Sayyiduna Imran bin Husayn (may Allah be pleased with him) said: The Prophet (peace and blessings be upon him) said: "When you see a fornicator, a drinker or a thief, what do you say?" We said: Allah and His Messenger know best. He (peace and blessings be upon him) said: "They are acts of indecency, and there are punishments for them."
Only Umar bin Sa'id al-Dimashqi narrated it, and he is munkar al-hadith (his narrations are rejected); it is only known from the hadith of al-Nu'man bin Murrah as a mursal report.

The previous narration, and: "The worst thief is the one who steals from his prayer." In the narration of Ibn Bukayr: The Companions (may Allah be pleased with them) asked: "O Messenger of Allah (peace and blessings be upon him), how does he steal from his prayer?" He said: "He does not complete its bowing and its prostrations."
Imam al-Shafi'i (may Allah have mercy on him) said: At first their punishment was what Allah Almighty stated in verses 15 and 16 of Surah al-Nisa: "And those of your women who commit immorality" up to His words: "Accepting of repentance, Most Merciful" [Surah al-Nisa: 15-16].
Imam al-Shafi'i (may Allah have mercy on him) said: The first punishment of the fornicator was imprisonment and harm; then Allah Almighty abrogated it and revealed this verse: "The fornicatress and the fornicator, flog each one of them with a hundred lashes" [Surah al-Nur: 2].

Then both these verses were abrogated by the verse of flogging, namely: "The fornicatress and the fornicator, flog each one of them with a hundred lashes" [Surah al-Nur: 2].

Mujahid (may Allah have mercy on him) said concerning the words of Allah Almighty, "And those of your women who commit immorality" [Surah al-Nisa: 15]: That is, fornication; and "harm them both" means by reviling them. Then they were abrogated by "The fornicatress and the fornicator, flog each one of them with a hundred lashes" [Surah al-Nur: 2]. And in the words of Allah, "or Allah makes for them a way" [Surah al-Nisa: 15], "a way" means the prescribed punishment (hadd).
