حدثناه أبو بكر بن إسحاق، أخبرنا أبو المثنَّى، حدثنا مُسدَّد، حدثنا يزيد بن زُرَيع، حدثنا حَبيب المعلِّم، عن عمرو بن شُعيب، عن سعيد بن المسيّب: أنَّ أخوينِ من الأنصار كان بينهما مِيراثٌ، فسأل أحدُهما صاحبَه القسمةَ، فقال: لئن عُدْتَ سألتَني القسمةَ لم أكلِّمْك أبدًا، وكلُّ مالي في رِتَاج الكعبة، فقال عمر بن الخطاب إنَّ الكعبةَ لَغنيّةٌ عن مالِك، كَفِّرْ عن يمينك وكلِّمْ أخاك، فإنِّي سمعتُ رسول الله ﷺ يقول: "لا يمينَ عليك ولا نذرَ في معصيةِ الرَّبِّ، ولا في قطيعةِ الرَّحِم، ولا فيما لا تَملِكُ" (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. Sa'id bin al-Musayyib narrates that there was a matter of dividing an inheritance between two brothers of the Ansar. One of them asked the other (for the division), and he swore: If you ask me again, I will never speak to you, and all my wealth is dedicated to the Ka'bah. Sayyiduna Umar (may Allah be pleased with him) said: The Ka'bah has no need of your wealth; expiate your oath and speak to your brother, for I heard the Messenger of Allah (peace and blessings be upon him) say: "No oath or vow is binding upon you in disobedience to Allah, in severing ties of kinship, or in what you do not own."
This hadith has a sahih (authentic) chain, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده إلى سعيد بن المسيب حسن، وسماع سعيد من عمر مشَّاه كبار العلماء كأحمد وابن معين. أبو المثنّى: هو معاذ بن المثنى العنبري. Grading: Its chain up to Sa'id bin al-Musayyab is hasan. Technical note / Defect ('illah): Sa'id bin al-Musayyab's hearing from Umar (may Allah be pleased with him) has been accepted by major scholars such as Imam Ahmad and Ibn Ma'in. Note / Clarification: Abu al-Muthanna means Mu'adh bin al-Muthanna al-Anbari. وقال الدارقطني في "العلل" (181) عن هذا الحديث وسابقه: يشبه أن يكونا صحيحين. Important point: Imam al-Daraqutni says in "al-Ilal" (181) about this hadith and the one before it: "It seems likely that both of them are sahih." وأخرجه ابن حبان (4355) عن أبي خليفة الفضل بن حُباب، عن مسدد، بهذا الإسناد. Reference / Source: Ibn Hibban narrated it (4355) by the route of Abu Khalifah al-Fadl bin Hubab via Musaddad with this same chain. وأخرجه أبو داود (3272) عن محمد بن المنهال، عن يزيد بن زريع، به. Reference / Source: Imam Abu Dawud (3272) narrated it by the route of Muhammad bin al-Minhal via Yazid bin Zuray' with this same chain. قوله: "رِتاج" بكسر الراء الباب، والمقصود جوف الكعبة، لأنَّ الجوف يُدخَل إليه من بابها. Note / Clarification: In the hadith the word "ritaj" (with a kasrah under the ra') means a door, and what is meant is the interior (jawf) of the Ka'bah, because one enters the inside of the Ka'bah through its door.
