Mustadrak al-Hakim — Hadith 7783

حدثنا علي بن حَمْشَاذَ العَدْل، حدثنا بِشر بن موسى، حدثنا الحُميدي، حدثنا سفيان، عن عبيد الله بن أبي يزيد، حدثني أبي، عن سباع بن ثابت، عن أمِّ كُرْز قالت: سمعتُ رسول الله ﷺ يقول: "أَقِرُّوا الطَّيرَ على مُكنَاتِها"، وسمعته يقول: "عن الغُلام شاتانِ، وعن الجاريةِ شاةٌ، لا يَضُرُّك ذُكرانًا كنَّ أو إناثًا" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

Umm Kurz (may Allah be pleased with her) narrates: I heard the Messenger of Allah (peace and blessings be upon him) say: "Leave the birds settled in their nests." And I also heard him (peace and blessings be upon him) say: "For a boy, two sheep, and for a girl, one sheep (should be slaughtered); it does not matter to you whether they (the sheep) are male or female."
This hadith has a sahih (authentic) chain, and they (the two Shaykhs) did not record it.

(1) حديث جيد إن شاء الله، وهذا إسناد وهم فيه سفيان بن عيينة كما نبه عليه الإمام أحمد في "مسنده" عقب الرواية (27142) فقال: سفيان يهمُ في هذه الأحاديث، عبيد الله (يعني ابن أبي يزيد المكي) سمعها من سباع بن ثابت. وكذلك قال أبو داود يعني ليس بينهما والد عبيد الله، كذلك رواه حماد بن زيد وابن جريج عن عبيد الله عن سباع بن ثابت مباشرة، قال الدارقطني في "العلل" 15/ 404: القول عندي قولهما. وسباع بن ثابت مختلف في صحبته، فقد عدَّه ابن حبان في "ثقاته" تابعيًا، بينما عدَّه البغوي وابن قانع في الصحابة، ورجَّح صحبته ابن حجر في "الإصابة"، بينما قال الذهبي في "الميزان": لا يكاد يعرف!
Grading: God willing, this hadith is "jayyid" (good).
Technical note / Defect ('illah): Sufyan bin 'Uyaynah made an error (wahm) in this chain, as Imam Ahmad pointed out (in his "Musnad") after narration (27142), saying that Sufyan errs in these hadiths; in fact 'Ubayd Allah (bin Abi Yazid al-Makki) heard them directly from Siba' bin Thabit, and there is no intermediary of 'Ubayd Allah's father between them. Imam Abu Dawud said the same, and Hammad bin Zayd and Ibn Jurayj likewise narrated it without the intermediary. Imam al-Daraqutni says (in "al-'Ilal" 15/ 404) that the correct view is what Hammad and Ibn Jurayj said. There is a difference over whether Siba' bin Thabit was a Companion: Ibn Hibban counted him (in his "al-Thiqat") as a Tabi'i, while al-Baghawi and Ibn Qani' counted him among the Companions; al-Hafiz Ibn Hajar (in "al-Isabah") preferred that he was a Companion, whereas Imam al-Dhahabi (in "al-Mizan") says that he is hardly known.
والحديث أخرجه تامًا ومقطعًا أحمد 45/ (27139)، وأبو داود (2835)، وابن ماجه (3162)، وابن حبان (5312) و (6126) من طريق سفيان بن عيينة، بهذا الإسناد.
Reference / Source: Imam Ahmad 45/ (27139), Abu Dawud (2835), Ibn Majah (3162) and Ibn Hibban (5312, 6126) narrated it in full and in parts by way of Sufyan bin 'Uyaynah, with this same chain.
وأخرجه النسائي (4529) عن قتيبة بن سعيد، عن سفيان بن عيينة، عن عبيد الله بن أبي يزيد، عن سباع بن ثابت، به بقصة العقيقة ليس فيه والد عبيد الله.
Reference / Source: Imam al-Nasa'i (4529) narrated it by way of Qutaybah bin Sa'id, from Sufyan bin 'Uyaynah, from 'Ubayd Allah bin Abi Yazid, from Siba' bin Thabit, with the story of the 'aqiqah; it does not mention 'Ubayd Allah's father.
وأخرجه بقصة العقيقة أحمد (27143)، وأبو داود (2836) من طريق حماد بن زيد، وأحمد (27374)، والنسائي (4530) من طريق ابن جريج كلاهما عن عبيد الله بن أبي يزيد، عن سباع، به وفيه تصريح عبيد الله بسماعه من سباع.
Reference / Source: Imam Ahmad (27143) and Abu Dawud (2836) narrated it with the story of the 'aqiqah by way of Hammad bin Zayd, and Imam Ahmad (27374) and al-Nasa'i (4530) by way of Ibn Jurayj; both of them report it from 'Ubayd Allah bin Abi Yazid, from Siba', and in it 'Ubayd Allah explicitly states that he heard it from Siba'.
ووهمَ عبد الرزاق في رواية الحديث عن ابن جريج فيما رواه أحمد (27373) والترمذي (1516)، فزاد بين عبيد الله وسباع محمدَ بنَ ثابت بن سباع ونصَّ على وهمه فيه غير واحد من أهل العلم كالدارقطني في "العلل" (4101)، والمزي في "التحفة" 13/ 101، والذهبي في "الميزان" في ترجمة سباع.
Technical note / Defect ('illah): Imam 'Abd al-Razzaq made an error in narrating it from Ibn Jurayj (as reported by Ahmad (27373) and al-Tirmidhi (1516)), in that he added Muhammad bin Thabit bin Siba' between 'Ubayd Allah and Siba'; more than one scholar has explicitly noted his error in this, such as al-Daraqutni in "al-'Ilal" (4101), al-Mizzi in "al-Tuhfah" 13/ 101 and al-Dhahabi in "al-Mizan" in the biography of Siba'.
وأخرجه أحمد (27142)، والنسائي (4528) من طريق عمرو بن دينار، وأحمد (27371) و (27372)، وابن حبان (5313) من طريق ابن جريج، كلاهما عن عطاء بن أبي رباح، عن حبيبة بنت ميسرة، عن أم كُرز بقصة العقيقة. وفي رواية ابن جريج: أم بني كُرز. وحبيبة تفرَّد بالرواية عنها عطاء، وذكرها ابن حبان في "الثقات". وهذه الطريق لا بأس بها للمتابعة.
Reference / Source: Imam Ahmad (27142) and al-Nasa'i (4528) narrated it by way of 'Amr bin Dinar, and Imam Ahmad (27371, 27372) and Ibn Hibban (5313) by way of Ibn Jurayj; both of them from 'Ata' bin Abi Rabah, from Habibah bint Maysarah, from Umm Kurz, with the story of the 'aqiqah. In the narration of Ibn Jurayj it is: "Umm Bani Kurz".
Technical note / Defect ('illah): Only 'Ata' narrates from Habibah, and Ibn Hibban mentioned her in "al-Thiqat". This route is acceptable for corroboration (mutaba'ah).
وأخرجه أحمد (27369) من طريق منصور بن زاذان، عن عطاء عن أم كرز بقصة العقيقة. ليس بين عطاء وأم كرز أحد. وأخرجه النسائي (4527) من طريق حماد بن سلمة، عن قيس بن سعد، عن عطاء وطاووس ومجاهد، عن أم كرز بقصة العقيقة.
Reference / Source: Imam Ahmad (27369) narrated it by way of Mansur bin Zadhan, from 'Ata', directly from Umm Kurz (with no mention of Habibah in between). Imam al-Nasa'i (4527) narrated it by way of Hammad bin Salamah, from Qays bin Sa'd, from 'Ata', Tawus and Mujahid, from Umm Kurz, with the story of the 'aqiqah.

قوله: "مُكُناتها" كذا ضبطت في (ز) بضم الكاف، قال صاحب "النهاية" عن الزمخشري: جمع مُكُن، ومُكُن جمع مَكان، كصُعُدات في صُعُد، وحُمُرات في حُمُر.
Note / Clarification: The word of the hadith "mukunatiha" is vocalized in manuscript (Z) with a dammah on the kaf. The author of "al-Nihayah" (Ibn al-Athir) reports from al-Zamakhshari that it is the plural of "mukun", and "mukun" is itself the plural of "makan" (so it is a plural of a plural), like "su'udat" as the plural of "su'ud" and "humurat" as the plural of "humur".
وضبطها البعض: مَكِناتها بفتح فكسر من مَكِنة، قيل: بمعنى الأمكنة، يقال: الناس على مَكِناتهم، أي: على أمكنتهم. والمَكِنة في الأصل: بيض الضِّباب، فاستُعير في بيض الطيور.
Technical note / Defect ('illah): Some scholars vocalized it as "makinat" (with a fathah on the mim and a kasrah on the kaf), the plural of "makinah". It is said that it too means "places" (amkinah), as in the expression "al-nasu 'ala makinatihim", meaning people are in their places. In the original language "al-makinah" refers to the eggs of the dhabb lizard, and it was then used metaphorically for the eggs of birds.
