فَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ يُوسُفَ الرَّفَّاءُ الْبَغْدَادِيُّ، أنبأ أَبُو عَمْرٍو عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ الْقَاضِي، ثنا إِسْمَاعِيلُ بْنُ أَبِي أُوَيْسٍ، وَعِيسَى بْنُ مِينَا، قَالَا: ثنا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، قَالَ: " كَانَ مَنْ أَدْرَكْتُ مِنْ فُقَهَائِنَا الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْهُمْ سَعِيدُ بْنُ الْمُسَيِّبِ، وَعُرْوَةُ بْنُ الزُّبَيْرِ، وَالْقَاسِمُ بْنُ مُحَمَّدٍ، وَأَبُو بَكْرِ بْنُ عَبْدِ الرَّحْمَنِ، وَخَارِجَةُ بْنُ زَيْدِ بْنِ ثَابِتٍ، وَعُبَيْدُ اللهِ بْنُ عَبْدِ اللهِ بْنِ عُتْبَةَ وَسُلَيْمَانُ بْنُ يَسَارٍ، فِي مَشْيَخَةٍ جُلَّةُ سِوَاهُمْ مِنْ نُظَرَائِهِمْ أَهْلُ فِقْهٍ وَفَضْلٍ، وَرُبَّمَا اخْتَلَفُوا فِي الشَّيْءِ فَأَخَذْنَا بِقَوْلِ أَكْثَرِهِمْ وَأَفْضَلِهِمْ رَأْيًا وَكَانَ الَّذِي وَعَيْتُ عَنْهُمْ عَلَى هَذِهِ الْقِصَّةِ، أَنَّهُمْ كَانُوا يَقُولُونَ: الْمَرْأَةُ تُقَادُ مِنَ الرَّجُلِ عَيْنًا بِعَيْنٍ، وَأُذُنًا بِأُذُنٍ، وَكُلُّ شَيْءٍ مِنَ الْجِرَاحِ عَلَى ذَلِكَ، وَإِنْ قَتَلَهَا قُتِلَ بِهَا " وَرُوِّينَاهُ عَنِ الزُّهْرِيِّ وَغَيْرِهِ.
Abd al-Rahman bin Abi al-Zinad narrated from his father, who said: I met jurists whose word was regarded as final; among them were Sa'id bin al-Musayyib (may Allah have mercy on him), Urwah bin al-Zubayr (may Allah have mercy on him), al-Qasim bin Muhammad (may Allah have mercy on him), Abu Bakr bin Abd al-Rahman (may Allah have mercy on him), Kharijah bin Zayd bin Thabit (may Allah have mercy on him), Ubaydullah bin Abdullah bin Utbah (may Allah have mercy on him) and Sulayman bin Yasar (may Allah have mercy on him), along with other eminent scholars besides them. Sometimes they differed among themselves, and we would take the view of the majority. What I retained from them was that they used to say that a man is to be killed in retaliation for a woman, and if he inflicts a wound, the same wound will be inflicted on the man.
Sufyan al-Thawri (may Allah have mercy on him) narrated from Mughirah, from Ibrahim (may Allah have mercy on him), that in deliberate killing there is retaliation between a man and a woman as well.
The same is reported through Jabir from al-Sha'bi (may Allah have mercy on him).
