(1) ضعيف مرفوعًا، قوي موقوفًا، عمرو مولى المطلب وإن كان صدوقًا لكن أحاديثه عن عكرمة كلُّها مضطربة كما قال الإمام أحمد، فيما نقله عنه ابن رجب في "شرح العلل" 2/ 798.
Grading: As "marfu'" it is weak, whereas as "mawquf" it is strong (qawi).
Technical note: Although Amr the mawla of al-Muttalib is "saduq" (truthful), all his hadiths from Ikrimah are "mudtarib" (inconsistent), as Imam Ahmad said (as Ibn Rajab quoted from him in "Sharh al-Ilal" 2/798).
وقد اضطرب في لفظ هذا الحديث، فرواه مرةً بلفظ القتل، ومرةً بلفظ الرجم، ومرة بلفظ اللعن، ورواه غيره - كما سيأتي - فوقفه على ابن عباس، وهو الصواب. وقد أنكر العلماءُ روايتَه عن عكرمة عامةً، وهذا الحديثَ خاصةً، فقال ابن معين كما في "كامل ابن عدي" 5/ 116: عمرو بن أبي عمرو ثقة، يُنكر عليه حديث عكرمة عن ابن عباس أنَّ النبي ﷺ قال: "اقتلوا الفاعل والمفعول فيه". وقال البخاري كما في "علل الترمذي" ص 236: صدوق، ولكن روى عن عكرمة مناكير، ولم يذكر في شيء من ذلك سمع من عكرمة. وقال العجلي: أنكروا عليه حديث البهيمة (وهو قسم من هذا الحديث، وسيأتي بعد حديث). وقال أبو داود: حديث عاصم (يعني: ليس على الذي يأتي البهيمة حدٌّ، الآتي عند المصنف برقم 8249) يُضعَّف حديث عمرو بن أبي عمرو. ونقل ابن قدامة في "المغني" 12/ 352 أنَّ الإمام أحمد لا يُثبت حديث عمرو بن أبي عمرو.
Inconsistency and criticism: Amr was inconsistent in the wording of this hadith: sometimes he narrated it with the wording of "killing", sometimes with the wording of "stoning", and sometimes with the wording of "cursing". Others, as will come, narrated it as "mawquf" on Ibn Abbas, and this is correct. The scholars rejected his narration from Ikrimah in general, and this hadith in particular.
Statements of the imams: Ibn Ma'in said ("al-Kamil" of Ibn Adi 5/116): "Amr bin Abi Amr is thiqah, but his hadith from Ikrimah, from Ibn Abbas, that the Prophet (peace and blessings be upon him) said, 'Kill the one who does it and the one to whom it is done', is regarded as munkar." Al-Bukhari said ("Ilal al-Tirmidhi" p. 236): "He is saduq, but he narrated munkar reports from Ikrimah, and in none of them did he state that he heard from Ikrimah." Al-Ijli said: "They rejected his 'hadith of the animal' (about bestiality) (which is part of this hadith and comes one hadith later)." Abu Dawud said: "The hadith of Asim (i.e., 'There is no hadd punishment on one who has intercourse with an animal', coming with the author at no. 8249) weakens the hadith of Amr bin Abi Amr." Ibn Qudamah quoted in "al-Mughni" (12/352) that Imam Ahmad did not consider the hadith of Amr bin Abi Amr established.
وسيأتي عند المصنف برقم (8250) بلفظ اللعن بدل القتل، وهذا من اضطراب عمرو فيه.
Note: This hadith will come with the author (al-Hakim) at number (8250) with the wording of "cursing" instead of killing, and this is part of Amr's inconsistency in this hadith.
وأخرجه البيهقي 8/ 231 عن أبي عبد الله الحاكم، بهذا الإسناد. وقرن به أبا بكر القاضي.
Reference / Source: Al-Bayhaqi (8/231) narrated it from Abu Abd Allah al-Hakim, with this same chain, and paired Abu Bakr al-Qadi with him.

وأخرجه الآجري في ذم "اللواط" (26) من طريق محمد بن داود بن رزق، عن ابن وهب، به.
Reference / Source: Al-Ajurri narrated it in "Dhamm al-Liwat" (26) via Muhammad bin Dawud bin Rizq, from Ibn Wahb, with this same chain.
وأخرجه الطبراني في "الكبير" (11527) من طريق عبد العزيز بن يحيى المدني، حدثنا سليمان بن بلال، عن حسين بن عبد الله، عن عكرمة به، فجعل مكان عمرو بن أبي عمرو حسينَ بن عبد الله بن عبيد الله بن عباس، وعبد العزيز المدني متروك متهم، وحسين ضعيف، فلا يفرح به.
Sources and criticism: Al-Tabarani narrated it in "al-Kabir" (11527) via Abd al-Aziz bin Yahya al-Madani, from Sulayman bin Bilal, from Husayn bin Abd Allah, from Ikrimah. Here he mentioned "Husayn bin Abd Allah bin Ubayd Allah bin Abbas" in place of Amr bin Abi Amr.
Technical note: Abd al-Aziz al-Madani is "matruk and accused (of lying)", and Husayn is "weak", so this narration is nothing to rejoice over (i.e., it is not reliable).
أحمد 4/ (2732)، وأبو داود (4462)، وابن ماجه (2561)، والترمذي (1456) من طريق عبد العزيز بن محمد الدراوردي، عن عمرو بن أبي عمرو، به.
Reference / Source: Ahmad (4/2732), Abu Dawud (4462), Ibn Majah (2561) and al-Tirmidhi (1456) narrated it via Abd al-Aziz bin Muhammad al-Darawardi, from Amr bin Abi Amr, with this same chain.
وأخرجه موقوفًا أبو داود (4463) من طريق عبد الرزاق، والنسائي (7298) من طريق محمد بن ربيعة، كلاهما عن ابن جريج قال: أخبرني ابن خثيم - وهو عبد الله بن عثمان - قال: سمعت سعيد بن جبير ومجاهدًا يحدثان عن ابن عباس في البكر يوجد على اللُّوطية، قال: يُرجَم.
Mawquf sources: It was narrated as "mawquf" by Abu Dawud (4463) via Abd al-Razzaq and by al-Nasa'i (7298) via Muhammad bin Rabi'ah; both of them from Ibn Jurayj, who said: Ibn Khuthaym, who is Abd Allah bin Uthman, informed me; he said: I heard Sa'id bin Jubayr and Mujahid narrating from Ibn Abbas, regarding an unmarried man found committing sodomy, that he said: "He is to be stoned."
وإسناده قوي. وعند النسائي مكان مجاهدٍ عكرمةُ، وهو وهم، فقد جاء على الصواب عند الدارقطني في "سننه" (3235)، ورواه أيضًا كرواية عبد الرزاق محمدُ بن بكر عند ابن أبي شيبة 9/ 530، وروحُ بن عبادة عند ابن المنذر في "الأوسط" (9650)، كلاهما عن ابن جريج على الصواب.
Grading of the chain: Its chain is strong (qawi).
Technical note: In al-Nasa'i's version the name "Ikrimah" is in place of Mujahid, which is an error (wahm). The correct name comes in al-Daraqutni's "al-Sunan" (3235). Also, like the narration of Abd al-Razzaq, it was narrated by Muhammad bin Bakr in Ibn Abi Shaybah (9/530) and by Rawh bin Ubadah in Ibn al-Mundhir's "al-Awsat" (9650); both of them narrated it from Ibn Jurayj with the correct name.
وروى ابن معين في "التاريخ" (4639 - رواية الدوري)، وابن أبي شيبة 9/ 529، وابن أبي الدنيا في ذم "الملاهي" (125)، والآجري في ذم "اللواط" (30)، والبيهقي 8/ 232 من طريق أبي نضرة قال: سئل ابن عباس: ما حدُّ اللوطي؟ قال: يُنظَر أعلى بناء في القرية فيُرمى به منكَّسًا، ثم يُتبَع بالحجارة. ورجاله ثقات، فلو كان فيه عند ابن عباس حكمٌ مرفوع إلى النبي ﷺ، ما تعدّاه إلى رأيه، والله تعالى أعلم.
Sources of the report: Ibn Ma'in in "al-Tarikh" (4639, narration of al-Duri), Ibn Abi Shaybah (9/529), Ibn Abi al-Dunya in "Dhamm al-Malahi" (125), al-Ajurri in "Dhamm al-Liwat" (30) and al-Bayhaqi (8/232) narrated via Abu Nadrah that Ibn Abbas was asked: What is the punishment of the sodomite? He said: "The highest building in the town is to be sought out and he is to be thrown from it head-first, then pelted with stones."
Grading of the chain: Its narrators are thiqah.
Inference: Had Ibn Abbas possessed a "marfu'" ruling from the Prophet (peace and blessings be upon him) on this, he would not have passed over it to his own opinion; and Allah the Exalted knows best.
قال الترمذي في "جامعه": اختلف أهل العلم في حد اللوطي، فرأى بعضهم: أنَّ عليه الرجم أحصن أو لم يُحصن، وهذا قول مالك والشافعي وأحمد وإسحاق.
Juristic schools: Al-Tirmidhi says in "al-Jami'": The scholars differed over the punishment of the sodomite. Some held that he is to be "stoned" whether married or unmarried; this is the view of Malik, al-Shafi'i, Ahmad and Ishaq.
وقال بعض أهل العلم من فقهاء التابعين منهم: الحسن البصري وإبراهيم النخعي وعطاء بن أبي رباح وغيرهم، قالوا: حدُّ اللوطي حدُّ الزاني، وهو قول الثّوري وأهل الكوفة.
Juristic schools: Some scholars among the jurists of the Tabi'in, such as al-Hasan al-Basri, Ibrahim al-Nakha'i, Ata' bin Abi Rabah and others, said: The punishment of the sodomite is that of the adulterer (i.e., stoning for the married and flogging for the unmarried); this is the view of Sufyan al-Thawri and the people of Kufah.
قال الخطابي: رتّب الفقهاء القتل المأمور به (يعني في اللوطة) على معاني ما جاء فيه في أحكام الشريعة، فقالوا: يقتل بالحجارة رجمًا إن كان محصنًا، ويُجلد مئة إن كان بكرًا، ولا يُقتل. وإلى هذا ذهب سعيد بن المسيب وعطاء بن أبي رباح والنخعي والحسن وقتادة، وهو أظهر قولَي الشافعي، وحُكي ذلك أيضًا عن أبي يوسف ومحمد وقال الأوزاعي: حكمُه حكمُ الزاني، وقال مالك بن أنس وإسحاق بن راهويه: يُرجم إن أَحصن أولم يُحصن، روي ذلك عن الشعبي، وقال أبو حنيفة: يُعزّر ولا يُحدّ، وذلك أنَّ هذا الفعل ليس عندهم بزني.
Juristic details: Al-Khattabi says: The jurists arranged the killing that is commanded (i.e., for sodomy) according to the meanings of what has come on it in the rulings of the Shari'ah. They said: If he is married, he is to be killed by stoning with stones, and if he is unmarried, he is to be flogged a hundred lashes and not killed. Sa'id bin al-Musayyab, Ata' bin Abi Rabah, al-Nakha'i, al-Hasan and Qatadah held this, and it is the more evident of al-Shafi'i's two views; it is also reported from Abu Yusuf and Muhammad. Al-Awza'i said: His ruling is that of the adulterer. Malik bin Anas and Ishaq bin Rahawayh said: He is to be stoned whether married or not; this is also reported from al-Sha'bi. And Abu Hanifah said: He is given "ta'zir" (discretionary punishment), not the hadd, because in their view this act is not "zina".
والظاهرية يذهبون في ذلك مذهب أبي حنيفة، يعني في تعزير من فَعَل هذا الفعل كقول أبي حنيفة.
Juristic schools: The Zahiris follow the school of Abu Hanifah in this matter, i.e., that whoever commits this act is given ta'zir.
