Mustadrak al-Hakim — Hadith 8038

حدَّثَناه عبد الله بن إسحاق الخُراساني، حدثنا إبراهيم بن الهيثم البَلَدي، حدثنا محمد بن كَثير الحِمصي، حدثنا الأوزاعي، حدثني يحيى، عن محمد بن الزُّبير الحنظلي، عن أبيه، عن عِمران بن حُصين، أنَّ النبي ﷺ قال: "لا نذرَ في غضب، وكفّارتُه كفارةُ يمين" (1). وقد أعضَلَه مَعمرٌ عن يحيى بن أبي كثير:
It is narrated from Sayyiduna Imran bin Husayn (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "A vow made in anger is not binding, and its expiation is like the expiation for an oath."
And (Imam al-Hakim says that) Ma'mar narrated it from Yahya bin Abi Kathir as mu'dal (with a break in the chain).

(1) إسناده ضعيف جدًّا كسابقه ولم يذكر فيه الرجل المبهم، كما أنَّ الزبير لم يسمع من عمران، قال البيهقي 10/ 70: الزبير لم يسمع من عمران، وأسند عن محمد بن الزُّبير أنَّ أباه لم يسمع من عمران. وقال النسائي في "المجتبى": قيل: إنَّ الزبير لم يسمع من عمران.
Grading: Like the previous narration, this chain is also "extremely weak", although the unnamed person is not mentioned in it.
Technical note / Defect ('illah): The main defect in it is that "al-Zubayr" did not hear from 'Imran (may Allah be pleased with him). Imam al-Bayhaqi (10/70) says that al-Zubayr did not hear from 'Imran, and he reported with a chain from Muhammad bin al-Zubayr himself that his father (al-Zubayr) did not hear from 'Imran. Imam al-Nasa'i likewise says in "al-Mujtaba" that it has been said that al-Zubayr did not hear from 'Imran.
وأخرجه النسائي في "المجتبى" (3841) من طريق بقية بن الوليد، عن الأوزاعي، بهذا الإسناد.
Reference / Source: Imam al-Nasa'i narrated it in "al-Mujtaba" (3841) through Baqiyyah bin al-Walid via Imam al-Awza'i ('Abd al-Rahman bin 'Amr), with this same chain.
لكن بلفظ: "لا نذر في معصية، وكفارتها كفارة يمين".
Details of the narration: However, the wording of this narration is: "There is no vow in disobedience, and its expiation is the expiation for an oath."
وأخرجه النسائي (3840) و (3742) و (3843) من طرق عن يحيى بن أبي كثير، به. بلفظ الغضب، إلَّا الرواية الأولى فبلفظ المعصية.
Reference / Source: Imam al-Nasa'i narrated it in several places (3840, 3742, 3843) through Yahya bin Abi Kathir with this same chain.
Details of the narration: These narrations have the word "ghadab" (anger), except the first narration (3840), in which the word "disobedience" is mentioned.
وأخرجه النسائي (3844) من طريق حماد بن زيد، عن محمد بن الزبير، به. بلفظ الغضب.
Reference / Source: Imam al-Nasa'i (3844) narrated it through Hammad bin Zayd via Muhammad bin al-Zubayr.
Details of the narration: In this narration the word "ghadab" (anger) occurs.
