(1) خبر واهٍ كما قال الذهبي في "التلخيص"، وهذا الإسناد غريب ضعيف؛ فداود بن عبد الحميد ضعّفه أبو حاتم الرازي، وقال الأزدي: منكر الحديث، وقال البزار والعقيلي: روى عن عَمْرو بن قيس الملائي أحاديث لا يتابع عليها. ويغلب على ظننا أنَّ هذا الخبر إنما حمله داود عن أبي إسرائيل الملائي وقد كان غاليًا في التشيع، وضعّفه وترك الحديث عنه غيرُ واحد من الأئمة، فالمعروف في هذا الحديث أنه من رواية أبي إسرائيل عن عطية العوفي عن أبي سعيد كما سيأتي.
Grading: This report is "wahin" (extremely weak), as al-Hafiz al-Dhahabi said in "al-Talkhis".
Technical note: This chain is gharib and weak; (the narrator) Dawud bin Abd al-Hamid was declared weak by Abu Hatim al-Razi, al-Azdi said he is "munkar al-hadith", and al-Bazzar and al-Uqayli said: He narrated from Amr bin Qays al-Mula'i hadiths in which he is not corroborated.
Researchers' view: Our strong presumption is that Dawud actually took this report from "Abu Isra'il al-Mula'i", who was extreme in Shi'ism, and several imams declared him weak and abandoned narrating from him. What is well known about this hadith is that it is from the narration of Abu Isra'il, from Atiyyah al-Awfi, from Abu Sa'id al-Khudri, as is coming.
وأما عطية - وهو ابن سعد - العوفي فضعيف مع تشيّعه أيضًا.
Criticism and praise (jarh wa ta'dil): As for Atiyyah, who is Ibn Sa'd al-Awfi, he too is a "weak" narrator, besides his Shi'ism.
عُبَيدٌ العِجْل: لقبه، واسمه حسين بن محمد بن حاتم.
Identification of the narrator: "Ubayd al-Ijl" is his nickname, and his name is "Husayn bin Muhammad bin Hatim".
وأخرجه البزار (3348 - كشف الاستار)، وكذا أبو طاهر السَّلفي في "الطيوريات" (644) من طريق محمد بن عبد الله الحضرمي، كلاهما (البزار والحضرمي) عن إسحاق بن إبراهيم البغوي، بهذا الإسناد. وقال البزار: أحاديث داود عن عمرو لا نعلم أحدًا تابعه عليها.
Reference / Source: Al-Bazzar (3348 - Kashf al-Astar) narrated it, and likewise Abu Tahir al-Silafi in "al-Tuyuriyyat" (644) via Muhammad bin Abd Allah al-Hadrami; both of them (al-Bazzar and al-Hadrami) narrate it from Ishaq bin Ibrahim al-Baghawi, with this same chain.
Statement of al-Bazzar: Imam al-Bazzar said: "As for the hadiths of Dawud from Amr, we do not know anyone who corroborated him in them."
وأخرج الشطر الأول منه أحمد 17/ (11341) و 18 / (11845)، والبزار (1534 - كشف الأستار)، والعقيلي في "الضعفاء" (92)، وابن عدي في "الكامل" 1/ 290، والبيهقي في "السنن" 8/ 126 من طرق ثمانية عن أبي إسرائيل الملائي، عن عطية العوفي، عن أبي سعيد. ولفظه: وُجد قتيل بين قريتين أو ميت، فأمر رسول الله ﷺ فرع ما بين القريتين إلى أيهما كان أقرب، فوجد أقرب إلى إحداهما بشبر، قال: فكأني انظر إلى شبر رسول الله ﷺ فجعله على الذي كان أقرب. قال الإمام أحمد - كما في ترجمة إسماعيل بن أبي إسحاق أبي إسرائيل الملائي من "الجرح والتعديل" 2/ 166 - : روى حديثًا منكرًا في القتيل. وقال العقيلي ما جاء به غيره، وليس له أصل.
Sources and details: The first part of this hadith was narrated by Ahmad (17/11341 and 18/11845), al-Bazzar (1534 - Kashf al-Astar), al-Uqayli in "al-Du'afa'" (92), Ibn Adi in "al-Kamil" (1/290) and al-Bayhaqi in "al-Sunan" (8/126), through eight different routes from Abu Isra'il al-Mula'i, from Atiyyah al-Awfi, from Abu Sa'id.
Text: Its wording is: "A slain man, or a dead man, was found between two villages, so the Messenger of Allah (peace and blessings be upon him) ordered that the distance between the two villages be measured to see which of them he was closer to, and he was found to be closer to one of them by a hand-span. The narrator said: It is as if I am looking at the hand-span of the Messenger of Allah (peace and blessings be upon him), and he assigned him to the village that was closer."
Criticism: Imam Ahmad said (as found in the biography of Isma'il bin Abi Ishaq Abu Isra'il al-Mula'i in "al-Jarh wa al-Ta'dil" 2/166): "He narrated a munkar hadith about the slain man." Al-Uqayli said: "No one else brought it, and it has no basis."
وقال البيهقي: تفرد به أبو إسرائيل عن عطية العوفي وكلاهما لا يحتج بروايتهما.
Statement of al-Bayhaqi: Imam al-Bayhaqi said: "Abu Isra'il is alone in narrating it from Atiyyah al-Awfi, and the narration of neither of them can be used as proof."
وأخرج الترمذي (1398) من طريق يزيد بن أبان الرقاشي، عن أبي الحكم البجلي قال: سمعت أبا سعيد الخدري وأبا هريرة يذكران عن رسول الله ﷺ قال: "لو أن أهل السماء والأرض اشتركوا في دم مؤمن لأكبَّهم الله في النار". وقال: غريب. قلنا: ويزيد الرقاشي متفق على ضعفه.
Reference / Source: Al-Tirmidhi (1398) narrated it via Yazid bin Aban al-Raqashi, from Abu al-Hakam al-Bajali, who said: I heard Abu Sa'id al-Khudri and Abu Hurayrah (may Allah be pleased with them both) mention from the Messenger of Allah (peace and blessings be upon him) that he said: "If the people of the heavens and the earth joined together in the blood (killing) of a believer, Allah would throw them all face-down into the Fire."
Technical note: Al-Tirmidhi called it "gharib". We say: Yazid al-Raqashi is agreed upon to be weak.
ورواه أبو حمزة الأغور عند الطبراني في "الأوسط" (1421) و (9242)، والبيهقي في "الشعب" (4968) عن أبي الحكم البجلي، عن أبي هريرة وحده. وأبو حمزة الأعور - واسمه ميمون - متفق على ضعفه.
Supporting reports: Abu Hamzah al-A'war narrated it, in al-Tabarani's "al-Awsat" (1421 and 9242) and al-Bayhaqi's "Shu'ab al-Iman" (4968), from Abu al-Hakam al-Bajali, from Abu Hurayrah alone.
Criticism: Abu Hamzah al-A'war, whose name is Maymun, is agreed upon by the hadith scholars to be weak.
وفي الباب عن ابن عباس عند الطبراني في "الكبير" (12681)، وابن عدي في "الكامل" 5/ 367، وأبي نعيم في "الحلية" 5/ 62، والبيهقي 8/ 22 وإسناده ضعيف، تفرد به عطاء بن مسلم الخفاف، وهو ضعيف، وفيه عنعنة حبيب بن أبي ثابت عن ابن عباس.
Supporting reports: On this topic there is a narration from Ibn Abbas (may Allah be pleased with them both) in al-Tabarani's "al-Kabir" (12681), Ibn Adi's "al-Kamil" (5/367), Abu Nu'aym's "al-Hilyah" (5/62) and al-Bayhaqi (8/22).
Grading of the chain: Its chain is weak; Ata' bin Muslim al-Khaffaf, who is weak, is alone in it, and it also contains the "'an'anah" (narrating with "from" without stating direct hearing) of Habib bin Abi Thabit from Ibn Abbas.
وعن أبي بكرة الثقفي عند أبي عمرو السَّمرقندي في "فوائده" (48)، والطبراني في "الصغير" (565)، وإسناده ضعيف أيضًا.
Supporting reports: Also there is a narration from Abu Bakrah al-Thaqafi (may Allah be pleased with him) in Abu Amr al-Samarqandi's "al-Fawa'id" (48) and al-Tabarani's "al-Saghir" (565), and its chain is also weak.
وسلف الشطر الثاني منه عند المصنف برقم (4768) من حديث أبي نضرة عن أبي سعيد.
Reference / Source: The second part of this hadith has already passed with the author (al-Hakim) (no. 4768), from the hadith of Abu Nadrah from Abu Sa'id.
