Mustadrak al-Hakim — Hadith 962

حدثنا أبو بكر بن إسحاق الفقيه وعبد الله بن محمد بن موسى قالا: أخبرنا محمد بن أيوب، أخبرنا أحمد بن عيسى المِصْري، أخبرنا ابن وَهْب، أخبرني جَرِير بن حازم، عن سليمان بن مِهْران، عن أبي ظَبْيان، عن ابن عباس قال: مَرَّ عليُّ بن أبي طالب بمجنونةِ بني فلان وقد زَنَتَ وأَمَرَ عمر بن الخطّاب برَجْمِها، فردَّها عليٌّ، وقال لعمر: يا أمير المؤمنين، أترجُمُ هذه؟ قال: نعم، قال: أوَما تَذكُرُ أنَّ رسول الله ﷺ قال: "رُفِعَ القلمُ عن ثلاث: عن المجنون المغلوب على عَقلِه، وعن النائم حتى يستيقظَ، وعن الصبيِّ حتى يَحتلِمَ"؟ قال: صَدَقتَ، فخَلَّى عنها (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that Ali bin Abi Talib passed by the insane woman of such-and-such tribe who had committed fornication, and Umar bin al-Khattab (may Allah be pleased with him) had ordered her to be stoned. Sayyiduna Ali (may Allah be pleased with him) sent her back and said to Sayyiduna Umar: "O Commander of the Believers, will you stone her?" He said: "Yes." Sayyiduna Ali said: "Do you not remember that the Messenger of Allah (peace and blessings be upon him) said: 'The pen has been lifted from three: from the insane person whose mind is overpowered, from the sleeper until he wakes up, and from the child until he reaches puberty'?" Sayyiduna Umar said: "You have spoken the truth," and he let her go.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) حديث صحيح، وهذا إسناد رجاله ثقات إلّا أنه قد اختُلف في رفع ما رواه عليٌّ ووقفه، ومهما يكن من أمرٍ فإنه مرفوع حكمًا كما قال الحافظ ابن حجر في "الفتح" 21/ 536، على أنه قد روي عن عليٍّ من وجوه أخرى فيها التصريح برفعه إلى النبي ﷺ، فضلًا عن شواهده. سليمان بن مهران: هو الأعمش، وأبو ظبيان: هو حُصين بن جندب.
Grading: (1) The hadith is sahih and its narrators are thiqah;
Important point: although there is disagreement over whether it is marfu' or mawquf, it is in any case marfu' in ruling (hukman), as Ibn Hajar said, since there are other sahih marfu' narrations and supporting reports from 'Ali (may Allah be pleased with him).
وأخرجه أبو داود (4401)، والنسائي (7303)، والحاكم فيما سيأتي برقم (2382) من طريق أحمد بن عمرو بن السرح، وابن حبان (143) من طريق يونس بن عبد الأعلى، كلاهما عن عبد الله بن وهب، بهذا الإسناد.
Reference / Source: It was narrated by Abu Dawud (4401), al-Nasa'i (7303), al-Hakim (later at number 2382) and Ibn Hibban (143) by way of Ibn Wahb with this same chain.
وأخرجه أبو داود (4399) عن عثمان بن أبي شيبة، عن جرير بن حازم، به - وقال عن علي فيه: أما علمت أنَّ القلم قد رفع … ولم يصرِّح برفعه.
Reference / Source: It was narrated by Abu Dawud (4399) through 'Uthman bin Abi Shaybah from Jarir bin Hazim, but in it he did not explicitly make it marfu'.
وكذلك رواه وكيع عند أبي داود (4400)، وجعفر بن عون وشعبة عند المصنف فيما سيأتي برقمي (8367) و (8368)، ثلاثتهم عن سليمان بن مهران الأعمش، به.
Reference / Source: Likewise, Waki', Ja'far bin 'Awn and Shu'bah (later at numbers 8367 and 8368) narrated it by way of al-A'mash.
وأخرجه - وفيه مرويُّ عليٍّ مرفوع - أحمد 2/ (1328)، وأبو داود (4402)، والنسائي (7304) من طرق عن عطاء بن السائب، عن أبي ظبيان قال: أُتي عمر … إلخ. هكذا رواه عطاء مرسلًا، فأبو ظبيان لم يدرك عمر، ورواية الأعمش أقوى وأصح بإثبات الواسطة وهو ابن عباس.
Variation in the chain: It was narrated by Ahmad 2/ (1328), Abu Dawud (4402) and al-Nasa'i (7304) through 'Ata' bin al-Sa'ib from Abu Zabyan (with 'Ali's statement in it as marfu'), who said: "'Umar was brought …". 'Ata' thus narrated it as mursal, for Abu Zabyan did not live in the time of 'Umar (may Allah be pleased with him); hence the narration of al-A'mash, which establishes the intermediary, Ibn Abbas, is stronger and more correct.
وأخرج المرفوع منه أحمد 2/ (940) و (956) و (1183)، والترمذي (1423)، والنسائي (7306)، والمصنف فيما سيأتي برقم (8369) من طريق الحسن البصري، وأبو داود (4403) من طريق أبي الضحى وابن ماجه (2042) من طريق القاسم بن يزيد، ثلاثتهم عن علي بن أبي طالب، ورواية هؤلاء عن عليٍّ الغالب أنها منقطعة. وحسَّنه الترمذي.
Reference / Source: It was narrated by Ahmad 2/ (940) and elsewhere, al-Tirmidhi (1423), al-Nasa'i (7306), al-Hakim (later at number 8369), Abu Dawud (4403) and Ibn Majah (2042) from 'Ali, but these narrators' narration from 'Ali is mostly munqati' (broken). Al-Tirmidhi called it "hasan".
وأخرجه النسائي (7307) من طريق يونس بن عبيد، عن الحسن البصري، عن علي موقوفًا، وجعله أولى بالصواب من المرفوع!
Grading: Al-Nasa'i (7307) narrated it through al-Hasan al-Basri from 'Ali as "mawquf" and declared this more correct than the marfu' version.
ويشهد للمرفوع منه حديث عائشة سيأتي برقم (2381)، وإسناده صحيح.
Corroborating chains and supporting reports: It is supported by the sahih hadith of 'A'ishah (may Allah be pleased with her), which will come later at number (2381).
وآخر من حديث أبي قتادة، سيأتي أيضًا برقم (8370)، وإسناده ضعيف.
Corroborating chains and supporting reports: The hadith of Abu Qatadah (may Allah be pleased with him) is also a supporting report for it (later at number 8370), but its chain is da'if.
