أخبرني علي بن عيسى الحِيَري، حدثنا إبراهيم بن أبي طالب، حدثنا ابن أبي عمر حدثنا سفيان، حدثنا عمرو بن دينار، قال: سمعتُ صُهيبًا مولى ابن عامر يُخبر، أنَّ عبد الله بن عمرو أخبره عن النبيِّ ﷺ قال: "ما مِن إنسانٍ يقتُلَ عُصفورًا فما فوقَها بغير حقِّها، إلَّا سأله الله ﷿ عنها يومَ القيامة" قيل: يا رسولَ الله، وما حقُّها؟ قال: "حقُّها أن يَذبحَها فيأكلَها (2)، ولا يقطع رأسَها فيَرميَ به" (3). هذا حديث صحيح الإسناد، ولم يُخرجاه. It is narrated from Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Any person who kills a sparrow or any creature bigger than it without its right, Allah, the Mighty and Majestic, will surely question him about it on the Day of Resurrection." It was said: O Messenger of Allah (peace and blessings be upon him)! What is its right? He (peace and blessings be upon him) said: "Its right is that it be slaughtered and eaten, not that its head be cut off and thrown away."
This hadith has an authentic chain (sahih al-isnad), but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) في النسخ الخطية: فلا يأكلها، وهو تحريف قبيح، وجاء على الصواب في "تلخيص الذهبي". Technical note / Defect ('illah): The manuscripts have the words "fa-la ya'kuluha" (so let him not eat it) here, which is an ugly corruption (scribal error); whereas in "Talkhis al-Dhahabi" this phrase is reported correctly.
(3) حسن لغيره، وهذا إسناد ضعيف لجهالة صهيب مولى ابن عامر، فلم يرو عنه غير عمرو ابن دينار، وذكره ابن حبان في "الثقات"، وفرَّق بينه وبين أبي موسى الحذاءِ البخاريُّ وأبو حاتم وابن حبان، وذكره المزي في كنى "التهذيب"، وقال في الثاني: يحتمل أن يكون هو والذي قبله واحدًا، وتبعه ابن حجر، بينما جزم الذهبي في "الميزان" بأنهما واحد، وقال: ويكون صدوقًا. Grading: This narration is hasan li-ghayrihi (sound due to supporting reports). Technical note / Defect ('illah): Its chain is da'if (weak) because Suhayb, the mawla of Ibn 'Amir, is unknown (majhul), since no one other than 'Amr bin Dinar narrated from him. Although Ibn Hibban mentioned him in "al-Thiqat", al-Bukhari, Abu Hatim and Ibn Hibban distinguished between Suhayb and Abu Musa al-Hadhdha'. Al-Mizzi mentioned him in the kunyah section of "Tahdhib al-Kamal" and said of the second that it is possible that the two are one person, and Ibn Hajar followed this view. Al-Dhahabi, however, stated firmly in "al-Mizan" that the two are one and the same, and said that he would then be saduq (truthful). وأخرجه النسائي (4519) عن قتيبة بن سعيد، و (4841) عن محمد بن عبد الله بن يزيد المقرئ، كلاهما عن سفيان بن عيينة، بهذا الإسناد. Reference / Source: Al-Nasa'i narrated it (4519) from Qutaybah bin Sa'id and (4841) from Muhammad bin Abd Allah bin Yazid al-Muqri'; both of these narrators report it from Sufyan bin 'Uyaynah with this same chain. وأخرجه أحمد 11/ (6550) و (6960) من طريق شعبة، و (6551) و (6861) من طريق حماد بن سلمة، كلاهما عن عمرو بن دينار، به. Reference / Source: Ahmad narrated it (11/6550 and 6960) via Shu'bah, and (6551 and 6861) via Hammad bin Salamah; both of these narrators report it via 'Amr bin Dinar. وله شاهد من حديث الشَّريد بن سويد عند أحمد 32/ (19470)، والنسائي (4520)، وابن حبان (5894)، وفي سنده صالح بن دينار روى عنه اثنان وذكره ابن حبان في "الثقات"، فحديثه حسن في المتابعات والشواهد إن شاء الله. Corroborating chains and supporting reports: This hadith has a supporting report (shahid) from the narration of al-Sharid bin Suwayd (may Allah be pleased with him) in Ahmad (32/19470), al-Nasa'i (4520) and Ibn Hibban (5894). Technical note / Defect ('illah): The chain of this supporting report contains Salih bin Dinar, from whom two narrators narrated and whom Ibn Hibban mentioned in "al-Thiqat"; so his hadith is of hasan level in corroborating and supporting reports, if Allah wills.
