(1) إسناده ضعيف، الأعمش - وهو سليمان بن مِهْران - لم يسمعه من مجاهد وهو ابن جبر - إنما سمعه من ليث بن أبي سليم عن مجاهد كما أخبر هو نفسه. وقد ذكرُ غير واحد من أهل العلم كابن المنذر في "الأوسط" 12/ 159 وابن حزم في "المحلى" 8/ 45 أنَّ هذا الرأي منسوب لمجاهد، لذلك نُرى أنَّ ليث بن أبي سليم - وهو ضعيف - وصله بذكر ابن عبّاس، وإنما هو من قول مجاهد، والله تعالى أعلم.
Grading: Its chain is "da'if".
Technical note / Defect ('illah): Al-A'mash (Sulayman bin Mihran) did not hear it directly from Mujahid bin Jabr; rather he heard it from Mujahid via Layth bin Abi Sulaym, as al-A'mash himself clarified. Ibn al-Mundhir in "al-Awsat" (12/159) and Ibn Hazm in "al-Muhalla" (8/45) mentioned that this opinion (about the exception) is Mujahid's own statement. So it appears that Layth bin Abi Sulaym (who is himself da'if) connected it to Ibn 'Abbas by name, whereas in reality it is a statement of Mujahid. And Allah knows best.
وأخرجه الطبري في "تفسيره" 2292/ 15، وأبو القاسم البغوي في "الجعديات" (814)، والطبراني في "الكبير" (11069)، و "الأوسط" (119)، والبيهقي 10/ 82 من طرق عن الأعمش، بهذا الإسناد. ووقع في هذه الطرق: قيل للأعمش: سمعتَه من مجاهد؟ قال: لا، حدثني به ليث بن أبي سليم.
Reference / Source: It was recorded by Imam al-Tabari in his "Tafsir" (15/2292), Abu al-Qasim al-Baghawi in "al-Ja'diyyat" (814), al-Tabarani in "al-Mu'jam al-Kabir" (11069) and "al-Mu'jam al-Awsat" (119), and al-Bayhaqi (10/82) through various routes from al-A'mash.
Technical note / Defect ('illah): All these narrations state explicitly that when al-A'mash was asked, "Did you hear it from Mujahid?" he replied, "No, rather Layth bin Abi Sulaym narrated it to me."
وأخرجه الطبراني في "الكبير" (11143)، و "الأوسط" (6872)، و"الصغير" (876) من طريق عبد العزيز بن الحُصين، عن عبد الله بن أبي نجيح، عن مجاهد، عن ابن عبّاس، في قول الله: ﴿وَاذْكُرْ رَبَّكَ إِذَا نَسِيتَ﴾ قال: إذا نسيت الاستثناء فاستثن إذا ذكرت. قال: هي لرسول الله ﷺ خاصة، وليس لأحد منا أن يستثني إلَّا بصلة اليمين.
Reference / Source: Al-Tabarani recorded it in "al-Mu'jam al-Kabir" (11143), "al-Mu'jam al-Awsat" (6872) and "al-Mu'jam al-Saghir" (876) through 'Abd al-'Aziz bin al-Husayn, from 'Abd Allah bin Abi Najih, from Mujahid, from Ibn 'Abbas (may Allah be pleased with them both), who said in explanation of the words of Allah the Exalted "And remember your Lord when you forget": When you forget to say in sha' Allah (in an oath), then say it when you remember.
Note / Clarification: He also said that this concession was specific to the Messenger of Allah (peace and blessings be upon him), and it is not permissible for any of us to make the exception without joining it to the oath (i.e. after a long interval).
وقال الطبراني: لم يرو هذا الحديث عن ابن أبي نجيح إلَّا عبد العزيز بن الحصين، تفرَّد به الوليد بن مسلم قلنا: وعبد العزيز بن الحصين ضعيف.
Technical note / Defect ('illah): Imam al-Tabarani says that no one narrated this hadith from Ibn Abi Najih except 'Abd al-'Aziz bin al-Husayn, and al-Walid bin Muslim is alone in reporting it (from him).
Grading: Our finding is that 'Abd al-'Aziz bin al-Husayn is a "da'if" narrator.
وأخرج الطبراني في "الكبير" (12817)، و "الأوسط" (930) من طريق سفيان بن حسين، عن يعلى بن مسلم عن جابر بن زيد، عن ابن عباس: ﴿وَلَا تَقُولَنَّ لِشَيْءٍ إِنِّي فَاعِلٌ ذَلِكَ غَدًا (23) إِلَّا أَنْ يَشَاءَ اللَّهُ وَاذْكُرْ رَبَّكَ إِذَا نَسِيتَ﴾ أن تقول: إن شاء الله. وسنده صحيح.
Reference / Source: Al-Tabarani recorded it in "al-Kabir" (12817) and "al-Awsat" (930) through Sufyan bin Husayn, from Ya'la bin Muslim, from Jabir bin Zayd (Abu al-Sha'tha'), from Ibn 'Abbas (may Allah be pleased with them both), that the meaning of the verse "And never say of anything, 'I will do that tomorrow', except (adding) 'If Allah wills'" is that if you forget (to say in sha' Allah), then say "in sha' Allah" (when you remember).
Grading: Its chain is "sahih".
قال ابن كثير في "تفسيره": ومعنى قول ابن عبّاس: أنه يستثني ولو بعد سنة أي: إذا نسي أن يقول في حلفه أو كلامه: إن شاء الله، وذكر ولو بعد سنة، فالسُّنة له أن يقول ذلك، ليكون آتيًا بسنّة الاستثناء، حتى ولو كان بعد الحنث قاله ابن جَرِير ﵀ ونصَّ على ذلك، لا أن يكون ذلك رافعًا لحنث اليمين ومسقطًا للكفارة، وهذا الذي قاله ابن جَرِير ﵀ هو الصحيح، وهو الأليَق بحمل كلام ابن عبّاس عليه، والله أعلم.
General principle: Al-Hafiz Ibn Kathir (may Allah have mercy on him) says in his "Tafsir": The meaning of the statement of Ibn 'Abbas (may Allah be pleased with them both) that "he may make the exception even after a year" is that if someone forgets to say "in sha' Allah" in his oath or speech and remembers it even a year later, it is sunnah for him to say it, so that he acts upon the sunnah of making the exception, even if this is after breaking the oath (hinth); Imam Ibn Jarir al-Tabari (may Allah have mercy on him) stated this explicitly.
Important point: This by no means implies that saying in sha' Allah late will cancel the legal ruling of the oath or remove the expiation. This statement of Ibn Jarir is correct and is the best interpretation of the words of Ibn 'Abbas. And Allah knows best.

Note / Clarification: Ibn Kathir further says: The verse may also carry another sense, namely that Allah, Mighty and Majestic, has guided the one who forgets something during his speech to remember Allah the Exalted, because forgetfulness comes from Satan, as the companion of Musa (peace be upon him) on his journey (Yusha' bin Nun) said: "And none made me forget it except"
ثم قال: ويحتمل في الآية وجه آخر، وهو أن يكون الله ﷿ قد أرشد من نسي الشيء في كلامه إلى ذكرُ الله تعالى؛ لأنَّ النسيان منشؤه من الشيطان، كما قال فتى موسى: ﴿وَمَا أَنْسَانِيهُ إِلَّا الشَّيْطَانُ أَنْ أَذْكُرَهُ﴾، وذكر الله تعالى يطرد الشيطان، فإذا ذهب الشيطان ذهب النسيان، فذكرُ الله سببٌ للذكر؛ ولهذا قال: ﴿وَاذْكُرْ رَبَّكَ إِذَا نَسِيتَ﴾.
Note / Clarification: (Completion of the previous statement): "And none made me forget it except Satan, that I should mention it." Since the remembrance of Allah the Exalted drives Satan away, and when Satan goes, forgetfulness also ends, the remembrance of Allah becomes a means of recalling what was forgotten; that is why it was said: "And remember your Lord when you forget."
وقال ابن قدامة في "المغني" 13/ 484: يشترط أن يكون الاستثناء متصلًا باليمين، بحيث لا يفصل بينهما كلام أجنبي، ولا يسكت بينهما سكوتًا يمكنه الكلام فيه، فأما السكوت لانقطاع نفسه أو صوته، أو عيّ، أو عارض من عطسة، أو شيء غيرها، فلا يمنع صحة الاستثناء، وثبوت حكمه، وبهذا قال مالك والشافعي والثَّوري وأبو عبيد وإسحاق وأصحاب الرأي، لأنَّ النبي ﷺ قال: "من حلف فاستثنى" وهذا يقتضي كونه عَقيبه، ولأنَّ الاستثناء من تمام الكلام، فاعتبر اتصاله به كالشرط وجوابه، وخبر المبتدأ، والاستثناء بإلَّا، ولأنَّ الحالف إذا سكت ثبت حكم يمينه، وانعقدت موجبة لحكمها، وبعد ثبوته لا يمكن دفعه ولا تغييره. وانظر تمام كلامه فيه.
General principle: Imam Ibn Qudamah (may Allah have mercy on him) says in "al-Mughni" (13/484): For the exception (saying in sha' Allah) to be valid, it is a condition that it be "joined" (muttasil) to the oath, such that no unrelated speech comes between them and no silence long enough for him to have spoken. However, if the silence occurred because of breath running out, the voice failing, fatigue, a sneeze, or some similar impediment, this does not prevent the exception from being valid. This is the view of Imam Malik, al-Shafi'i, al-Thawri, Abu 'Ubayd, Ishaq and Ashab al-Ra'y (the Hanafis). The evidence for this is that the Prophet (peace and blessings be upon him) said: "Whoever swears an oath 'and then' makes an exception", and the word "then" (denoting sequence) requires that it come immediately after. Moreover, the exception is the completion of the speech, so it must be joined to it, just as the condition and its consequence, and the subject and predicate, are joined. If the one swearing falls silent, the ruling of the oath becomes fixed, and once the ruling is fixed it cannot be changed or cancelled.
