Mustadrak al-Hakim — Hadith 7711

أخبرنا أبو الحسين أحمد بن عثمان الأدَمي، حدثنا محمد بن ماهان حدثنا عبد الرحمن بن مَهدي، حدثنا شُعبة، قال: سمعتُ قَتَادة يحدِّث، قال: جاء رجلٌ من العَتِيك، فحدَّث سعيدَ بن المسيّب أنَّ يحيى بن يَعْمَر يقول: من اشترى أُضحيَّةً في العَشْر، فلا يأخذَنَّ من شعره وأظفاره، قال سعيد: نعم، فقلتُ: عمَّن يا أبا محمد؟ قال: عن أصحابِ رسول الله ﷺ (2).

It is narrated from Qatadah that he said: A man from (the tribe of) al-Atik came and told Sa'id bin al-Musayyib that Yahya bin Ya'mar says: "Whoever buys a sacrificial animal during the ten days of Dhu al-Hijjah, let him not cut his hair or his nails." Sa'id bin al-Musayyib affirmed it, saying: "Yes, that is quite correct." I asked: "O Abu Muhammad, from whom is this narrated?" He replied: "It is narrated from the Companions of the Messenger of Allah (peace and blessings be upon him)."

وأخرجه إسحاق بن راهويه في "مسنده" (1817) عن النضر بن شميل، عن شعبة، بهذا الإسناد.
Reference / Source: It was recorded by Ishaq bin Rahwayh in his "Musnad" (1817) via al-Nadr bin Shumayl, from Shu'bah, with this chain.
وأخرجه الطحاوي في "شرح المشكل" 14/ 128 من طريق هشام الدستوائي وسعيد بن أبي عروبة - فرَّقهما - عن قتادة عن كثير بن أبي كثير: أنَّ يحيى بن يَعمَر كان يُفتي بخراسان: أَنَّ الرجل إذا اشترى أضحيّته وسمّاها ودخل العشرُ أن يكفَّ عن شعره وأظفاره حتى يضحي. قال قتادة: فذكرت ذلك لسعيد بن المسيّب، فقال: نعم، قلت: عمن يا أبا محمد؟ قال: عن أصحاب محمد ﷺ. واللفظ لابن أبي عروبة.
Reference / Source: It was recorded by al-Tahawi in "Sharh Mushkil al-Athar" (14/ 128) via Hisham al-Dastuwa'i and Sa'id bin Abi Arubah that Yahya bin Ya'mar used to give the fatwa in Khurasan that when a man has bought his sacrificial animal and designated it, and the ten days begin, he should refrain from (cutting) his hair and nails (until he sacrifices).
Details of the narration: Qatadah said that he mentioned this to Sa'id bin al-Musayyab, who confirmed it and attributed it to "the Companions" (of Muhammad, peace and blessings be upon him). This wording is from Ibn Abi Arubah's narration.
قلنا: وهذه الرواية فيها تسمية الواسطة بين قتادة ويحيى بن يعمر، وهو كثير بن أبي كثير وهو مولى لعبد الرحمن بن سمرة القرشي وليس عتكيًا كما في رواية المصنف، فالعَتيك فخذ من الأزد.
Technical note / Defect ('illah): In this narration the intermediary between Qatadah and Yahya bin Ya'mar is named explicitly as "Kathir bin Abi Kathir"; he is a freed slave (mawla) of Abd al-Rahman bin Samurah al-Qurashi, and he is not "Ataki" as in the author's narration, since Atik is a branch of the tribe of "Azd".
وأما فتوى يحيى بن يعمر، فالذي يظهر أنه أخذها عن علي ﵁، فقد أخرج إسحاق بن راهويه (1818)، وابن عبد البر في "التمهيد" 17/ 238 من طريق حماد بن سلمة عن قتادة عن كثير بن أبي كثير عن يحيى بن يعمر أنَّ علي بن أبي طالب قال: إذا دخل العشر واشترى أضحيّةً أمسك عن شعره وأظفاره. زاد ابن عبد البر: قال قتادة: فأخبرت بذلك سعيد بن المسيب فقال: كذلك كانوا يقولون. وسنده حسن من أجل كثير بن أبي كثير، وسقط هذا من رواية إسحاق بن راهويه!
Important point: The fatwa of Yahya bin Ya'mar was apparently taken from Ali (may Allah be pleased with him).
Reference / Source: It was recorded by Ishaq bin Rahwayh (1818) and Ibn Abd al-Barr in "al-Tamhid" (17/ 238) via Hammad bin Salamah that Ali (may Allah be pleased with him) said: "When the ten days begin and one has bought a sacrificial animal, he should refrain from cutting his hair and nails."
Grading: Its chain is "hasan" on account of Kathir bin Abi Kathir, and this addition (Qatadah's report to Sa'id bin al-Musayyab) has dropped out of Ishaq bin Rahwayh's narration.
