Mustadrak al-Hakim — Hadith 8019

حدثنا محمد بن صالح بن هانئ حدثنا يحيى بن محمد بن يحيى، حدثنا الحَكَم بن موسى، حدثنا الهيثم بن حُمَيد، عن زيد بن واقد، عن بُسْر بن عُبيد الله، عن ابن عائذ، عن أبي الدَّرداء، عن النبيِّ ﷺ؛ قال: أفاءَ الله على رسولِه إبلًا ففرَّقها، فقال أبو موسى الأشعريُّ: يا رسولَ الله، أَحْذِني، قال: "لا"، فقال له ثلاثًا، فقال رسول الله ﷺ: "لا أفعلُ (2) "، قال: وبقي أربعٌ غُرُّ الذُّرَى فقال: "يا أبا موسى، خُذْهُنَّ" فقال: يا رسولَ الله، إني أستَحْيي [سألتُك] (3) فمنعتَني وحلفتَ، فأشفقتُ أن يكونَ دخلَ على رسول الله ﷺ وهمٌ، فقال رسول الله ﷺ: "إنِّي إذا حلفتُ فرأيتُ أنَّ غيرَ ذلك أفضلُ، كفَّرتُ عن يميني وأَتيتُ الذي هو أفضلُ" (4).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abu al-Darda (may Allah be pleased with him) that Allah granted His Messenger some camels as spoils (fay'), and the Prophet (peace and blessings be upon him) distributed them. Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) said: O Messenger of Allah, give me a share. He said: "No." He asked him three times, and the Messenger of Allah (peace and blessings be upon him) said: "I will not do it." Then four camels with white humps remained, and he said: "O Abu Musa, take them." He said: O Messenger of Allah, I feel shy; I asked you and you refused me and swore, and I feared that the Messenger of Allah (peace and blessings be upon him) might have become mistaken. The Messenger of Allah (peace and blessings be upon him) said: "When I swear an oath and then see that something other than it is better, I expiate my oath and do what is better."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(2) كذا وقع في نسخ "المستدرك"، بلا قسم فيه، وعند الذين أخرجوا الحديث ذكرُ القسم، وهو الصواب، إذ هو موضع الشاهد من الحديث.
Note / Clarification: In the manuscripts of "al-Mustadrak" this narration is reported like this, without the oath, whereas the other imams who recorded it mention the oath, and that is correct, since it is the very point of evidence in the hadith.

(4) صحيح لغيره، وهذا إسناد حسن من أجل الحكم بن موسى وشيخه الهيثم بن حميد. وابنُ عائذ: هو أبو إدريس الخَولاني كما جاء مصرَّحًا به في رواية الطبراني، وقد اختلف في اسمه، فقيل: عائذ الله بن عبد الله، ويقال فيه: عيِّذ الله بن إدريس بن عائذ، كما قال الذهبي في "سير النبلاء" 4/ 272.
Grading: This narration is "sahih li-ghayrihi" (sahih due to supporting reports), while this chain is "hasan" because of al-Hakam bin Musa and his shaykh al-Haytham bin Humayd.
Technical note / Defect ('illah): Ibn 'A'idh refers to "Abu Idris al-Khawlani", as is stated explicitly in the narration of al-Tabarani. There is a difference of opinion about his name: according to one view his name is 'A'idh Allah bin 'Abd Allah, and some said 'Ayyidh Allah bin Idris bin 'A'idh, as Imam al-Dhahabi mentioned in "Siyar A'lam al-Nubala'" (4/272).
وقد انبهم أمرُه على الحافظ ابن حجر فترجم له في إتحاف المهرة 12/ 609: ابن عائذ عن أبي الدرداء، ولم ينسبه! مع أنَّ البخاري وغيره قد رووا بهذه السلسلة يعني زيد بن واقد عن بسر عن أبي إدريس عن أبي الدرداء - غير ما حديث واعتبره البعض عبد الرحمن بن عائذ كما في "أطراف الغرائب" للمقدسي (4666)، وهذا بعيد، فهذه السلسلة معروفة كما تقدَّم، أضف إلى ذلك أنه لا يعرف رواية له عن أبي الدرداء، ولا يعرف لبسر رواية عن عبد الرحمن بن عائد.
Technical note / Defect ('illah): The identity of this narrator remained hidden from al-Hafiz Ibn Hajar, so in "Ithaf al-Maharah" (12/609) he gave an entry under "Ibn 'A'idh from Abu al-Darda'" but did not make his lineage clear! Yet Imam al-Bukhari and others narrated several hadiths with this very chain: "Zayd bin Waqid from Busr bin 'Ubayd Allah from Abu Idris al-Khawlani from Abu al-Darda'". Some identified him as "'Abd al-Rahman bin 'A'idh", as in al-Maqdisi's "Atraf al-Ghara'ib" (4666), but this is far-fetched, because the above-mentioned chain is well known; moreover, no narration of 'Abd al-Rahman bin 'A'idh from Abu al-Darda' (may Allah be pleased with him) is known, nor any narration of Busr from 'Abd al-Rahman bin 'A'idh.
وأخرجه أبو عوانة في "صحيحه" (5955) و (5960)، والطبراني في "مسند الشاميين" (1301)، والبيهقي 10/ 52 من طرق عن الحكم بن موسى، بهذا الإسناد. وعند الطبراني: أبو إدريس مكان ابن عائذ.
Reference / Source: It was recorded by Abu 'Awanah in his "Sahih" (5955 and 5960), al-Tabarani in "Musnad al-Shamiyyin" (1301) and al-Bayhaqi (10/52), through various routes from al-Hakam bin Musa, with this same chain. In al-Tabarani's narration "Abu Idris" (Abu Idris al-Khawlani) is mentioned in place of "Ibn 'A'idh".
وقد ورد هذا الحديث من حديث أبي موسى الأشعري نفسه عند البخاري (3133)، ومسلم (1649).
Details of the narration: This hadith is also narrated from Abu Musa al-Ash'ari (may Allah be pleased with him) himself, recorded by Imam al-Bukhari (3133) and Imam Muslim (1649).
قوله: "أحْذِني" رباعي، أي: أعطني. وفي لغة حَذَاه، فيكون من الفعل الثلاثي.
Note / Clarification: The word "ahdhini" in the text is from the form af'ala (a four-letter verb) and means "give me". In one dialect "hadhahu" is also used, which is the simple three-letter form.
و"غُرُّ الذُّرى": بيض الأسنمة.
Note / Clarification: "Ghurr al-dhura" means (camels) with white humps.
