Mustadrak al-Hakim — Hadith 8313

فحدَّثَناه إبراهيم بن عِصْمة بن إبراهيم، حدَّثنا أبي، حدَّثنا يحيى بن يحيى، أخبرنا جَرير، عن مُغِيرة، عن عبد الرحمن بن أبي نُعْم، عن ابن عمر قال: قال رسول الله ﷺ: "مَن شَرِبَ الخمرَ فاجلِدُوه، فإن شَرِبَ فاجلِدُوه [فإن شَرِبَ فاجلِدُوه] (1) فإن شَرِبَ فاقتُلُوه" (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. وأما حديثُ أبي هريرة ﵁:

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever drinks wine, flog him; if he drinks again, flog him; if he drinks again, flog him; and if he drinks the fourth time, kill him."
This hadith is sahih on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Technical note / Defect ('illah): (1) The wording between the brackets we have recorded from the narration coming below at no. (8321) and from the sources that transmit the hadith.

(2) إسناده صحيح. جرير: هو ابن عبد الحميد، ومغيرة: هو ابن مِقسَم.
Grading: (2) Its chain is sahih.
Technical note / Defect ('illah): Jarir is Ibn Abd al-Hamid, and Mughirah is Ibn Miqsam.
وأخرجه النسائي (5151) و (5281) عن إسحاق بن إبراهيم، عن جرير بن عبد الحميد، بهذا الإسناد. وقرن مع ابن عمر فيه نفرًا، وهو كذلك في رواية الحاكم الآتية برقم (8321) من طريق يحيى بن المغيرة السعدي عن جرير.
Reference / Source: Al-Nasa'i (5151, 5281) narrated it from Ishaq bin Ibrahim, from Jarir bin Abd al-Hamid, with this same chain.
Details of the narration: In it he coupled some other persons with Ibn Umar, and it is likewise in al-Hakim's narration coming soon at no. (8321), through the route of Yahya bin al-Mughirah al-Sa'di (from Jarir).
ووقع في رواية النسائي الثانية مكان عبد الرحمن بن أبي نعم: عبد الرحمن بن إبراهيم، قال الحافظ ابن حجر في "النكت الظراف" 5/ 477: هكذا قرأته بخط المزي في لحق "الأطراف"، وفي الهامش بخط الحسيني: لم يذكر - يعني المزي - عبد الرحمن بن إبراهيم هذا في "التهذيب"، ولعله عبد الرحمن بن أبي نعم.
Technical note / Defect ('illah): In al-Nasa'i's second narration the name "Abd al-Rahman bin Ibrahim" appears in place of Abd al-Rahman bin Abi Nu'm. Al-Hafiz Ibn Hajar says in "al-Nukat al-Ziraf" (5/477): "I read it like this in al-Mizzi's handwriting in a marginal addition to 'al-Atraf', while in the margin, in the handwriting of al-Husayni, it says: He (al-Mizzi) did not mention this Abd al-Rahman bin Ibrahim in 'al-Tahdhib'; perhaps he is Abd al-Rahman bin Abi Nu'm."
وأخرجه أحمد 10/ (6197)، وأبو داود (4483) من طريق حميد بن يزيد أبي الخطاب، عن نافع، عن ابن عمر. لكنه شكّ في القتل، الرابعة أو الخامسة. وفي رواية أبي داود قال: وأحسبه قال في الخامسة: "إن شربها فاقتلوه". وحميد بن يزيد لم يرو عنه غير حماد بن سلمة، وقال الذهبي في "الميزان": لا يدرى من هو.
Reference / Source: Ahmad (10/6197) and Abu Dawud (4483) narrated it through the route of Humayd bin Yazid Abu al-Khattab, from Nafi', from Ibn Umar (may Allah be pleased with them both).
Details of the narration: But he was unsure regarding the killing, whether it was the fourth time or the fifth. In Abu Dawud's narration the narrator said: "I think he said on the fifth time: If he drinks it, kill him."
Technical note / Defect ('illah): No one narrated from Humayd bin Yazid except Hammad bin Salamah, and al-Dhahabi said in "al-Mizan": "It is not known who he is."
