Mustadrak al-Hakim — Hadith 7999

أخبرنا أبو بكر إسماعيل بن محمد الفقيه بالرَّي، حدثنا سعيد بن يزيد ابن (2) عطية، حدثنا وَكيع بن الجرّاح، حدثنا الحارث بن سليمان الكِنْدي (3)، عن كُرْدُوس الثَّعلبي، عن الأشعث بن قيس، عن النبيِّ ﷺ أنه قال: "مَن حَلَفَ على يمينٍ يَقتطِعُ بها مالَ امرئٍ مسلم وهو فاجرٌ، لقيَ الله وهو أجذمُ" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه بهذه الزِّيادة.

It is narrated from Sayyiduna al-Ash'ath bin Qays (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "Whoever, while being a sinner, swears a (false) oath to seize the wealth of a Muslim, will meet Allah as a leper (or with one of his limbs cut off)."
This hadith has a sahih (authentic) chain, but the two Shaykhs (Bukhari and Muslim) did not record it with this addition.

(2) تحرّف لفظ "بن" في النسخ الخطية إلى عن. وقد وقع اسمه على الصواب في موضعين عند البيهقي في "شعب الإيمان" برقم (5586) و (5707)، حيث سماه: سعيد بن يزيد بن عطية التيمي. وسعيد هذا مجهول، لم يرو عنه غير إسماعيل بن محمد الرازي، وذكره الذهبي في "تاريخ الإسلام" 6/ 92 ولم يأثر فيه جرحًا ولا تعديلًا.
Note / Clarification: In the manuscripts the word "bin" was distorted into "'an". Imam al-Bayhaqi, in two places of his book "Shu'ab al-Iman" (5586 and 5707), wrote his name correctly as "Sa'id bin Yazid bin Atiyyah al-Taymi".
Technical note / Defect ('illah): This narrator named Sa'id is "majhul"; no one narrated from him except Isma'il bin Muhammad al-Razi. Imam al-Dhahabi mentioned him in "Tarikh al-Islam" (6/ 92) but did not transmit any criticism or accreditation of him.

Note / Clarification: In the manuscripts the word here was distorted and recorded as "al-Jundi".

(1) حديث صحيح لكن بلفظ: "لقي الله وهو عليه غضبان" كما في الحديث التالي، وهذا إسناد ضعيف كُردوس اختلفوا فيه، فقيل: هو ابن عباس الثعلبي، وقيل: ابن هانئ، وقيل: ابن عمرو الغطفاني، وعدَّهم ابن المديني ثلاثةً، وتبعه البخاري، وقال ابن حجر في "التقريب": مقبول؛ يعني عند المتابعة، وقد تفرّد بهذا اللفظ. وصح الحديث باللفظ الذي ساقه المصنِّف في الحديث التالي، وهناك يأتي تخريجه. وسعيد بن يزيد التيمي سبق الكلام عليه.
Grading: The hadith is sahih, but with the wording "he will meet Allah while He is angry with him", as comes in the next hadith.
Technical note / Defect ('illah): This chain is weak because there is disagreement over the identity of the narrator "Kurdus". Some said he is Ibn Abbas al-Tha'labi, some Ibn Hani', and some Ibn Amr al-Ghatafani. Ibn al-Madini and Imam al-Bukhari considered them three separate persons. Al-Hafiz Ibn Hajar called him "maqbul" (acceptable, on condition of corroboration) in "al-Taqrib", and he is alone with this wording. The discussion about Sa'id bin Yazid al-Taymi has already passed above.
وأخرجه أحمد 36 / (21843)، وابن حبان (5088) من طريق وكيع، بهذا الإسناد.

وأخرجه أحمد (21849)، وأبو داود (3244) و (3622)، والنسائي (5959) من طرق عن الحارث بن سليمان، به.
Reference / Source: Imam Ahmad (21849), Abu Dawud (3244, 3622) and al-Nasa'i (5959) narrated it by various routes of al-Harith bin Sulayman.
قوله: "فاجر" أي: كاذب.
Note / Clarification: In the hadith the word "fajir" means a liar (kadhib).
