Mustadrak al-Hakim — Hadith 8312

فأخبرناه بكر بن محمد الصَّيرَفي بمَرُو، حدَّثنا عبد الصمد بن الفضل، حدَّثنا مكِّيُّ بن إبراهيم، حدَّثنا داود بن يزيد، عن سِمَاك بن حَرْب، عن خالد بن جَرير (1) عن جَرِير قال: قال رسول الله ﷺ: "إِنْ شَرِبَ الخمرَ فاجلِدُوه، فإن عادَ فاجلِدُوه، فإن عادَ فاجلِدُوه، فإن عادَ في الرابعة فاقتُلُوه" (2). وأما حديثُ عبد الله بن عمر ﵄:

It is narrated from Sayyiduna Jarir bin Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "If someone drinks wine, flog him; if he drinks again, flog him again; if he drinks a third time, flog him again; and if he drinks the fourth time, kill him."

Technical note / Defect ('illah): (1) In the handwritten manuscripts this name has been corrupted and written as "Hazm".

(2) إسناده ضعيف من أجل داود بن يزيد - وهو الأودي - وقد أسقط الوساطة بين سماك وخالد، وهي محمد بن حرب أخو سماك، ومحمد هذا تفرَّد بالرواية عنه أخوه سماك، وروى له مسلم بعض حديثٍ، ووثقه النسائي، وذكره ابن حبان في "ثقاته". وانظر "العلل" للدارقطني (3330).
Grading: (2) Its chain is weak because of Dawud bin Yazid, who is al-Awdi.
Technical note / Defect ('illah): He dropped the intermediary between Simak and Khalid, and that intermediary is "Muhammad bin Harb" (Simak's brother). His brother Simak is alone in narrating from this Muhammad; Imam Muslim narrated part of a hadith from him, al-Nasa'i declared him trustworthy, and Ibn Hibban mentioned him in "al-Thiqat". See al-Daraqutni's "al-'Ilal" (3330).
وخالد بن جرير روى عنه سماك بن حرب، ومنهم من يدخل بينه وبين سماك أخا سماك كما قال ابن أبي حاتم، ولم يذكر هو والبخاري فيه تعديلًا ولا جرحًا، وذكره ابن حبان في "ثقاته".
Technical note / Defect ('illah): Simak bin Harb narrated from Khalid bin Jarir, and some narrators insert Simak's brother (Muhammad) between him and Simak, as Ibn Abi Hatim said. He (Ibn Abi Hatim) and al-Bukhari mentioned neither praise nor criticism of Khalid bin Jarir, but Ibn Hibban mentioned him in "al-Thiqat".
وأخرجه البخاري في "التاريخ الكبير" 3/ 142، والطحاوي في "شرح معاني الآثار" 3/ 159، والطبراني في "الكبير" (2398)، والخطيب في "المتفق والمفترق" (534) من طريق مكي بن إبراهيم، والطبراني في "الكبير" (2397) من طريق الصباح بن محارب، كلاهما عن داود بن يزيد الأودي، بهذا الإسناد.
Reference / Source: Al-Bukhari narrated it in "al-Tarikh al-Kabir" (3/142), al-Tahawi in "Sharh Ma'ani al-Athar" (3/159), al-Tabarani in "al-Kabir" (2398) and al-Khatib in "al-Muttafiq wa'l-Muftariq" (534) through the route of Makki bin Ibrahim, and al-Tabarani in "al-Kabir" (2397) through the route of al-Sabbah bin Muharib, both of them from Dawud bin Yazid al-Awdi, with this same chain.
وخالف داودَ إبراهيم بن طهمان في "مشيخته" (14) - ومن طريقه الدارقطني في "العلل" (3330)، وابن شاهين في "ناسخ الحديث" (526) - فرواه عن سماك عن أخيه محمَّد بن حرب عن ابن جرير عن أبيه. وقال الدارقطني: وهو الصحيح.
Technical note / Defect ('illah): Ibrahim bin Tahman contradicted Dawud in his "Mashyakhah" (14), and through his route al-Daraqutni in "al-'Ilal" (3330) and Ibn Shahin in "Nasikh al-Hadith" (526) narrated it: he narrated it from Simak, from his brother Muhammad bin Harb, from Ibn Jarir, from his father. Al-Daraqutni said: "This is the correct one."
وقال ابن شاهين عقبه: هذا حديث غريب، لا أعلم أنّ سماكًا حدّث عن أخيه إلَّا هذا، وابن جرير هذا اسمه خالد بن جرير.
Note / Clarification: Ibn Shahin said after it: "This hadith is gharib; I do not know that Simak narrated anything from his brother except this, and this Ibn Jarir's name is Khalid bin Jarir."
