It is narrated from Ibn Shihab (may Allah have mercy on him) that a man who had snatched some goods was brought to Marwan bin al-Hakam. He intended to cut off his hand, then he sent someone to Zayd bin Thabit (may Allah be pleased with him) to ask him about this matter. Zayd (may Allah be pleased with him) said: There is no cutting (of the hand) for snatching.
Imam Malik (may Allah have mercy on him) said: The ruling with us is that the hand of one who snatches property is not cut.
Imam al-Shafi'i (may Allah have mercy on him) said: Likewise, whoever borrows goods and then denies it, or has a deposit with him and denies it, there is no cutting upon him for it.
