It is narrated from Masruq that Umar (may Allah be pleased with him) said concerning a woman who marries during her 'iddah: Her marriage is unlawful and her dowry is unlawful. He ordered that her dowry be placed in the public treasury (bayt al-mal) and said: These two may never come together as long as they live.

It is narrated from Ubayd bin Nadlah (or Nudaylah; Dawud was unsure about this) that a woman was brought to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him). He (may Allah be pleased with him) said to her: Did you know that you were marrying during the 'iddah? She said: No (I did not know). He said to her husband: Did you know? He said: No, I did not know either. He (may Allah be pleased with him) said: Had you known, I would have stoned you both. He (may Allah be pleased with him) struck them with a whip, took her dowry and gave it in charity in the path of Allah. He (may Allah be pleased with him) said: Neither is her dowry valid, nor is her marriage valid. And he said: She will never be lawful for you.

It is narrated from al-Sha'bi (may Allah have mercy on him) that Ali (may Allah be pleased with him) separated the two of them and assigned her the dowry because of what was made lawful of her private parts, and he said: When her 'iddah ends, if she wishes to marry him, she may do so.
Imam al-Shafi'i (may Allah have mercy on him) said: We hold the same as the view of Ali (may Allah be pleased with him).
And Imam al-Bayhaqi (may Allah have mercy on him) said: Umar bin al-Khattab (may Allah be pleased with him) retracted his first view, declared the dowry hers, and allowed the two of them to come together.

It is narrated from al-Sha'bi that a woman who had married during her 'iddah was brought to Umar bin al-Khattab (may Allah be pleased with him). He took her dowry and placed it in the public treasury, separated the two of them and said: These two may never come together, and this is their punishment. Al-Sha'bi said: Ali (may Allah be pleased with him) said: It is not like this; this is ignorance on the part of the people. Rather, they are to be separated, then she completes the remainder of her 'iddah from her first husband, then she begins another 'iddah. And Ali (may Allah be pleased with him) assigned her the dowry because of what was made lawful of her private parts. Al-Sha'bi said: Umar (may Allah be pleased with him) praised Allah and extolled Him, then said: O people, refer matters of ignorance back to the Sunnah.
