Mustadrak al-Hakim — Hadith 7972

حدثنا أبو زكريا يحيى بن محمد العَنبَري، حدثنا محمد بن عبد السلام والحسين بن محمد القَبَّاني وإبراهيم بن أبي طالب، قالوا: حدثنا إسحاق بن إبراهيم، أخبرنا معاذ بن هشام، حدثني أبي، عن عطاء، عن أبي الزُّبير، عن جابر قال: قال رسول الله ﷺ: "مَن كان يُؤْمِنُ بالله واليومِ الآخر فلا يُدخِلْ حَلِيلتَه (1) الحمَّامَ، ومَن كان يُؤْمِنُ بالله واليوم الآخر فلا يَدخُلِ الحمَّامَ إلَّا بمئزَرٍ، ومَن كان يُؤْمِنُ بالله واليوم الآخر فلا يَجلِسْ على مائدةٍ يُدارُ عليها الخمرُ" (2).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever believes in Allah and the Last Day, let him not admit his wife into the (public) bathhouse; whoever believes in Allah and the Last Day, let him not enter the bathhouse himself without a waist-wrapper (covering his private parts); and whoever believes in Allah and the Last Day, let him not sit at a table around which wine is being passed."
This hadith is sahih (authentic) on the condition of Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: In the manuscripts this word was written "halilah" (with a plain final ha'), while in the text it has been corrected in accordance with the sources of takhrij.

(2) حديث حسن، وهذا إسناد رجاله ثقات غير عطاء، وقد اختلفوا في نسبته، والراجح أنه عطاء ابن عجلان كما سيأتي، وهو ضعيف منكر الحديث، إلَّا أنه لم ينفرد به، فقد تابعه عليه غير واحد كما سيأتي. ومعنى الحديث قد روي عن غير واحد من الصحابة، فبمجموعها يتحسن الحديث إن شاء الله.
Grading: The hadith is hasan.
Technical note / Defect ('illah): All the narrators of this chain are thiqah (trustworthy) except Ata'. There is disagreement over his lineage, but the preponderant view is that he is Ata' bin Ajlan, who is weak and "munkar al-hadith". However, he is not alone in this narration; rather, several narrators mentioned below corroborated him.
Important point: The meaning of this hadith is also narrated from several Companions, so by the combination of all these routes the hadith, in sha' Allah, reaches the level of hasan.
وأخرجه تامًّا ومقطَّعًا النسائي في "الكبرى" (6708)، وفي "المجتبى" (401)، والطبراني في "الأوسط" (1694) و (8214)، وأبو الشيخ في "الطبقات" (440)، والبيهقي في "شعب الإيمان" (5207)، والخطيب في "تاريخ بغداد" 2/ 50، والجورقاني في "الأباطيل والمناكير" (335) من طرق عن إسحاق بن راهويه، بهذا الإسناد. قال الطبراني: يقال: هذا عطاء بن السائب، والله أعلم، ولم يروه عن عطاء إِلَّا هشام، ولا عن هشام إلَّا معاذ، تفرَّد به إسحاق!
Reference / Source: Imam al-Nasa'i narrated it in "al-Kubra" (6708) and "al-Mujtaba" (401), al-Tabarani in "al-Awsat" (1694, 8214), Abu al-Shaykh in "al-Tabaqat" (440), al-Bayhaqi in "Shu'ab al-Iman" (5207), al-Khatib in "Tarikh Baghdad" (2/ 50) and al-Jawraqani in "al-Abatil wa al-Manakir" (335), by the chain of Ishaq bin Rahawayh, both complete and in parts.
Technical note / Defect ('illah): Imam al-Tabarani says that it is said that this is Ata' bin al-Sa'ib (and Allah knows best). Also, no one narrated it from Ata' except Hisham, nor from Hisham except Mu'adh, and Ishaq is alone in narrating it.
وأخرجه قوام السنة في "الترغيب والترهيب" (27) من طريق أبي بكر بن صالح - وهو الحافظ محمد بن صالح الأنماطي المعروف بكيلجة - عن أبي معمر عبد الله بن عمرو المِنقري، عن عبد الوارث بن سعيد، عن عطاء بن دينار، عن أبي الزبير، به. فسمى عطاءً ابنَ دينار، وعطاء بن دينار هذا مصري لا بأس به.
Reference / Source: Qiwam al-Sunnah narrated it in "al-Targhib wa al-Tarhib" (27) by the route of Abu Bakr bin Salih (who is the hafiz Muhammad bin Salih al-Anmati, known as "Kaylajah"), from Abu Ma'mar Abdullah bin Amr al-Minqari, from Abd al-Warith bin Sa'id, from Ata' bin Dinar, from Abu al-Zubayr.
Technical note / Defect ('illah): Here the narrator is named Ata' bin Dinar, who is an Egyptian narrator of the level "la ba'sa bihi" (there is no harm in him).
ورواه الحافظ ابن شيرويه النيسابوري كما في "المطالب العالية" لابن حجر (2585) - وغاير في لفظه فقال: "من كان يؤمن بالله واليوم الآخر فلا يَدخلنَّ مع حليلته الحمام" - عن محمد بن يحيى الذهلي، عن أبي معمر، به. إلَّا أنه سمَّى عطاءٌ ابنَ عجلان، وهذا أصحُّ، فإن ابن عجلان بصريٌّ والراوي عنه وهو عبد الوارث - بصري أيضًا، وكذلك هشام الدستوائي الذي في رواية الحاكم.
Reference / Source: The hafiz Ibn Shirawayh al-Naysaburi narrated it, as found in Ibn Hajar's "al-Matalib al-Aliyah" (2585).
Details of the narration: Its wording differs slightly: "Whoever believes in Allah and the Last Day, let him not enter the bathhouse with his wife."
Technical note / Defect ('illah): He named the narrator "Ata' bin Ajlan", and this is more correct, because Ibn Ajlan is from Basra and the one narrating from him, Abd al-Warith, is also from Basra; likewise Hisham al-Dastuwa'i (who is in al-Hakim's narration) is also from Basra.

Reference / Source: Imam Abu Hanifah narrated it in his "Musnad" (15), Imam Ahmad (23/ 14651), al-Darimi (2137), al-Bazzar (Kashf al-Astar: 320), al-Tabarani in "al-Awsat" (688, 2510), Abu Tahir al-Mukhlis in "al-Mukhallisiyyat" (2206), al-Sahmi in "Tarikh Jurjan" (275), Ibn Bishran in "al-Amali" (189), al-Khatib in "Tarikh Baghdad" (2/ 50) and al-Silafi in "al-Mashyakhah al-Baghdadiyyah" (part 15, no. 24), by various routes from Abu al-Zubayr, both complete and in parts.
وسلف برقم (588) من طريق زهير بن معاوية عن أبي الزبير، بلفظ: نهى أن يدخل الرجل الماء إلّا بمئزر.
Important point: This narration has already passed at no. (588) by the route of Zuhayr bin Mu'awiyah, via Abu al-Zubayr, with the wording: "He (peace and blessings be upon him) forbade entering the water without a waist-wrapper."
وأخرجه الترمذي (2801)، وأبو يعلى (1925)، والطبراني في "الأوسط" (588)، وابن عدي في الكامل 2/ 315 من طريق ليث بن أبي سليم، عن طاووس، عن جابر، به. وليث ضعيف.
Reference / Source: Imam al-Tirmidhi (2801), Abu Ya'la (1925), al-Tabarani in "al-Awsat" (588) and Ibn Adi in "al-Kamil" (2/ 315) narrated it by the route of Layth bin Abi Sulaym, via Tawus, from Jabir (may Allah be pleased with him).
Technical note / Defect ('illah): Layth bin Abi Sulaym is a weak narrator.
وقال الترمذي: حسن غريب لا نعرفه من حديث طاووس عن جابر إلَّا من هذا الوجه.
Important point: Imam al-Tirmidhi (may Allah have mercy on him) says that it is "hasan gharib", and we know it as a hadith of Tawus from Jabir (may Allah be pleased with him) only through this route.

Corroborating chains and supporting reports: The hadith of Abdullah bin Amr (may Allah be pleased with them both) is also a shahid, found in Abu Dawud (4011) and Ibn Majah (3748).
وحديث أبي أيوب الآتي عند الحاكم برقم (7976).
Corroborating chains and supporting reports: The hadith of Abu Ayyub al-Ansari (may Allah be pleased with him) is also a shahid; it will come later with al-Hakim at no. (7976).
ولا يخلو إسناد واحد منها من مقال، لكنها تصلح في الشواهد.
Technical note / Defect ('illah): None of the chains of these supporting reports is free of criticism (weakness), but they are suitable to be adduced as supporting reports.
