Mustadrak al-Hakim — Hadith 8347

أخبرنا أبو عبد الله محمد بن يعقوب الشَّيباني، حدَّثنا إبراهيم بن عبد الله السَّعْدي ومحمد بن أحمد بن أنس القُرشي، قالا: حدَّثنا أبو عاصم الضَّحَّاك بن مَخْلَد الشَّيباني، حدَّثنا زكريا بن إسحاق، عن عمرو بن دينار، عن طاووس، عن ابن عباس: أنَّ صفوان بن أُمية أتى النبيَّ ﷺ برجلٍ قد سَرَقَ حُلَّةً له، ثم قال: يا رسول الله، هَبْهُ لي، فقال رسول الله ﷺ: "فهَلَّا قبل أن تأتيَنا به" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. والحديث المُفسَّر فيه:

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that Sayyiduna Safwan bin Umayyah (may Allah be pleased with him) brought to the Prophet (peace and blessings be upon him) a man who had stolen a garment (hullah) of his. Then he said: "O Messenger of Allah, I have granted it to him (that is, I have pardoned him)." So the Messenger of Allah (peace and blessings be upon him) said: "Why did you not do so before bringing him to us?"
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) صحيح لغيره، وهذا إسناد رجاله ثقات، لكن اختلف على طاووس في وصله عن ابن عباس وإرساله، والمرسل أصحُّ سندًا وأكثر عددًا. لكن له عدة مخارج يصحُّ بها، سنذكرها هنا وعند حديث صفوان بن أمية التالي.
Grading: This hadith is "sahih li-ghayrihi", and the narrators of this isnad are thiqah (trustworthy).
Technical note / Defect ('illah): However, there is disagreement over Tawus as to whether he narrated it from Ibn Abbas as "mawsul" (connected) or as "mursal". In terms of isnad and the number of narrators, the "mursal" narration is more authentic. Nevertheless, this hadith has several other outlets (routes) through which it is authentic; we will mention them here and under the following hadith of Safwan bin Umayyah.

Details of the narration: It was narrated by Amr bin Dinar from Tawus, and there was disagreement over him too:
فرواه زكريا بن إسحاق - وهو المكي - عن عمرو بن دينار عند الدارقطني (3469)، وعند الحاكم.
Details of the narration: Zakariyya bin Ishaq — who is al-Makki — narrated it from Amr bin Dinar, in al-Daraqutni (3469) and in al-Hakim.
وخالفه سفيانُ بن عيينة عند الشافعي في "الأم" 7/ 326 و 375، وسعيد بن منصور في "السنن" (2352)، وابن أبي شيبة 14/ 231، والفاكهي في "أخبار مكة" (2075)، والنسائي (7329)، وأبي القاسم البغوي في "معجم الصحابة" (1274)، والطحاوي في "مشكل الآثار" (2385) و (2387)، والبيهقي 8/ 265، فرواه عن عمرو، عن طاووس مرسلًا.
Technical note / Defect ('illah): He was contradicted by Sufyan bin Uyaynah, as found in al-Shafi'i's "al-Umm" 7/ 326 and 375, Sa'id bin Mansur's "al-Sunan" (2352), Ibn Abi Shaybah 14/ 231, al-Fakihi's "Akhbar Makkah" (2075), al-Nasa'i (7329), Abu al-Qasim al-Baghawi's "Mu'jam al-Sahabah" (1274), al-Tahawi's "Mushkil al-Athar" (2385) and (2387), and al-Bayhaqi 8/ 265. Sufyan narrated it from Amr (bin Dinar), from Tawus, as "mursal".
وأخرجه عبد الرزاق (18938) عن ابن جريجٍ، عن عمرو بن دينار مرسلًا، لم يذكر طاووسًا وابن عباس.
Corroborating chains and supporting reports: It was also recorded by Abd al-Razzaq (18938) from Ibn Jurayj, from Amr bin Dinar, as "mursal"; he did not mention Tawus or Ibn Abbas.
وورواه عبدُ الله بن طاووس عن أبيه مرسلًا لم يذكر ابنَ عباس عند عبد الرزاق (18939)، وأحمد 24/ (15306) و 45/ (27640)، والنسائي (7330)، والطحاوي (2388)، والطبراني في "الأوسط" (6841)، وابن عبد البر في "التمهيد" 11/ 219 من طريقين عنه.
Corroborating chains and supporting reports: It was also narrated by Abd Allah bin Tawus from his father (Tawus) as "mursal", without mentioning Ibn Abbas, as in Abd al-Razzaq (18939), Ahmad 24/ (15306) and 45/ (27640), al-Nasa'i (7330), al-Tahawi (2388), al-Tabarani in "al-Awsat" (6841), and Ibn Abd al-Barr in "al-Tamhid" 11/ 219, via two routes from him.
وأخرجه النسائي (7327)، والدارمي (2345)، والطحاوي في "مشكل الآثار" (2382)، والطبراني في "الكبير" (7327) و (11703) من طريق أشعث بن سوّار، عن عكرمة، عن ابن عباس. وأشعث بن سوار ضعيف.
Corroborating chains and supporting reports: It was also narrated by al-Nasa'i (7327), al-Darimi (2345), al-Tahawi in "Mushkil al-Athar" (2382), and al-Tabarani in "al-Kabir" (7327) and (11703), via Ash'ath bin Sawwar, from Ikrimah, from Ibn Abbas.
Grading: And Ash'ath bin Sawwar is a da'if (weak) narrator.
وخالف أشعثَ عبدُ الملك بن أبي بشير - وهو ثقة - عند النسائي (7326)، فرواه عن عكرمة، عن صفوان بن أمية. وعكرمة لا يعرف له سماع من صفوان كما قال ابن القطان الفاسي في "بيان الوهم والإيهام" 3/ 570.
Technical note / Defect ('illah): Ash'ath was contradicted by Abd al-Malik bin Abi Bashir — who is thiqah — as in al-Nasa'i (7326); he narrated it from Ikrimah, from Safwan bin Umayyah. And it is not known that Ikrimah heard from Safwan, as Ibn al-Qattan al-Fasi said in "Bayan al-Wahm wa al-Iham" 3/ 570.

General principle: On the topic of it being recommended for people to pardon hadd offences among themselves before the matter reaches the ruler, there are narrations from a number of Companions; see them under the hadith of Abd Allah bin Mas'ud (may Allah be pleased with him) that will come as number (8354).
