Mustadrak al-Hakim — Hadith 8240

وقد أخبرَناه محمد بن محمد بن عبد الله (1)، حدثنا مَحْمِش (2) بن عِصام، حدثنا حفص بن عبد الله. وحدثنا أبو الحسن محمد بن الحسين بن داود العلَوَي، حدثنا أحمد بن محمد بن الحسن الحافظ، حدثنا أحمد بن حفص، حدثني أبي، حدثنا إبراهيم بن طَهْمان، عن منصور بن المُعتمِر، عن إبراهيم، عن أبي مَعْمَر، عن مسروق، عن عائشة أمِّ المؤمنين أنها قالت: لا يَحِلُّ دمُ أحدٍ من أهل القبلة إلَّا بإحدى ثلاث: رجلٌ قَتَلَ فيُقتَلُ به، والثيِّبُ الزاني، والمُفارِقُ للجماعة (3).
It is narrated from the Mother of the Believers, Sayyidah Aishah (may Allah be pleased with her), that she said: "Shedding the blood of anyone from the people of the Qiblah is not lawful except in three cases: a man who killed someone, so he is killed in retaliation for him; the married adulterer; and the one who separates from the community (jama'ah)."

(1) تحرَّف في النسخ الخطية إلى: محمد بن عبد الله بن محمد، مقلوبًا. وهو محمد بن محمد بن عبد الله الشَّعِيري.
Correction: In the manuscripts the name has been inverted into "Muhammad bin Abd Allah bin Muhammad", whereas the correct form is "Muhammad bin Muhammad bin Abd Allah al-Sha'iri".

(2) تحَرّف في النسخ إلى: محمد.
Correction: In the manuscripts the name is corrupted into just "Muhammad".

(3) صحيح مرفوعًا، وهذا إسناد لا بأس برجاله إبراهيم: هو ابن يزيد النخعي، وأبو معمر: هو عبد الله بن سخبرة.
Grading: It is sahih as "marfu'".
Grading of the chain: There is no harm in the narrators of this chain. (The narrator) Ibrahim is "Ibn Yazid al-Nakha'i", and Abu Ma'mar is "Abd Allah bin Sakhbarah".
وأخرجه الدارقطني في "السنن" (3095)، وفي "العلل" 5/ 255 من طريق أبي عامر عبد الملك بن عمرو العقدي، عن إبراهيم بن طهمان بهذا الإسناد.
Reference / Source: Al-Daraqutni narrated it in "al-Sunan" (3095) and "al-Ilal" (5/255) via Abu Amir Abd al-Malik bin Amr al-Aqadi, from Ibrahim bin Tahman, with this same chain.
وتابع إبراهيمَ بنَ طهمان جريرُ بن عبد الحميد، فرواه عن منصور به موقوفًا عند ابن أبي شيبة 414/ 9، والدارقطني (3096) من طريقين عن جرير به.
Corroboration: Jarir bin Abd al-Hamid corroborated Ibrahim bin Tahman: he narrated it from Mansur as "mawquf", as found in Ibn Abi Shaybah (9/414), and al-Daraqutni (3096) narrated it through two routes from Jarir.
