Al-Sa'ib bin Yazid (may Allah be pleased with him) heard al-Ala' bin al-Hadrami (may Allah be pleased with him) say that the Messenger of Allah (peace and blessings be upon him) said: "The Muhajir may stay in Makkah for three days after performing his rites."

Umar bin Abd al-Aziz (may Allah have mercy on him) asked Sayyiduna al-Sa'ib bin Yazid (may Allah be pleased with him): "Have you heard anything about staying in Makkah?" Sayyiduna al-Sa'ib (may Allah be pleased with him) said: I heard al-Hadrami (may Allah be pleased with him) say that the Messenger of Allah (peace and blessings be upon him) said: "The Muhajir may stay three days in Makkah after the departure (from the rites)," as if he (peace and blessings be upon him) were saying: "Not more."

Abd al-Rahman bin Humayd (may Allah have mercy on him) said: I heard Umar bin Abd al-Aziz (may Allah have mercy on him) asking those sitting with him: "Have you heard anything about residing in Makkah?" Al-Sa'ib bin Yazid (may Allah be pleased with him) said: I heard al-Ala' (may Allah be pleased with him) - or he said: al-Ala' bin al-Hadrami (may Allah be pleased with him) - say that the Messenger of Allah (peace and blessings be upon him) said: "After performing the rites, the Muhajir may stay in Makkah for three days."

Aslam, the freed slave of Umar bin al-Khattab (may Allah be pleased with him), said that Umar bin al-Khattab (may Allah be pleased with him) allowed the Jews, the Christians and the Magians a stay of three days in Madinah to trade in the markets. They would also see to their needs. No one was permitted to stay beyond three days.
Note: Imam al-Shafi'i (may Allah have mercy on him) said in his old (school), and gave the same answer in his new (school): Whoever resolves to stay four days is to pray the complete prayer. And several hadiths have been narrated to me about this, among them one from Qatadah, from Sayyiduna Uthman bin Affan (may Allah be pleased with him), to the same effect.

Ata' bin Abdullah al-Khurasani heard Sa'id bin al-Musayyib (may Allah have mercy on him) say: Whoever resolves to stay four nights while he is a traveller should pray the complete prayer. Imam Malik (may Allah have mercy on him) said: This is the position the people of knowledge have always held.

"And we found that Umar (may Allah be pleased with him) expelled the Jews from the Arabian Peninsula and set them a time limit of three days." So we considered three (days) to be within what a traveller may stay, while four seem closer to (the stay of) a resident; for if a traveller were allowed to stay more than three, it would have been likely that the Prophet (peace and blessings be upon him) would order the Muhajir to do so, and that Umar (may Allah be pleased with him) would permit it to the Jews.
