أَخْبَرَنَا أَبُو زَكَرِيَّا يَحْيَى بْنُ إِبْرَاهِيمَ بْنِ مُحَمَّدِ بْنِ يَحْيَى، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ رَضِيَ اللهُ عَنْهُ، أنبأ ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ قَالَ: قَالَ أَبُو هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ " مَا رَأَيْتُ أَحَدًا أَكْثَرَ مُشَاوَرَةً لِأَصْحَابِهِ مِنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ " قَالَ الشَّافِعِيُّ رَضِيَ اللهُ تَعَالَى عَنْهُ: وَقَالَ اللهُ عَزَّ وَجَلَّ: {وَأَمْرُهُمْ شُورَى بَيْنَهُمْ} [الشورى: ٣٨].
Sayyiduna Abu Hurayrah (may Allah be pleased with him) said: I have not seen anyone who consulted his companions more than the Prophet (peace and blessings be upon him).
Imam al-Shafi'i (may Allah have mercy on him) said: Allah Almighty says: "And their affairs are (conducted by) consultation among themselves." [Surah al-Shura: 38]

وَفِيمَا أَجَازَ لِي أَبُو عَبْدِ اللهِ الْحَافِظُ رِوَايَتَهُ عَنْهُ، عَنْ أَبِي الْعَبَّاسِ، عَنِ الرَّبِيعِ، عَنِ الشَّافِعِيِّ رَضِيَ اللهُ عَنْهُ قَالَ: قَالَ الْحَسَنُ الْبَصْرِيُّ: " إِنْ كَانَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَغَنِيًّا عَنِ الْمُشَاوَرَةِ، وَلَكِنَّهُ أَرَادَ أَنْ يَسْتَنَّ بِذَلِكَ الْحُكَّامُ بَعْدَهُ وَاللهُ أَعْلَمُ ".
It is narrated from Imam al-Shafi'i (may Allah have mercy on him) that Imam Hasan al-Basri (may Allah have mercy on him) used to say: The Prophet (peace and blessings be upon him) had no need of consultation; (he consulted) so that the rulers after him would take it as a sunnah.
