باب: : الولاء للكبر من عصبة المعتق، وهو الأقرب فالأقرب منهم بالمعتق، إذا كان قد مات المعتق.

وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ، ثنا الْحَسَنُ بْنُ عِيسَى، عَنِ ابْنِ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ أَبِي هَاشِمٍ، عَنِ النَّخَعِيِّ، أَنَّ عَلِيًّا، وَزَيْدًا، رَضِيَ اللهُ عَنْهُمَا قَالَا فِي رَجُلٍ تَرَكَ أَخًا لِأَبِيهِ وَأُمِّهِ وَأَخًا لِأَبِيهِ، فَجَعَلَا الْوَلَاءَ لِأَخِيهِ لِأَبِيهِ وَأُمِّهِ، فَإِنْ مَاتَ الْأَخُ مِنْ أَبٍ رَجَعَ الْوَلَاءُ إِلَى بَنِي الْأَخِ لِلْأَبِ وَالْأُمِّ ".
Al-Nakha'i (may Allah have mercy on him) said that Sayyiduna Ali and Sayyiduna Zayd (may Allah be pleased with them both) said, concerning a man who left a full brother and a paternal half-brother, that the wala' is assigned to the full brother. If the paternal half-brother dies, the wala' returns to the sons of the full brother.
