Mustadrak al-Hakim — Hadith 8039

حدَّثَناه أبو بكر بن إسحاق، حدثنا الحسن بن علي بن زياد، حدثنا إبراهيم بن موسى، حدثنا هشام بن يوسف، عن مَعمَر، عن يحيى بن أبي كثير قال: حدثني رجلٌ من بني حَنيفة، عن عِمران بن حُصَين (1)، أنَّ رسول الله ﷺ قال: "لا نذرَ في مَعصِيَةٍ" (2). الرجل الذي لم يُسمِّه معمرٌ عن يحيى هو محمد بن الزُّبير بلا شكٍّ، فإنه أراد أن يقول: من بني حنظلة، فقال: من بني حنيفة، فأما قولُه ﷺ: "لا نذرَ في معصية" فقد اتَّفق عليه الشيخان (3)، ومدار الحديث الآخر على محمد بن الزُّبير الحنظلي، وليس يصحُّ.
It is narrated from Sayyiduna Imran bin Husayn (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "A vow made in disobedience to Allah has no standing (that is, it is not to be fulfilled)."
Imam al-Hakim says that the narrator whom Ma'mar did not name, narrating from Yahya, is without doubt Muhammad bin al-Zubayr, because instead of saying "Banu Hanzalah" he mistakenly said "Banu Hanifah". As for his (peace and blessings be upon him) saying "There is no vow in disobedience", the two Shaykhs (Bukhari and Muslim) agree upon it, whereas the other hadith (about anger) revolves around Muhammad bin al-Zubayr al-Hanzali, and it is not authentic (in its chain).

(1) كذا وقع في النسخ الخطية بذكر عمران بن حصين، ووصفُ المصنف له بالمُعضَل يقتضي عدمه، وعلى ذلك جاءت رواية عبد الرزاق عن مَعمَر الآتي تخريجها، حيث لم يذكر في سنده لا الزبير والد محمد ولا عمران بن حصين، والله تعالى أعلم.
Technical note / Defect ('illah): In the manuscripts this narration occurs thus, with the mention of 'Imran bin Husayn (may Allah be pleased with him), but the author's describing this narration as "mu'dal" (a chain from which two or more consecutive narrators have dropped) requires that 'Imran should not be mentioned in it.
Important point: Accordingly, the narration of 'Abd al-Razzaq from Ma'mar (whose takhrij follows) mentions neither Muhammad's father al-Zubayr nor 'Imran bin Husayn. And Allah the Exalted knows best.

(2) صحيح بهذا اللفظ، وهذا إسناده ضعيف لإبهام الرجل الحنفي، ولإرساله، وقد صحَّ من غير هذا الطريق كما سيأتي.
Grading: With this wording the narration is "sahih", but this particular chain is "da'if", because the man from Banu Hanifah in it is "mubham" (unnamed) and the chain is "mursal".
Important point: This narration is established through other sahih routes, as will be detailed later.
وأخرجه عبد الرزاق (15815) عن مَعمَر، عن يحيى بن أبي كثير، عن رجل من بني حنيفة قال: إنَّ النبي ﷺ قال: "لا نذرّ في غضب ولا في معصية الله وكفارته كفارة يمين"، ليس فيه عمران، وزاد فيه ذكرُ الغضب.
Reference / Source: Imam 'Abd al-Razzaq (15815) narrated it through Ma'mar bin Rashid from Yahya bin Abi Kathir, via a man from Banu Hanifah.
Details of the narration: The Prophet (peace and blessings be upon him) said: "There is no vow in anger nor in disobedience to Allah, and its expiation is the expiation for an oath." This narration does not mention 'Imran (may Allah be pleased with him), and the word "ghadab" (anger) is an addition.
وأخرجه ضمن قصة أحمد 33/ (19863) و (19883) و (19894)، ومسلم (1641)، وأبو داود (3316)، وابن ماجه (2124)، والترمذي (1568)، والنسائي (4735) و (8538)، وابن حبان (4391) و (4859) من طريق أبي المهلب، عن عمران مرفوعًا بلفظ: "لا نذر في معصية الله، ولا فيما لا يملك ابن آدم".
Reference / Source: This hadith was narrated as part of a story by Imam Ahmad (33/19863, 19883, 19894), Sahih Muslim (1641), Abu Dawud (3316), Ibn Majah (2124), al-Tirmidhi (1568), al-Nasa'i (4735, 8538) and Ibn Hibban (4391, 4859) through Abu al-Muhallab al-Jarmi from 'Imran (may Allah be pleased with him) as marfu'.
Details of the narration: Its wording is: "There is no vow in disobedience to Allah, nor in what the son of Adam does not own."

(3) رواه بهذا اللفظ مسلم وحده من حديث عمران، لكن روى البخاري (6696) و (6700) من حديث عاشة مرفوعًا: "من نذر أن يطيع الله فليطعه، ومن نذر أن يعصيه فلا يعصه".
Reference / Source: With this wording only Imam Muslim narrated it, from the hadith of 'Imran (may Allah be pleased with him); but Imam al-Bukhari (6696 and 6700) narrated from 'A'ishah (may Allah be pleased with her) as marfu': "Whoever vows to obey Allah, let him obey Him; and whoever vows to disobey Him, let him not disobey Him."
