It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "A believer does not kill by treacherous surprise attack (fatk); faith has restrained treacherous killing."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Hadith Takhrij«
Explanation & Benefits
Shaykh Adil Murshid et al.
Manuscript variants: In manuscripts (Z) and (K) the word is "yuqtal" (is killed).
Grading: Hasan li-ghayrihi. Technical note: This chain is "weak" because Abd al-Rahman, who is Ibn Abi Karimah al-Suddi, is unknown (majhul). Reference / Source: Abu Dawud (2769) narrated it via Ishaq bin Mansur, from Asbat, with this same chain. Supporting reports: It is supported by the following hadith of Mu'awiyah (may Allah be pleased with him). Also the hadith of al-Zubayr bin al-Awwam (may Allah be pleased with him) is a supporting report; it is in Abd al-Razzaq (9676, 9677), Ibn Abi Shaybah (15/123, 279) and Musnad Ahmad (3/1426), and its chain is "hasan" in supporting reports. Linguistic note: Imam al-Khattabi says: "Al-fatk" (treacherous killing) means killing suddenly someone who has been granted protection (aman).
