman, from his father, from Ibn Mas'ud, but al-Mas'udi differed from him and narrated it mursal, as has passed, and what has been narrated in opposition to it is not weaker than it.
Hadith Reference
Sayyiduna Abdullah (may Allah be pleased with him) said that the Prophet (peace and blessings be upon him) cut off the hand for a shield whose value was five dirhams.
As for the hadith of Sayyiduna Umar (may Allah be pleased with him), we have mentioned that it is munqati' (disconnected), since only al-Qasim bin Abd al-Rahman narrated it from him, and he did not meet any of the Companions. And we have narrated earlier from Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both) the cutting off of the hand for five dirhams.
Hadith Reference
Sayyiduna Umar (may Allah be pleased with him) said that the hand is to be cut off for five dirhams. Another narration from Sayyiduna Umar (may Allah be pleased with him) is munqati' (disconnected).
Hadith Reference
Sayyiduna Abu Hurayrah and Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with them both) said: "The hand is to be cut off for four dirhams or more." The Shaykh said: "It is possible that they said this only when the exchange value of a quarter of a dinar had become four dirhams. Likewise, what we have narrated from Sayyiduna Umar (may Allah be pleased with him) and others about five (dirhams) may have been when the exchange rate changed. The basis for the minimum amount (nisab) is a quarter of a dinar, as the established Sunnah that has passed indicates."
Hadith Reference
Sayyidah Aishah (may Allah be pleased with her) said: I have neither forgotten, nor has a long time passed over me: the hand is cut for a quarter of a dinar or more.
