Mustadrak al-Hakim — Hadith 8249

فحدَّثنا أبو الوليد، حدثنا محمد بن إسحاق، حدثنا محمد بن عيسى، حدثنا أبو بكر بن عيّاش عن عاصم، عن أبي رَزِين، عن ابن عباس قال: مَن أتى بهيمةً فليس عليه حدٌّ (1).

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he said: "Whoever commits (bestiality) with an animal, there is no hadd (prescribed legal punishment) upon him."

(1) رجاله لا بأس بهم، لكن لما سُئل البخاري كما في "العلل الكبير" للترمذي عن سماع أبي رزين - واسمه مسعود بن مالك - من ابن عباس قال: قد أدركه، وروى عن أبي يحيى عن ابن عباس.
Grading of the chain: There is no harm in its narrators, but when al-Bukhari was asked (as in al-Tirmidhi's "al-Ilal al-Kabir") whether Abu Razin, whose name is Mas'ud bin Malik, heard from Ibn Abbas, he said: "He was his contemporary, and he narrates (through an intermediary) from Abu Yahya, from Ibn Abbas."
قلنا: يعني أنه لم يجزم بسماعه منه، لأن بينهما أبا يحيى واسمه مِصدع، ويعرف بالمعرقب، ومصدع هذا قال عمار الدهني: كان عالمًا بابن عباس، وقال العجلي: ثقة. وقال ابن حبان في "المجروحين": كان ممّن يخالف الأثبات في الروايات، وينفرد عن الثقات بألفاظ الزيادات ممّا يوجب ترك ما انفرد منها، والاعتبار بما وافقهم فيها. وعدَّه ابن حجر في "التقريب" مقبولًا يعني عند المتابعة.
Analysis: We say: This means that Imam al-Bukhari did not affirm with certainty that he heard (directly) from him, because between them is "Abu Yahya", whose name is "Misda'" and who is known as "al-Mu'arqab". Ammar al-Duhni said: He was knowledgeable about Ibn Abbas. Al-Ijli called him "thiqah". Ibn Hibban said in "al-Majruhin": "He was among those who contradicted the reliable narrators in their narrations and was alone, against the thiqah narrators, in additional wordings, which requires abandoning what he narrated alone and giving consideration only to what agrees with them." Ibn Hajar counted him in "al-Taqrib" as "maqbul" (acceptable), i.e., when corroborated.
محمد بن إسحاق: هو ابن خُزَيمة، ومحمد بن عيسى هو ابن زياد الدامغاني، عاصم: هو ابن بهدلة.
Identification of narrators: "Muhammad bin Ishaq" is "Ibn Khuzaymah", "Muhammad bin Isa" is "Ibn Ziyad al-Damghani", and "Asim" is "Ibn Bahdalah".
وأخرجه أبو داود (4465) عن أحمد بن يونس، عن شريك وأبي الأحوص وأبي بكر بن عياش، عن عاصم بن بهدلة، بهذا الإسناد. وقال عقبه: حديث عاصم يضعَّفُ حديث عمرو بن أبي عمرو. يعني السالف قبل حديث.
Reference / Source: Abu Dawud (4465) narrated it from Ahmad bin Yunus, from Sharik, Abu al-Ahwas and Abu Bakr bin Ayyash, from Asim bin Bahdalah, with this same chain. Abu Dawud said after it: "The hadith of Asim weakens the hadith of Amr bin Abi Amr" (i.e., the one that passed one hadith earlier).
وأخرجه الترمذي في "الجامع" بإثر (1455)، وفي "العلل الكبير" (428) من طريق سفيان الثوري، والنسائي (7301) من طريق أبي حنيفة النعمان، كلاهما عن عاصم، به.
Reference / Source: Al-Tirmidhi narrated it in "al-Jami'" (after no. 1455) and in "al-Ilal al-Kabir" (428) via Sufyan al-Thawri, and al-Nasa'i (7301) via Abu Hanifah al-Nu'man; both of them from Asim, with this same chain.
وقال الترمذي: وهذا أصحُّ من الحديث الأول (يعني حديث عمرو بن أبي عمرو) والعمل على هذا عند أهل العلم، وهو قول أحمد وإسحاق. وقال النسائي: هذا غير معروف والأول هو المحفوظ. يعني الحديث الذي رواه عمرو بن أبي عمرو بذكر اللَّعن لا القتل، وهو السالف عند النسائي برقم (7299)، والتالي عند الحاكم.
Statements of the imams: Al-Tirmidhi said: "This is more sahih than the first hadith (the hadith of Amr bin Abi Amr), and the practice of the scholars is according to this; it is the view of Ahmad and Ishaq." Al-Nasa'i said: "This (the narration about killing) is not known, and the first (Amr's) is the mahfuz (preserved) one." That is, the hadith that Amr bin Abi Amr narrated mentioning "cursing" rather than killing, which passed with al-Nasa'i at (7299) and is the next one with al-Hakim.
