أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَسَنِ، ثنا أَبُو الْعَبَّاسِ، أنا الرَّبِيعُ، أنا الشَّافِعِيُّ، أنا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنِي بُكَيْرُ بْنُ عَبْدِ اللهِ، قَالَ: سَمِعْتُ الْقَاسِمَ يَعْنِي ابْنَ مُحَمَّدٍ، ⦗٣٣٨⦘ يَقُولُ: كُنْتُ جَالِسًا عِنْدَ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُ فَسَأَلَهُ رَجُلٌ عَنْ جَرَادَةٍ، يَقْتُلُهَا وَهُوَ مُحْرِمٌ، فَقَالَ ابْنُ عَبَّاسٍ: " فِيهَا قَبْضَةٌ مِنْ طَعَامٍ وَلَتَأْخُذَنَّ بِقَبْضَةِ جَرَادَاتٍ وَلَكِنْ وَلَوْ " قَالَ الشَّافِعِيُّ: قَوْلُهُ: " وَلَتَأْخُذَنَّ بِقَبْضَةِ جَرَادَاتٍ " أَيْ إِنَّمَا فِيهَا الْقِيمَةُ، وَقَوْلُهُ: " وَلَوْ "، يَقُولُ: تَحْتَاطُ فَتُخْرِجُ أَكْثَرَ مِمَّا عَلَيْكَ بَعْدَ أَنْ أَعْلَمْتُكَ أَنَّهُ أَكْثَرُ مِمَّا عَلَيْكَ.
Qasim bin Muhammad (may Allah have mercy on him) said: I was sitting with Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) when a man asked him about a locust that he kills while in ihram. Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: For it a handful of food is due, although you would surely get a handful of locusts for that; but even so (give it).
Imam al-Shafi'i (may Allah have mercy on him) said: His words 'you would surely get a handful of locusts' mean that only its value is due for it; and by 'even so' he means: you take precaution and pay out more than is due from you, after I have told you that it is more than what is due from you.
