Mustadrak al-Hakim — Hadith 8270

حدثني محمد بن صالح بن هانئ، حدثنا الحسين بن محمد بن زياد، حدثنا محمد بن المثنَّى ومحمد بن بشّار، قالا: حدثنا محمد بن جعفر، حدثنا شُعبة، عن قَتَادة، عن يونس بن جُبَير، عن كَثير بن الصَّلت قال: كان ابن العاص وزيدُ بن ثابت يَكتُبانِ المصاحفَ، فمَرًا على هذه الآية فقال زيد: سمعتُ رسولَ الله ﷺ يقول: "الشيخُ والشيخةُ فارجُمُوهما البَتّةَ"، فقال عمرُ: لما أُنزلت أتيتُ النبيَّ ﷺ فقلتُ: أكتُبُها؟ فكأنه كَرِهَ ذلك. فقال له عمر: ألا ترى أنَّ الشيخ إذا زَنَى وقد أَحْصَنَ جُلِدَ ورُجِمَ، وإن لم يُحصَنْ جُلِدَ، وأنَّ الثيِّبَ إِذا زَنَى وقد أَحصَنَ رُجِمَ (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Kathir bin al-Salt that Ibn al-As and Sayyiduna Zayd bin Thabit (may Allah be pleased with him) were writing the copies of the Qur'an (masahif). When they reached this verse, Zayd said: I heard the Messenger of Allah (peace and blessings be upon him) say: "The old man and the old woman, stone them both without fail." At this Sayyiduna Umar (may Allah be pleased with him) said: When it was revealed, I came to the Prophet (peace and blessings be upon him) and said: Shall I write it down (in the Qur'an)? And he (peace and blessings be upon him) disliked that. Then Umar (may Allah be pleased with him) said (explaining): Do you not see that when an old man commits adultery while he is muhsan (married), he is flogged and also stoned, and if he is not muhsan he is flogged; and likewise, when a married person commits adultery while being married, he is stoned?
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: The "Ibn al-As" mentioned in the report is Sa'id bin al-As bin Abi Uhayhah al-Umawi.
وأخرجه النسائي (7107) عن محمد بن المثنى وحده، بهذا الإسناد.

وأخرج النسائي (7110) من طريق خالد بن الحارث، والبيهقي 8/ 211 من طريق محمد بن أبي عدي، كلاهما عن عبد الله بن عون، عن محمد بن سِيرين قال: نُبِّئت عن ابن أخي كثير بن الصلت، قال: كنا عند مروان وفينا زيد بن ثابت، فقال زيد: كنا نقرأ: (الشيخ والشيخة فارجموهما البتة)، فقال مروان: ألا تجعله في المصحف؟ قال: ألا ترى أنَّ الشابَّين الثيبين يرجمان، ذكرنا ذلك وفينا عمر، فقال: أنا أَشفيكم، قلنا: وكيف ذلك؟ قال: أذهب إلى رسول الله ﷺ إن شاء الله، فأذكر كذا وكذا، فإذا ذكر آية الرجم، فأقول: يا رسول الله أَكتِبني آية الرجم، قال: فأتاه، فذكر ذلك له، فذكر آية الرجم، فقال: يا رسول الله، أَكتِبني آية الرجم، قال: "لا أستطيع". وابن أخي كثير هذا لا يعرف قاله ابن حجر.
Reference / Source: Al-Nasa'i (7110) narrated it through the route of Khalid bin al-Harith, and al-Bayhaqi (8/211) through the route of Muhammad bin Abi Adi, both from Abdullah bin Awn, from Muhammad bin Sirin, who said: I was informed on the authority of the nephew of Kathir bin al-Salt, who said: We were with Marwan, and Zayd bin Thabit was among us. Zayd said: We used to recite (in the Qur'an): {The old man and the old woman (when they commit adultery), stone them both without doubt}. Marwan said: Why do you not put it in the Mushaf? He said: Do you not see that young married people are also stoned? We mentioned that while Umar (may Allah be pleased with him) was among us, and he said: I will settle this for you. We said: How so? He said: If Allah wills, I will go to the Messenger of Allah (peace and blessings be upon him) and mention such-and-such, and when he mentions the verse of stoning, I will say: O Messenger of Allah, dictate the verse of stoning to me. The narrator said: So he went to him and mentioned that to him, and he mentioned the verse of stoning, so Umar said: O Messenger of Allah, dictate the verse of stoning to me. He (peace and blessings be upon him) said: "I cannot do so (i.e., its recitation has been abrogated)."
Technical note / Defect ('illah): This nephew of Kathir is "not known" (unidentified); this was stated by al-Hafiz Ibn Hajar.
وخالفهما يزيد بن زريع فيما قاله المزي في "تحفة الأشراف" 3/ 225، فرواه عن ابن عون عن محمد بن سِيرين قال: نُبِّئت عن كثير بن الصلت.
Technical note / Defect ('illah): Yazid bin Zuray' contradicted the two of them, as al-Mizzi stated in "Tuhfat al-Ashraf" (3/225): he narrated it from Ibn Awn, from Muhammad bin Sirin, who said: I was informed on the authority of Kathir bin al-Salt.
وقال البيهقي عقبه: آية الرجم حكمها ثابت، وتلاوتها منسوخة وهذا مما لا أعلمُ فيه خلافًا.
General principle: Al-Bayhaqi said after it: The ruling of the verse of stoning is established while its recitation is abrogated, and this is among the matters on which I know of no disagreement.
وأخرج البخاري (6829)، ومسلم (1691) - واللفظ له - عن ابن عباس قال: قال عمر بن الخطاب وهو جالس على منبر رسول الله ﷺ: إنَّ الله قد بعث محمدًا ﷺ بالحق، وأنزل عليه الكتاب، فكان ممّا أنزل عليه آية الرجم، قرأناها ووعيناها وعقلناها، فرجم رسول الله ﷺ ورجمنا بعده، فأخشى إن طال بالناس زمان أن يقول قائل: ما نجد الرجمَ في كتاب الله فيضلُّوا بترك فريضة أنزلها الله، وإن الرجم في كتاب الله حقّ على من زنى إذا أَحصَن من الرجال والنساء، إذا قامت البيّنة، أو كان الحَبَل أو الاعتراف.
Reference / Source: Al-Bukhari (6829) and Muslim (1691) (the wording is Muslim's) narrated from Ibn Abbas (may Allah be pleased with them both) that he said: Umar bin al-Khattab (may Allah be pleased with him) said while sitting on the pulpit of the Messenger of Allah (peace and blessings be upon him): "Allah sent Muhammad (peace and blessings be upon him) with the truth and revealed the Book to him, and among what was revealed to him was the verse of stoning. We recited it, memorised it and understood it. The Messenger of Allah (peace and blessings be upon him) carried out stoning, and we carried out stoning after him. I fear that if a long time passes over people, someone will say: We do not find stoning in the Book of Allah, and so they will go astray by abandoning an obligation that Allah revealed. Stoning in the Book of Allah is a right due upon whoever commits adultery while married, whether man or woman, when the evidence is established, or there is pregnancy, or a confession."
وأخرجه مالك في "الموطأ" 2/ 824، ومن طريقه أحمد 1/ (249)، والترمذي (1431) من طريق سعيد بن المسيب عن عمر بن الخطاب بنحوه. قال الترمذي: حديث عمر حديث حسن صحيح، وروي من غير وجه عن عمر.
Reference / Source: Malik narrated it in "al-Muwatta'" (2/824), and through his route Ahmad (1/249) and al-Tirmidhi (1431), via Sa'id bin al-Musayyab from Umar bin al-Khattab (may Allah be pleased with him), with similar wording. Imam al-Tirmidhi said: The hadith of Umar is "hasan sahih", and it has been narrated from Umar (may Allah be pleased with him) through more than one route.
