Mustadrak al-Hakim — Hadith 7976

أخبرنا أبو بكر محمد بن عبد الله الشافعي، حدثنا محمد بن إسماعيل السُّلَمي، حدثنا أبو صالح، حدثني اللَّيث [عن يحيى بن أيوب] (2) عن يعقوب بن إبراهيم، عن عبد الرحمن بن جُبير، عن محمد بن ثابت بن شُرَحْبيل القُرشي من بني عبد الدار، أنَّ عبد الله بن يزيد الخَطْمي حدَّثه عن أبي أيوب الأنصاري، أنَّ رسولَ الله ﷺ قال: "مَن كان يُؤْمِنُ بالله واليوم الآخر فليُكرِمْ ضيفَه، ومَن كان يُؤْمِنُ بالله واليوم الآخر فليُكرِمْ جارَه (3)، ومَن كان يؤمن بالله واليوم الآخر فلا يَدخُلِ الحمَّامَ إِلَّا بِمِئزَرٍ، ومَن كان يُؤْمِنُ بالله واليوم الآخرِ من نسائِكم فلا تَدخُلِ الحمَّامات" (4) فرُفِعَ الحديثُ إلى عمر بن عبد العزيز، فكتب إلى أبي بكر بن محمد بن عمرو (1) ابن حزم: أنْ سَلْ محمدَ بن ثابت عن هذا الحديث واكتُب (2) بما قال. ففَعَلَ، فكتب عمر بن عبد العزيز أنْ تُمنَعَ النساءُ الحمَّاماتِ.
هذا حديث صحيح الإسناد، ولم يُخرجاه. ويعقوب بن إبراهيم هذا الذي روى عنه الليث بن سعد: هو أبو يوسف القاضي، وبصحّة ما ذكرتُه:

It is narrated from Sayyiduna Abu Ayyub al-Ansari (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever believes in Allah and the Last Day, let him honour his guest; whoever believes in Allah and the Last Day, let him honour his neighbour; whoever believes in Allah and the Last Day, let him not enter the bathhouse without a waist-wrapper; and whoever among your women believes in Allah and the Last Day, let her not enter the bathhouse."
The hadith was conveyed to Umar bin Abd al-Aziz, and he wrote to Abu Bakr bin Muhammad bin Amr bin Hazm: Ask Muhammad bin Thabit about this hadith and write (to me) what he says. He did so, and Umar bin Abd al-Aziz then wrote that women be prevented from the bathhouses.
This hadith has a sahih (authentic) chain, but the two Shaykhs (Bukhari and Muslim) did not record it. This Ya'qub bin Ibrahim, from whom al-Layth bin Sa'd narrated, is Abu Yusuf al-Qadi.

Note / Clarification: This was not in the manuscripts; we have established it from the other sources of takhrij, because the whole hadith revolves around it.

(3) في (ز) و (ب): ضيفه مرة أخرى. وسقطت الجملة بتمامها من (م) ومن "التلخيص"، والمثبت من مصادر التخريج.
Note / Clarification: Manuscripts (Z) and (B) have the words "his guest" once again. The entire sentence is missing from manuscript (M) and from al-Dhahabi's "al-Talkhis"; we have recorded it here from the reliable sources of takhrij.

(4) حسن لغيره، وهذا إسناد ضعيف فيه غير ما علّة، فأبو صالح - وهو عبد الله بن صالح المصري - ليَّن، واختُلف فيه على يحيى بن أيوب الغافقي، فرواه الليث بن سعد عنه، فزاد في إسناده بين يعقوب بن إبراهيم ومحمد بن ثابت عبد الرحمن بن جبير، ورواه عن يحيى بن أيوب عمرُو بن الربيع فلم يذكر ابن جبير. كما اختلفوا في تعيين يعقوب بن إبراهيم، فعدَّه الحاكم أبا يوسف القاضي صاحبَ أبي حنيفة، ولم يتابعه عليه أحد، وعدَّه عبدُ الله بن وهب - كما في "العلل" لابن أبي حاتم (192) - ويعقوبُ الفسوي عند البيهقي في "شعب الإيمان" (7379) يعقوب بن إبراهيم بن عبد الله بن حنين، وهو مجهول، وذكره ابن أبي حاتم في "الجرح والتعديل" 9/ 201 باسم يعقوب بن إبراهيم الأنصاري المصري، وذكر أنه روى عن عبد الرحمن بن جبير ومحمد بن ثابت بن شرحبيل، وعنه يحيى بن أيوب، وهو مجهول أيضًا، فهذا قول ثالث.
Grading: Hasan li-ghayrihi (sound due to supporting reports).
Technical note / Defect ('illah): This chain has several defects ('ilal): one is that Abu Salih Abdullah bin Salih al-Misri is "layyin" (of weak memory). Also, there is disagreement over his narration from Yahya bin Ayyub al-Ghafiqi: al-Layth bin Sa'd added "Abd al-Rahman bin Jubayr" between Ya'qub bin Ibrahim and Muhammad bin Thabit, while Amr bin al-Rabi' did not mention him.
Technical note / Defect ('illah): There is also strong disagreement over the identity of the narrator Ya'qub bin Ibrahim. Al-Hakim considered him to be Imam Abu Yusuf the Qadi (the companion of Abu Hanifah), but no other scholar supported him in this. According to Abdullah bin Wahb and Ya'qub al-Fasawi he is Ya'qub bin Ibrahim bin Abdullah bin Hunayn, who is majhul, while according to Ibn Abi Hatim he is Ya'qub bin Ibrahim al-Ansari al-Misri, and he too is majhul.
وأما عبد الله بن يزيد الخَطْمي، فهكذا سمّاه الليث، ورجحه ابن أبي حاتم في "العلل"، وهو مختلف في صحبته، بينما سماه عمرو بن الربيع - كما في الرواية التالية عند المصنف - عبدَ الله بن سويد، وهو ما رجَّحه أبو حاتم الرازي كما في "العلل" لابنه. وعبد الله بن سويد اثنان أحدهما حارثي له صحبة، والآخر أنصاري يروي عن عمته أم حميد امرأة أبي حميد الساعدي كما في "الجرح والتعديل 5/ 66، فالله أعلم.
Technical note / Defect ('illah): Al-Layth bin Sa'd named Abdullah bin Yazid al-Khatmi in this way, and Ibn Abi Hatim considered this the preponderant view; however, there is disagreement over whether he was a Companion. Amr bin al-Rabi' called him "Abdullah bin Suwayd", and Abu Hatim al-Razi preferred this. There are two persons named Abdullah bin Suwayd: one is al-Harithi, a Companion, and the other is al-Ansari, who narrates from his paternal aunt Umm Humayd (the wife of Abu Humayd al-Sa'idi). And Allah knows best.
وأخرجه تامًّا ومختصرًا إبراهيم الحربي في إكرام الضيف (37)، والخرائطي في "مكارم الأخلاق" (212) عن علي بن داود القنطري، والطبراني "في الكبير" (3873)، و"الأوسط" (8658)، و"مكارم الأخلاق" له (221) عن مطلب بن شعيب الأزدي، عن أبي صالح عبد الله بن صالح، بهذا الإسناد. وزادوا جميعًا بين الليث ويعقوب يحيى بنَ أيوب.
Reference / Source: Ibrahim al-Harbi narrated it in "Ikram al-Dayf" (37) and al-Khara'iti in "Makarim al-Akhlaq" (212) via Ali bin Dawud al-Qantari, and al-Tabarani in "al-Kabir" (3873), "al-Awsat" (8658) and his "Makarim al-Akhlaq" (221) via Mutallib bin Shu'ayb al-Azdi, with Abu Salih's same chain. All of these narrators mentioned Yahya bin Ayyub between al-Layth and Ya'qub.
وأخرجه الباغندي في "مسند عمر بن عبد العزيز" (94) من طريق زمعة بن صالح، عن عبد الله بن أبي بكر بن حزم قال: رفع إلى عمر بن عبد العزيز حديثٌ حدث به محمد بن ثابت ابن شرحبيل، فكتب عمر بن عبد العزيز إلى أبي: أن سل محمّد بن ثابت عن حديثه فإنَّه رضًا، فسأله وأنا معه، فأخبرنا محمد بن ثابت، عن عبد الله بن يزيد الخطميّ، عن أبي أيّوب، أنَّ رسول الله ﷺ قال: من كان يؤمن بالله واليوم الآخر فليكرم ضيفه، ومن كان يؤمن بالله واليوم الآخر فليكرم جاره، ومن كان يؤمن بالله واليوم الآخر فلا يدخل إلّا بمئزر، ومن كان يؤمن بالله واليوم الآخر من نسائكم فلا تدخل الحمّام"، قال عبد الله بن أبي بكر: فكتب أبي إلى عمر بن عبد العزيز بذلك، فمنع عمر بن عبد العزيز النّساء من الحمّام وزمعةُ بن صالح فيه ضعف، لكنه يصلح في المتابعات والشواهد.
Details of the narration: Al-Baghandi narrated it in "Musnad Umar bin Abd al-Aziz" (94) by the route of Zam'ah bin Salih that when this hadith reached Umar bin Abd al-Aziz, he wrote to Abu Bakr bin Hazm to ask Muhammad bin Thabit about it, since he was a reliable narrator. He narrated via Abu Ayyub al-Ansari (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever believes in Allah and the Last Day, let him honour his guest and his neighbour; let (a man) not enter the bathhouse without a waist-wrapper, and let your women not enter the bathhouse." On this report Umar bin Abd al-Aziz prohibited women from going to the bathhouse.
Technical note / Defect ('illah): There is weakness in Zam'ah bin Salih, but he can be relied upon in corroborating chains and supporting reports.
