Imam al-Bukhari (may Allah have mercy on him) said in the chapter heading: "It is mentioned from Sayyiduna Umar (may Allah be pleased with him): 'Retaliation is taken from a woman for a man in every deliberate (offence) that reaches the life or wounds less than that.' Umar bin Abd al-Aziz (may Allah have mercy on him) said the same, and Abu al-Zinad (may Allah have mercy on him) (reported it) from his companions."
He said: "The sister of al-Rubayyi' wounded a person, and the Prophet (peace and blessings be upon him) said: 'Retaliation (applies).'"
Al-Shaykh (may Allah have mercy on him) said: "As for the narration on this from the two Umars (Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) and Umar bin Abd al-Aziz (may Allah have mercy on him)), it has already passed from Abd al-Aziz bin Umar, that in a document of Umar bin Abd al-Aziz (may Allah have mercy on him) it was written that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) said: 'Retaliation is taken for a slave from a slave in every deliberate (offence) that reaches the life or less than that.'"

There is a lengthy narration from Anas (may Allah be pleased with him); it will come in its proper place, in sha Allah. Humayd's narration from Anas differs somewhat, in that Anas said: Al-Rubayyi' (may Allah be pleased with her) slapped a slave girl, which broke her front teeth. Thabit is the more precise (in memory), and it is possible that these are two separate incidents, and this is the more apparent view. There are also narrations on this from Ibn Abbas and Zayd bin Thabit (may Allah be pleased with them both).

It is reported from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) regarding the statement of Allah Almighty: "The free for the free, the slave for the slave, and the female for the female" [Surah al-Baqarah: 178], that (each) is to be killed (in retaliation). He said: A man used not to be killed for a woman; rather, a man was killed for a man and a woman for a woman. Then Allah Almighty revealed this verse: "A life for a life" [Surah al-Ma'idah: 45]. So the free, men and women, became equal in retaliation, and slaves, men and women, became equal, in that it is a life for a life.

Bukayr bin al-Ashajj (may Allah have mercy on him) said that the Sunnah is: "The free, whether man or woman, are equal in blood. If a woman's eye is gouged out, then in return that man's eye will also be gouged out." And it has also reached me from Zayd bin Thabit (may Allah be pleased with him) that "a man will be killed for a woman, and retaliation will be taken from him."

Abd al-Rahman bin Abi al-Zinad narrated from his father, who said: I met jurists whose word was regarded as final; among them were Sa'id bin al-Musayyib (may Allah have mercy on him), Urwah bin al-Zubayr (may Allah have mercy on him), al-Qasim bin Muhammad (may Allah have mercy on him), Abu Bakr bin Abd al-Rahman (may Allah have mercy on him), Kharijah bin Zayd bin Thabit (may Allah have mercy on him), Ubaydullah bin Abdullah bin Utbah (may Allah have mercy on him) and Sulayman bin Yasar (may Allah have mercy on him), along with other eminent scholars besides them. Sometimes they differed among themselves, and we would take the view of the majority. What I retained from them was that they used to say that a man is to be killed in retaliation for a woman, and if he inflicts a wound, the same wound will be inflicted on the man.
Sufyan al-Thawri (may Allah have mercy on him) narrated from Mughirah, from Ibrahim (may Allah have mercy on him), that in deliberate killing there is retaliation between a man and a woman as well.
The same is reported through Jabir from al-Sha'bi (may Allah have mercy on him).

It is narrated like the previous hadith from Ja'far bin Burqan from Umar bin Abd al-Aziz (may Allah have mercy on him); Sufyan mentioned all of these reports.
It has been narrated from al-Sha'bi and Ibrahim, contrary to this, regarding (injuries) less than life.
