Mustadrak al-Hakim — Hadith 8246

حدثنا أحمد بن سهل الفقيه ببُخارى، أخبرنا أبو عِصمةَ سهل بن المُتوكِّل، حدثنا القَعْنَبي، حدثنا عبد الرحمن بن عبد الله بن عمر بن حفص بن عاصم بن عمر بن الخطّاب، عن سُهيل بن أبي صالح، عن أبيه، عن أبي هريرة قال: قال رسول الله ﷺ: "مَن عَمِلَ عمل قوم لوطٍ، فارجُموا الفاعلَ والمفعولَ به" (1).

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever commits the act of the people of Lut, stone both the one who does it and the one to whom it is done."

Grading of the chain: Its chain is "very weak".
Technical note: Abd al-Rahman bin Abd Allah al-Umari is "matruk" (abandoned), and he has been corroborated by something that does not establish proof. Al-Dhahabi declared it defective for this reason in "al-Talkhis" and said: "Abd al-Rahman is saqit (worthless)."
وأخرجه الخرائطي في "مساوئ الأخلاق" (417)، والآجري في "ذم اللواط" (28) و (31) من طريق يعقوب بن محمد الزهري، عن عبد الرحمن بن عبد الله بن عمر، بهذا الإسناد.
Reference / Source: Al-Khara'iti narrated it in "Masawi' al-Akhlaq" (417) and al-Ajurri in "Dhamm al-Liwat" (28, 31) via Ya'qub bin Muhammad al-Zuhri, from Abd al-Rahman bin Abd Allah bin Umar, with this same chain.
وأخرجه ابن ماجه (2562) من طريق عاصم بن عمر بن حفص العمري، وابن حزم في "المحلى" 11/ 383 من طريق القاسم بن عبد الله بن عمر العمري، كلاهما عن سهيل بن أبي صالح، به.
Reference / Source: Ibn Majah (2562) narrated it via Asim bin Umar bin Hafs al-Umari, and Ibn Hazm in "al-Muhalla" (11/383) via al-Qasim bin Abd Allah bin Umar al-Umari; both of them from Suhayl bin Abi Salih, with this same chain.
ورواية القاسم بلفظ القتل لا الرجم وعاصم بن عمر العمري متفق على ضعفه، والقاسم بن عبد الله تالف، واتهمه الإمام أحمد. وقد أشار الترمذي في "جامعه" بإثر الحديث (1456) إلى حديث عاصم، فقال: هذا حديث في إسناده مقال، ولا نعلم أحدًا رواه عن سهيل بن أبي صالح غير عاصم بن عمر العمري! وعاصم بن عمر يضعف في الحديث من قبل حفظه. وقال ابن حزم: وأما حديث أبي هريرة، فانفرد به القاسمُ بن عبد الله بن عمر بن حفص! وهو مطَّرَح في غاية السقوط.
Criticism and details: Al-Qasim's narration has the wording of "killing", not "stoning". Asim bin Umar al-Umari is agreed upon to be weak, and al-Qasim bin Abd Allah is "talif" (ruined, extremely weak), and Imam Ahmad accused him (of lying). After hadith (1456), al-Tirmidhi pointed to the hadith of Asim and said: "This is a hadith whose chain is criticised, and we do not know anyone who narrated it from Suhayl bin Abi Salih other than Asim bin Umar al-Umari! And Asim bin Umar is considered weak in hadith because of his memory." Ibn Hazm said: "As for the hadith of Abu Hurayrah, al-Qasim bin Abd Allah bin Umar bin Hafs is alone in it! And he is discarded, utterly worthless."
ووقع إسناد لهذا الحديث عند ابن حزم 11/ 384: عبيد الله بن رافع، عن عاصم بن عبيد الله، عن سهيل بن أبي صالح. ونرى أنه تحرَّف عن عبد الله بن نافع عن عاصم بن عمر، خاصة أنه من رواية يونس بن عبد الأعلى عن عبد الله بن نافع، وهو شيخ ابن ماجه فيه.
Analysis and correction: In Ibn Hazm (11/384) one chain of this hadith occurs as: "Ubayd Allah bin Rafi', from Asim bin Ubayd Allah, from Suhayl bin Abi Salih." We think this is a corruption of "Abd Allah bin Nafi', from Asim bin Umar", especially since it is from the narration of Yunus bin Abd al-A'la from Abd Allah bin Nafi', who is Ibn Majah's shaykh for it.
