Mustadrak al-Hakim — Hadith 8011

حدثني علي بن حَمْشَاذَ العَدْل، حدثنا إسماعيل بن إسحاق القاضي، حدثنا مسلم بن إبراهيم، حدثنا عُبَيس بن ميمون، حدثنا يحيى بن أبي كثير، عن أبي سَلَمة، عن أبي هريرة قال: قال رسول الله ﷺ: "مَن حَلَفَ على يمين فهو كما حَلَفَ، إن قال: هو يهوديٌّ، فهو يهوديٌّ، وإن قال: هو نَصرانيٌّ، فهو نَصرانيُّ، وإن قال: هو بَريء من الإسلام، فهو بَريءٌ من الإسلام، ومن ادَّعى دُعاءَ الجاهلية فإنه من جُثَى جهنَّم" قالوا: يا رسول الله، وإن صام وصلَّى؟ قال: "وإن صام وصلَّى" (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever swears an oath (of this kind) about something, he is as he said: if he said he is a Jew (if such-and-such happens), then he is a Jew; if he said he is a Christian, then he is a Christian; and if he said he is free of Islam, then he is indeed free of Islam. And whoever makes the call of the Jahiliyyah (invokes tribal partisanship) is one of the heaps of Hell." The Companions said: O Messenger of Allah, even if he fasts and prays? He (peace and blessings be upon him) said: "Even if he fasts and prays."
This hadith has a sahih (authentic) chain, but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) إسناده ضعيف جدًّا من أجل عُبيس بن ميمون: وهو التيمي الخزاز، فهو متفق على ضعفه.
Grading: Its chain is "very weak" on account of Ubays bin Maymun (al-Taymi al-Khazzaz), since the hadith scholars agree that he is weak.
وبه أعلّه الذهبي في "تلخيصه" وقال: الخبر منكر.
Grading: Imam al-Dhahabi in "al-Talkhis" declared it defective (ma'lul) because of this same narrator and said that this report is "munkar".
وأخرجه أبو يعلى (6006) - وعنه ابن حبان في "المجروحين" 2/ 186 - 187 - عن الحسن بن عمر بن شقيق عن عبيس بن ميمون، بهذا الإسناد.
Reference / Source: Abu Ya'la (6006) narrated it, and via him Ibn Hibban in "al-Majruhin" (2/ 186-187), with the chain of al-Hasan bin Umar bin Shaqiq by the route of Ubays bin Maymun.
والنهي عن دعوى الجاهلية صحَّ من حديث ابن مسعود عند البخاري (1294) ومسلم (103). قوله: "جُثى" بضم الجيم مقصورًا، أي: جماعتهم، جمع جثوة، بالحركات الثلاث: وهي الحجارة المجموعة، وروي من "جُثِيّ" بتشديد الياء وضم الجيم جمع جاثٍ، وكسر الجيم جائز. قاله على القاري في "شرح المشكاة".
Important point: The prohibition of the slogans and claims of the Jahiliyyah is established from the hadith of Ibn Mas'ud (may Allah be pleased with him) in Sahih al-Bukhari (1294) and Sahih Muslim (103).
Note / Clarification: The word "juthā" (with a dammah on the jim) is the plural of "jathwah", which means a heap of stones or a group. In one narration it also comes as "juthiyy" (with a doubled ya'), which is the plural of "jathi" (one who falls on his knees). Mulla Ali al-Qari gave this same explanation in "Sharh al-Mishkat".
