Mustadrak al-Hakim — Hadith 8008

حدثنا علي بن حَمْشاذ العَدْل، حدثنا علي بن الحسين بن الجُنيد، حدثنا سهل بن عثمان العَسكَري (2)، حدثنا أبو خالد الأحمر، حدثنا الحسن بن عبيد الله النَّخَعي، عن سعد بن عُبيدة قال: سمع ابن عمر رجلًا يَحلِفُ بالكعبة، فقال: لا تَحلِفْ بالكعبة، فإنِّي سمعتُ رسولَ الله ﷺ يقول: "مَن حَلَفَ بغيرِ الله فقد كَفَر - أو (3) أشرَكَ - " (4).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

Sa'd bin Ubaydah narrates that Sayyiduna Ibn Umar (may Allah be pleased with them both) heard a man swearing by the Ka'bah, so he said: Do not swear by the Ka'bah, for I heard the Messenger of Allah (peace and blessings be upon him) say: "Whoever swears by other than Allah has committed disbelief - or (he said) has committed shirk."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(3) في النسخ الخطية: وأشرك. والمثبت من "تلخيص الذهبي"، وهو الموافق لمصدري التخريج اللذين أخرجاه من طريق أبي خالد الأحمر.
Note / Clarification: In the manuscripts "wa-ashraka" (and he associated partners) is written here, but the correct word is the one in al-Dhahabi's "al-Talkhis", and it also agrees with the two sources of takhrij that narrated it by the route of Abu Khalid al-Ahmar.

(4) رجاله لا بأس بهم لكن فيه انقطاعًا بينّاه فيما سلف برقم (45). أبو خالد الأحمر: هو سليمان بن حيّان الأزدي. وأخرجه أحمد 10/ (6072)، والترمذي (1535) من طريق عن أبي خالد الأحمر، بهذا الإسناد. وقال الترمذي: حديث حسن.
Technical note / Defect ('illah): There is no harm in its narrators, but there is an "inqita'" (break in the chain) in it, which we explained earlier at no. (45).
Note / Clarification: Abu Khalid al-Ahmar means Sulayman bin Hayyan al-Azdi.
Reference / Source: Imam Ahmad (10/ 6072) and al-Tirmidhi (1535) narrated it by the route of Abu Khalid al-Ahmar with this same chain.
Grading: Imam al-Tirmidhi called it "hadith hasan".

(2) لفظة "حدثنا" سقطت من النسخ الخطية، وأثبتناها من "إتحاف المهرة" (23335)، ومن "مسند ابن راهويه" (2407)، فقد رواه محمد بن عبيد، وهو الطنافسي.
Note / Clarification: The word "haddathana" had dropped out of the manuscripts; we have established it from "Ithaf al-Maharah" (23335) and "Musnad Ibn Rahawayh" (2407), since it was narrated by Muhammad bin Ubayd (who is al-Tanafisi).
