أَخْبَرَنَا أَبُو حَازِمٍ عُمَرُ بْنُ أَحْمَدَ الْعَبْدَوِيُّ الْحَافِظُ، أَنَا أَبُو الْحَسَنِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ حَمْزَةَ الْهَرَوِيُّ، أنا أَحْمَدُ بْنُ نَجْدَةَ، نا سَعِيدُ بْنُ مَنْصُورٍ، نا هُشَيْمٌ، نا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، أَنَّ عَلِيًّا رَضِيَ اللهُ عَنْهُ " فَرَّقَ بَيْنَهُمَا وَجَعَلَ لَهَا الصَّدَاقَ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَقَالَ: إِذَا انْقَضَتْ عِدَّتُهَا فَإِنْ شَاءَتْ تَزَوَّجَهُ فَعَلَتْ " وَكَذَلِكَ رَوَاهُ غَيْرُهُ عَنِ الشَّعْبِيِّ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَبِقَوْلِ عَلِيٍّ رَضِيَ اللهُ عَنْهُ نَقُولُ قَالَ الشَّيْخُ: وَعُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ رَجَعَ عَنْ قَوْلِهِ الْأَوَّلِ وَجَعَلَ لَهَا مَهْرَهَا وَجَعَلَهُمَا يَجْتَمِعَانِ.
It is narrated from al-Sha'bi (may Allah have mercy on him) that Ali (may Allah be pleased with him) separated the two of them and assigned her the dowry because of what was made lawful of her private parts, and he said: When her 'iddah ends, if she wishes to marry him, she may do so.
Imam al-Shafi'i (may Allah have mercy on him) said: We hold the same as the view of Ali (may Allah be pleased with him).
And Imam al-Bayhaqi (may Allah have mercy on him) said: Umar bin al-Khattab (may Allah be pleased with him) retracted his first view, declared the dowry hers, and allowed the two of them to come together.
