باب: ما أمره الله تعالى به من المشورة، فقال: وشاورهم في الأمر
Chapter: What Allah the Exalted commanded him (peace and blessings be upon him) of consultation, saying: "And consult them in the matter"
Bayhaqi 13304 — What Allah the Exalted commanded him ﷺ

وَفِيمَا أَجَازَ لِي أَبُو عَبْدِ اللهِ الْحَافِظُ رِوَايَتَهُ عَنْهُ، عَنْ أَبِي الْعَبَّاسِ، عَنِ الرَّبِيعِ، عَنِ الشَّافِعِيِّ رَضِيَ اللهُ عَنْهُ قَالَ: قَالَ الْحَسَنُ الْبَصْرِيُّ: " إِنْ كَانَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَغَنِيًّا عَنِ الْمُشَاوَرَةِ، وَلَكِنَّهُ أَرَادَ أَنْ يَسْتَنَّ بِذَلِكَ الْحُكَّامُ بَعْدَهُ وَاللهُ أَعْلَمُ ".
It is narrated from Imam al-Shafi'i (may Allah have mercy on him) that Imam Hasan al-Basri (may Allah have mercy on him) used to say: The Prophet (peace and blessings be upon him) had no need of consultation; (he consulted) so that the rulers after him would take it as a sunnah.
