باب: : الولاء للكبر من عصبة المعتق، وهو الأقرب فالأقرب منهم بالمعتق، إذا كان قد مات المعتق.

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ، ثنا يَحْيَى، أنبأ يَزِيدُ، أنبأ مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، أَنَّ عَلِيًّا، رَضِيَ اللهُ عَنْهُ قَالَ: " إِذَا أَعْتَقَتِ الْمَرْأَةُ عَبْدًا، أَوْ أَمَةً فَهَلَكَتْ وَتَرَكَتْ وَلَدًا ذَكَرًا فَوَلَاءُ ذَلِكَ الْمَوْلَى لِوَلَدِهَا مَا كَانُوا ذُكُورًا، فَإِذَا انْقَطَعَتِ الذُّكُورُ رَجَعَ الْوَلَاءُ إِلَى أَوْلِيَائِهَا ". وَقَالَ شُرَيْحٌ: " يَمْضِي الْوَلَاءُ عَلَى وَجْهِهِ كَمَا يَمْضِي الْمِيرَاثُ، وَلَكِنْ لَا يُورَّثُ الْوَلَاءَ أُنْثَى إِلَّا شَيْئًا أَعْتَقَتْهُ "..
Al-Sha'bi narrates from Sayyiduna Ali (may Allah be pleased with him): When a woman frees a male or female slave, then she dies and leaves a male child, the wala' of that freed slave belongs to her children as long as they are male. When the male children come to an end, the wala' returns to her awliya' (agnatic relatives).
