Mustadrak al-Hakim — Hadith 8026

أخبرنا عبد الله بن جعفر بن دَرَستوَيهِ، حدثنا يعقوب بن سفيان، حدثنا عبد العزيز بن عبد الله الأُوَيسي، حدثنا عبد الرحمن بن أبي الرِّجال، عن أبيه، عن عَمْرة، عن عائشة قالت: أُهدَي لي لحمٌ، فأمرني رسولُ الله ﷺ أن أُهدِيَ منه لزينب، فأهديتُ لها فردَّتْه، فقال: "زِيديها"، فزدتُها، فردَّتْه، فقال: "أقسمتُ عليكِ إِلَّا زِدتِيها" فزدتُها فردَّتْه، فدخلتني غَيْرةٌ، فقلتُ: لقد أهانَتْكَ، فقال: "أنتِ وهي أهونُ على اللهِ من أن يُهِيَنني منكنَّ أحدٌ، أقسمتُ لا أدخلُ عليكنَّ شهرًا"، فغابَ عنا تسعًا وعشرينَ، ثم دخلَ علينا مساءَ الثلاثين، فقالت: كنتَ حلفتَ أن لا تدخلَ شهرًا، فقال: "شهرٌ هكذا، وشهرٌ هكذا، وفرَّق بين كفَّيِه وأمسكَ في الثالثة الإبهامَ (3).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه، وفيه البيانُ أنَّ "أقسمتُ على كذا" يمينٌ وقَسَمٌ.

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that some meat was given to me as a gift, and the Messenger of Allah (peace and blessings be upon him) instructed me to send some of it to (Sayyidah) Zaynab (may Allah be pleased with her). I sent it, but she returned it. He (peace and blessings be upon him) said: "Send her more." I sent it again, but she returned it again. He (peace and blessings be upon him) said: "I adjure you to send her more." I sent it again, but she returned it again. Aishah (may Allah be pleased with her) says: Jealousy came over me and I said: She has rejected your word. He (peace and blessings be upon him) said: "You and she are far too insignificant before Allah for any of you to be guilty of disrespect towards me. I swear that I will not come to you for a month." So he (peace and blessings be upon him) stayed away from us for twenty-nine days and came to us on the evening of the thirtieth day. Aishah (may Allah be pleased with her) said: You had sworn not to come for a month? He (peace and blessings be upon him) said: "A month is like this, and also like this," and with a gesture of both his palms he (peace and blessings be upon him) made clear that a month can also be of 29 days.
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it; it also establishes that saying "I adjure you" falls under the ruling of an oath.

Grading: Its chain is "hasan", owing to the presence of 'Abd al-Rahman bin Abi al-Rijal.
وأخرجه أحمد 41 / (24743)، وابن ماجه (2059)، وأبو نعيم في "الحلية" 9/ 40 وغيرهم من طرق عن عبد الرحمن بن أبي الرجال، بهذا الإسناد. وروايتهم مختصرة بقصة حلفه بعدم الدخول على نسائه إلا رواية أبي نعيم فمطولة بنحو رواية الحاكم.
Reference / Source: It was recorded by Ahmad (24743), Ibn Majah (2059) and Abu Nu'aym in "al-Hilyah" (9/40) through routes from 'Abd al-Rahman bin Abi al-Rijal.
Details of the narration: All their narrations are abridged to the story of the oath not to go in to the Mothers of the Believers, except the narration of Abu Nu'aym, which is detailed like the narration of Imam al-Hakim.
وأخرجه ابن سعد في "الطبقات الكبرى" 8/ 190 عن محمد بن عمر الواقدي، عن مالك وعبد الرحمن ابني أبي، الرجال، عن أبيهما، به بنحو رواية الحاكم.
Reference / Source: Ibn Sa'd reported it in "al-Tabaqat al-Kubra" (8/190) via Muhammad bin 'Umar al-Waqidi, from Malik and 'Abd al-Rahman (the sons of Abu al-Rijal), from their father, similar to the narration of Imam al-Hakim.
وأخرجه ابن سعد 8/ 188 عن الواقدي، عن أبي معشر نجيح، السندي، عن حارثة بن أبي الرجال قال: دخلت مع القاسم بن محمد على عمرة بنت عبد الرحمن فقال القاسم: يا أم محمد في أي شيء هجر رسول الله ﷺ نساءه؟ فقالت عمرة: أخبرتني عائشة: أنه أُهدي إلى رسول الله ﷺ هدية في بيتها، فأرسل إلى كل امرأة من نسائه بنصيبها، وأرسل إلى زينب بنت جحش فلم ترضَ، ثم زادوها مرة أخرى فلم ترضَ فقالت عائشة: لقد أقمَأَت وجهَك أن تردَّ عليك الهدية، فقال رسول الله ﷺ: "الأنتنَّ أهونُ على الله من أن تُقمِئنَني لا أدخل عليكنَّ شهرًا". ثم ذكرت قصة عمر في مراجعته النبي ﷺ في طلاق زوجاته بنحو حديث ابن عباس عنه المخرّجة عند البخاري (4913) ومسلم (1479).
Details of the narration: Ibn Sa'd (8/188) reported through al-Waqidi that Harithah bin Abi al-Rijal went with al-Qasim bin Muhammad to 'Amrah bint 'Abd al-Rahman, and al-Qasim asked: Why did the Messenger of Allah (peace and blessings be upon him) keep away from his wives? She said that 'A'ishah (may Allah be pleased with her) said: A gift was given to the Prophet (peace and blessings be upon him), and he sent each of his wives her share, but when he sent to Zaynab bint Jahsh she was not pleased; it was sent again, and still she was not pleased. 'A'ishah said: She has humiliated you by returning the gift. At this he (peace and blessings be upon him) said: "You are all too insignificant before Allah to humiliate me! I will not come to you for a month." Then it mentions the incident of 'Umar (may Allah be pleased with him), as in al-Bukhari (4913) and Muslim (1479).
Note / Clarification: This chain includes al-Waqidi (Muhammad bin 'Umar), who has been criticised by the hadith scholars.
وأخرجه ابن سعد 8/ 190 عن الواقدي، عن محمد بن عبد الله، عن الزهري، عن عروة، عن عائشة قالت: ذبح رسول الله ﷺ ذبحًا فأمرني فقسمتُه بين أزواجه، فأرسل إلى زينب بنت جحش بنصيبها فردّته … فذكرته مطولًا بنحو سابقه، والواقدي فيه مَقال.
Reference / Source: Ibn Sa'd (8/190) also narrated it via al-Waqidi with the chain al-Zuhri from 'Urwah from 'A'ishah, which mentions the distribution of the meat of a slaughtered animal; this narration is also lengthy like the previous one.
Note / Clarification: The imams of jarh and ta'dil (narrator criticism) have criticised Muhammad bin 'Umar al-Waqidi.
