Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said that when the Prophet (peace and blessings be upon him) sent Sayyiduna Mu'adh (may Allah be pleased with him) to Yemen, he said: "You are going to a people who are People of the Book. So the first thing you invite them to should be the worship of Allah, Glorified and Exalted. When they come to know Allah, then tell them that Allah Almighty has made five prayers obligatory upon them in each day and night. When they do that, inform them that Allah has also made zakah obligatory upon them, which will be taken from the wealthy and given to the poor. When they obey this, take it from them, and beware of the choicest of their wealth."

Suwayd bin Ghafalah (may Allah be pleased with him) said: I was informed by someone who went with the collector in the time of the Messenger of Allah (peace and blessings be upon him), to whom he (peace and blessings be upon him) had said: "He is not to take a milk-giving animal, nor combine those grazing separately, and those grazing together are not to be separated." So he would come to them at the watering place and, when the sheep came there, say to them: Pay the zakah of your wealth. He said: A man went for his kawma' she-camel. He said: I said: O Abu Salih, what is a kawma'? He said: One with a huge hump. He said: He refused to take it, and the man said: I want you to take from my best camels, but the collector refused to accept it. Then he offered another, and he refused that too; then he offered a third, and he accepted it and said: I am taking it, but I fear that the beloved Prophet (peace and blessings be upon him) will hold me to account and say: "You went to a man and picked out the best of his camels against him."

Suwayd bin Ghafalah (may Allah have mercy on him) said: The collector of the Messenger of Allah (peace and blessings be upon him) came to us, so I came and sat with him. I heard him saying: "Included in my instructions is that I do not take a milk-giving animal, nor combine those grazing separately, nor separate those grazing together." Then a man brought him a she-camel with a large hump and said: "Take this," but the collector refused to take it.

Suwayd bin Ghafalah (may Allah have mercy on him) said: I took the hand of the collector (may Allah be pleased with him) of the Messenger of Allah (peace and blessings be upon him) and brought him to a large she-camel, and he said: Which sky will shade me and which earth will carry me if I take someone's best wealth? So then I brought him a she-camel from among the camels, and he accepted it.

Suwayd bin Ghafalah (may Allah be pleased with him) said: The collector of the Prophet (peace and blessings be upon him) came, so I took his hand and he took my hand, and I read in his document: "Those grazing together are not to be separated, and those grazing separately are not to be combined, for fear of zakah." A man came with a large she-camel, and he refused to take it; then he brought another, and he refused that too; then he brought yet another, and he refused that too, and said: "Which earth will carry me and which sky will shade me when I come to the Messenger of Allah (peace and blessings be upon him) having taken the best camels of a Muslim man?" It has already passed in the hadith of Ubayy bin Ka'b (may Allah be pleased with him), when he went out as a collector, and in it is evidence that it is permissible to take what is given voluntarily.

Sayyiduna Qurrah bin Da'mus (may Allah be pleased with him) said: I came to Madinah, and the Prophet (peace and blessings be upon him) was seated, and the Companions (may Allah be pleased with them) were around him (peace and blessings be upon him). I wanted to come close and sit near him (peace and blessings be upon him), but I could not get close. Then I said: O Messenger of Allah! Seek forgiveness for your Numayri servant. He (peace and blessings be upon him) said: "Ghafara Allahu laka" (May Allah forgive you). He said: The Messenger of Allah (peace and blessings be upon him) sent al-Dahhak (may Allah be pleased with him) as a collector, and he brought back a large camel. The Prophet (peace and blessings be upon him) said to him: "You went to Hilal bin Amir, Numayr bin Amir and Amir bin Rabi' and took the finest of their wealth." He said: O Messenger of Allah (peace and blessings be upon him)! I heard you (peace and blessings be upon him) mentioning a military expedition, so I wanted to bring a camel that you (peace and blessings be upon him) could ride, and your Companions (may Allah be pleased with them) too. He (peace and blessings be upon him) said: "By Allah! What you left behind was dearer to me than what you have brought. Go and return it, and collect the zakah from their ordinary wealth."

Muhammad bin Yahya bin Habban said: Two men from the tribe of Ashja' informed me that Muhammad bin Maslamah al-Ansari (may Allah be pleased with him) used to come to them as a collector, and he would say to the owner of the wealth: Bring out the zakah of your wealth. Whatever sheep they brought to him in zakah that fulfilled his due, he would accept it. Malik (may Allah have mercy on him) said: The Sunnah is that people should not be put to hardship in collecting zakah, and that whatever they pay in zakah should be accepted from them. The Shaykh (may Allah have mercy on him) said: This is when the zakah fully meets what is obligatory upon him, as has been stated in the hadith of Muhammad bin Maslamah (may Allah be pleased with him).

Hisham bin Urwah (may Allah have mercy on him) narrates from his father that the Messenger of Allah (peace and blessings be upon him) sent a man as a collector and said: "Do not take from the people's choicest wealth; rather accept the old, the young and the defective as well."

Abu Ubayd (may Allah have mercy on him) said: "Do not take from their choicest wealth; rather accept the old one, and the bakr, that is, a young camel." And this was at the beginning of Islam, before people had learned the Shari'ah.
The Shaykh (may Allah have mercy on him) said: This hadith is mursal. In our view, it is conceivable that when all the livestock are defective and male, the male, the young and the defective may be taken.

Al-Hakam said: When the collector came to the sheep, he would divide them into two parts; then the owner of the sheep would take the better part, and the collector would collect from the other part.

Al-Qasim bin Muhammad (may Allah have mercy on him) said: He would divide them into three parts: one third the best, one third middling animals, and one third weaker than that; the collector would leave the best and collect from the middling. It is reported from Umar bin al-Khattab (may Allah be pleased with him) that the owner of the sheep would choose one third, and then they would choose from the remaining two thirds.
