Mustadrak al-Hakim — Hadith 7784

أخبرني إسماعيل بن محمد بن الفضل، حدثنا جَدِّي، حدثنا أبو بكر ابن شَيْبة الحِزامي، حدثنا داود بن قيس، عن عمرو بن شعيب، عن أبيه، عن جَدِّه قال: سُئِلَ رسولُ الله ﷺ عن العَقِيقة، فقال: "لا أُحِبُّ العُقوقَ، مَن وُلِدَ له منكم مولودٌ فأحبَّ أن يَنسُكَ عنه فليفعَلْ، عن الغلام شاتانِ، وعن الجاريةِ شاةٌ" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

Amr bin Shu'ayb narrates from his father, from his grandfather (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) was asked about the 'aqiqah, and he (peace and blessings be upon him) said: "I do not like 'uquq (disobedience). Whoever among you has a child born to him and wishes to offer a sacrifice ('aqiqah) on its behalf, let him do so: for a boy, two sheep, and for a girl, one sheep (should be slaughtered)."
This hadith has a sahih (authentic) chain, and they (the two Shaykhs) did not record it.

(1) صحيح لغيره، وهذا إسناد حسن. أبو بكر بن شيبة الحزامي اسمه: عبد الرحمن بن عبد الملك بن شيبة.
Grading: This narration is "sahih li-ghayrihi", and this chain of it is "hasan".
Technical note / Defect ('illah): The actual name of Abu Bakr bin Shaybah al-Hizami is 'Abd al-Rahman bin 'Abd al-Malik bin Shaybah.
وأخرجه أحمد 11/ (6713) و (6822)، وأبو داود (2842)، والنسائي (4523) من طرق عن داود بن قيس الفرّاء، بهذا الإسناد. رواية أحمد الأولى ورواية أبي داود مجموعتان مع الرواية السالفة عند المصنف برقم (7775). زاد في رواية النسائي: قال داود -يعني ابن قيس الفراء-: سألت زيد بن أسلم عن المكافأتان، قال الشاتان المشتبهتان تُذبَحان جميعًا.
Reference / Source: Imam Ahmad 11/ (6713, 6822), Abu Dawud (2842) and al-Nasa'i (4523) narrated it by various routes from Dawud bin Qays al-Farra', with this same chain. The first narration of Ahmad and the narration of Abu Dawud are combined with the previous hadith, number (7775).
Note / Clarification: In al-Nasa'i's narration there is this addition: Dawud bin Qays said: I asked Zayd bin Aslam about "al-mukafa'atan" (two equal goats), and he said: it means two similar or alike goats that are slaughtered together.
وخالف محمدُ بن مسلمة القعنبي أصحابَ داود بن قيس، فرواه عنه عن عمرو بن شعيب: أنَّ النبي ﷺ، فذكره مرسلًا، أخرجه أبو داود (2842).
Technical note / Defect ('illah): Muhammad bin Maslamah al-Qa'nabi differed from the other students of Dawud bin Qays; he narrated it from Dawud, from 'Amr bin Shu'ayb, from the Prophet (peace and blessings be upon him), that is, he narrated it as "mursal" (without mentioning the Companion). Imam Abu Dawud (2842) narrated it.
وأخرجه أحمد (6737) من طريق عبد الله بن عامر الأسلمي، عن عمرو بن شعيب، به. بلفظ: عقَّ رسول الله ﷺ عن الغلام شاتين، وعن الجارية شاة. جعله من فعل النبي ﷺ، وعبد الله الأسلمي ضعيف.
Reference / Source: Imam Ahmad (6737) narrated it by way of 'Abd Allah bin 'Amir al-Aslami, from 'Amr bin Shu'ayb, with these words: "The Messenger of Allah (peace and blessings be upon him) performed the 'aqiqah with two goats for a boy and one goat for a girl."
Technical note / Defect ('illah): This narrator made it an "action" of the Prophet (peace and blessings be upon him), and the narrator 'Abd Allah al-Aslami is weak.
وروى مالك في "الموطأ" 2/ 500 - وهو في "مسند أحمد" 38/ (23134) من طريقه - عن زيد ابن أسلم، عن رجل من بني ضمرة، عن أبيه قال: سئل رسول الله ﷺ عن العقيقة، فقال: "لا أحبّ العقوق"، وكأنه إنما كره الاسم، وقال: "من وُلد له ولد فأحبَّ أن يَنسُك عن ولده فليفعل". وفي سنده مبهم. قال البيهقي في "السنن الكبرى" 9/ 300: وهذا إذا انضمّ إلى الأول قويا. يعني بالأول حديث عمرو بن شعيب عن أبيه عن جده.
Reference / Source: Imam Malik narrated in "al-Muwatta'" 2/ 500 (and Imam Ahmad in 38/ 23134 by his route) from Zayd bin Aslam, from a man of Banu Damrah, from his father, that the Messenger of Allah (peace and blessings be upon him) was asked about the 'aqiqah, and he said: "I do not like disobedience ('uquq)." It was as if he disliked the name, and he said: "Whoever has a child born to him and wishes to offer a sacrifice (nusuk) on behalf of his child, let him do so."
Technical note / Defect ('illah): In its chain there is a "mubham" (unnamed) narrator. Imam al-Bayhaqi says in "al-Sunan al-Kubra" (9/ 300) that when this narration is joined with the first narration ('Amr bin Shu'ayb from his father from his grandfather), the two strengthen each other.
