فحدَّثَناه أبو زكريا العَنْبري، حدَّثنا أبو عبد الله البُوشَنْجي، حدَّثنا أحمد بن حنبل، حدَّثنا عبد الرزاق، أخبرنا مَعمَر، عن سهيل بن أبي صالح، عن أبيه، عن أبي هريرة، أن النبيَّ ﷺ قال: "مَن شَرِبَ الخمرَ فاجلِدُوه، ثم إذا شَرِبَ فاجلِدُوه، ثم إذا شَرِبَ فاجلِدُوه، ثم إذا شَرِبَ في الرابعة فاقتُلُوه" (1). قال مَعمَر: فَحَدَّثَتُ به محمد بن المُنكدِر فقال: قد تُرِكَ ذلك بعدُ، أُتِيَ النبيُّ ﷺ بابن النُّعَيمان فجلدَه، ثم أُتِي به فجلدَه، ثم أُتِيَ به فجلدَه، ثم أُتِي به في الرابعة فجلدَه، ولم يَزِدْ على ذلك (1). فأما حديثُ معاوية:
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "Whoever drinks wine, flog him; then if he drinks again, flog him; then if he drinks a third time, flog him; then if he drinks the fourth time, kill him." Ma'mar said: I narrated this hadith to Muhammad bin al-Munkadir, and he said: This (command to kill) was later abandoned, for Ibn al-Nu'ayman was brought to the Prophet (peace and blessings be upon him) and he (peace and blessings be upon him) flogged him; then he was brought again and he (peace and blessings be upon him) flogged him; then he was brought a third time and he (peace and blessings be upon him) flogged him; then when he was brought the fourth time, he (peace and blessings be upon him) still only flogged him and did not add anything more (to the punishment).

(1) إسناده صحيح على اختلاف وقع في صحابيه كما بيناه في الرواية السابقة. أبو عبد الله البوشنجي: هو محمد بن إبراهيم بن سعيد العبدري. Grading: (1) Its chain is sahih, despite the disagreement that occurred about its Companion, as we explained in the previous narration. Technical note / Defect ('illah): Abu Abdullah al-Bushanji is Muhammad bin Ibrahim bin Sa'id al-Abdari. وهو في "مصنف عبد الرزاق" (13549) و (17081)، ومن طريقه أخرجه أحمد 13/ (7762)، والنسائي (5277). وتابع معمرًا عليه ابن جريج فيما ذكر الترمذي في "جامعه" بإثر (1444). Reference / Source: It is in the "Musannaf of Abd al-Razzaq" (13549, 17081), and through his route Ahmad (13/7762) and al-Nasa'i (5277) transmitted it. Corroborating chains and supporting reports: Ibn Jurayj corroborated Ma'mar, as al-Tirmidhi mentioned in his "Jami'" after (1444).
(1) رواية محمد بن المنكدر عن النبي ﷺ هنا مرسلة، ووصلها محمد بن إسحاق عن ابن المنكدر عن جابر بن عبد الله عند المصنف برقم (8322)، وإسنادها ضعيف، يأتي الكلام عليها هناك. Technical note / Defect ('illah): (1) The narration of Muhammad bin al-Munkadir from the Prophet (peace and blessings be upon him) here is "mursal". Muhammad bin Ishaq narrated it as "connected" from Ibn al-Munkadir, from Jabir bin Abdullah, which is with the author (al-Hakim) at no. (8322), but its chain is weak; it will be discussed there. ولقصة النُّعيمان انظر حديث عُقبة بن الحارث الآتي برقم (8324).
