Mustadrak al-Hakim — Hadith 8321

فأخبرني عبد الله بن محمد الكَعْبي (4)، حدَّثنا محمد بن أيوب، حدَّثنا يحيى بن المغيرة السَّعْدي، حدَّثنا جَرير، عن المغيرة، عن عبد الرحمن بن أبي نُعْم، عن ابن عُمر ونَفَرٍ من أصحاب النبيِّ ﷺ قالوا: قال رسول الله ﷺ: "مَن شَرِبَ الخمرَ فاجلِدُوه، فإن شَرِبَ فاجلِدُوه، فإن شَرِبَ فاجلِدُوه، ثم إن شَرِبَ الرابعةَ فاقتُلوه" (5).
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) and a group of the Companions that the Messenger of Allah (peace and blessings be upon him) said: "Whoever drinks wine, flog him; then if he drinks again, flog him; then if he drinks a third time, flog him; then if he drinks a fourth time, kill him."

Technical note / Defect ('illah): (4) In manuscripts (Z) and (K) this word has been corrupted into "al-Kutbi"; what has been adopted is taken from manuscript (M).
(5) إسناده صحيح. محمد بن أيوب: هو ابن الضُّريس، وجرير هو ابن عبد الحميد، والمغيرة: هو ابن مِقسم. وسلف برقم (8313).
Grading: (5) Its isnad is sahih.
Technical note / Defect ('illah): Muhammad bin Ayyub: he is Ibn al-Durays; Jarir: he is Ibn Abd al-Hamid; and al-Mughirah: he is Ibn Miqsam. It has already passed as number (8313).
