Mustadrak al-Hakim — Hadith 7708

أخبرنا أحمد بن سلمان الفقيه ببغداد وبكر بن محمد الصَّيرَفي بمَرْو، قالا: حدثنا أبو قِلابة بن الرَّقَاشي، حدثنا يحيى بن كثير بن دِرهم، حدثنا شُعبة. وأخبرنا أحمد بن جعفر، حدثنا عبد الله بن أحمد بن حنبل، حدثني أبي، حدثنا محمد بن بكر، حدثنا شُعبة، عن مالك بن أنس، قال: سمعتُ عمرو بن مسلم يقول: سمعتُ سعيد بن المسيّب يقول: قالت أُمُّ سلمة: قال رسول الله ﷺ: "مَن رأى هلال ذي الحِجَّة فأراد أن يُضحي، فلا يأخُذ من ظُفْرِه ولا من شَعْرِه حتى يُضحِّيَ" (4)
هذا حديث على شرط الشيخين.

It is narrated from Sayyidah Umm Salamah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever sees the new moon of Dhu al-Hijjah and intends to offer a sacrifice, let him not cut any of his nails or his hair at all until he has offered his sacrifice."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim).

(4) إسناده جيد من أجل عمرو بن مسلم: وهو ابن عمارة بن أُكيمة الليثي، وقيل في اسمه: عُمر. وأخرجه أحمد 44/ (26654)، ومسلم (1977) (41)، وابن ماجه (3150)، والترمذي (1523)، والنسائي (4435)، وابن حبان (5916) من طرق عن شعبة، بهذا الإسناد. على الشك في اسم عمرو أو عمر بن مسلم، وقال الترمذي: حسن صحيح.
Grading: This chain is "jayyid" on account of Amr bin Muslim.
Technical note / Defect ('illah): Amr bin Muslim is the son of Ammarah bin Ukaymah al-Laythi (that is, Amr bin Muslim bin Ammarah bin Ukaymah al-Laythi), and some gave his name as "Umar".
Reference / Source: It was recorded by Ahmad (44/ 26654), Muslim (1977/ 41), Ibn Majah (3150), al-Tirmidhi (1523), al-Nasa'i (4435) and Ibn Hibban (5916) through various routes from Shu'bah bin al-Hajjaj, with this chain, with doubt over the name Amr or Umar bin Muslim.
Important point: Al-Tirmidhi graded it "hasan sahih".
قلنا: وتابع شعبةَ عن مالك في رفعه عبدُ الله القعنبي وعبدُ الله بن يوسف عند الطبراني 23/ (562)، وخالفهم عبدُ الله بن وهب وعثمانُ بن عمر بن فارس، فروياه عن مالك به موقوفًا على أم سلمة عند الطحاوي في "شرح المشكل" (5508) و (5509)، وفي "شرح المعاني" 4/ 182.
Corroborating chains and supporting reports: Shu'bah bin al-Hajjaj, in narrating this from Malik as marfu', is corroborated by Abd Allah bin Maslamah al-Qa'nabi and Abd Allah bin Yusuf, as in al-Tabarani (23/ 562).
Technical note / Defect ('illah): In contrast to them, Abd Allah bin Wahb and Uthman bin Umar bin Faris differed and narrated it from Malik as "mawquf" on Umm Salamah (may Allah be pleased with her), as found in al-Tahawi's "Sharh Mushkil al-Athar" (5508, 5509) and "Sharh Ma'ani al-Athar" (4/ 182).

Reference / Source: It was recorded by Ahmad (26571), Muslim (1977/ 42), al-Nasa'i (4436) and Ibn Hibban (5897) via Sa'id bin Abi Hilal; and also by Ahmad (26655), Muslim (1977/ 42), Abu Dawud (2799) and Ibn Hibban (5917, 5918) via Muhammad bin Amr bin Alqamah.
Details of the narration: Both these routes, through Amr bin Muslim, report this narration as "marfu'".
وأخرجه أحمد (26474)، ومسلم (1977) (39) و (40)، وابن ماجه (3149)، والنسائي (4438) من طريق سفيان بن عيينة، عن عبد الرحمن بن حميد، عن سعيد بن المسيب، به مرفوعًا. وقال البيهقي في "معرفة السنن والآثار" (18923): هذا حديث قد ثبت مرفوعًا من أوجه لا يكون مثلها غلطًا، وأودعه مسلم بن الحجاج كتابه. قلنا: وإسناده من هذا الوجه صحيح لو لم يُخالَف سفيانُ فيه.
Reference / Source: It was recorded by Ahmad (26474), Muslim (1977/ 39, 40), Ibn Majah (3149) and al-Nasa'i (4438) via Sufyan bin Uyaynah, from Abd al-Rahman bin Humayd, from Sa'id bin al-Musayyab, as marfu'.
Important point: Al-Bayhaqi says in "Ma'rifat al-Sunan wa al-Athar" (18923) that this hadith is established as marfu' through several routes the like of which cannot be an error, and that is why Muslim placed it in his book.
Grading: Through this route its chain would be sahih had Sufyan bin Uyaynah not been contradicted in it.
فقد خالفه يحيى القطانُ وأبو ضَمْرة أنس بن عياض -فيما ذكر الدار قطني في "العلل" (3957/ 10 - طبعة الدباس) - فرواه عن عبد الرحمن بن حميد به موقوفًا. قلنا: ورواية أنس بن عياض أسندها الطحاوي في "المشكل" (5512).
Technical note / Defect ('illah): Sufyan bin Uyaynah was contradicted by Yahya bin Sa'id al-Qattan and Abu Damrah Anas bin Iyad (as al-Daraqutni mentioned in "al-Ilal" 3957/ 10, al-Dabbas edition); both of them narrated it from Abd al-Rahman bin Humayd as "mawquf".
Reference / Source: The narration of Anas bin Iyad was given with its chain by al-Tahawi in "Mushkil al-Athar" (5512).
وأخرجه أبو عوانة في "صحيحه" (7789)، وابن عدي في "الكامل" 6/ 310، وأبو محمد الفاكهي في "فوائده" (84)، وأبو طاهر المخلص في "المخلصيات" (2692) من طريق مسلم ابن خالد الزنجي، عن ابن جريج، عن الزهري عن سعيد بن المسيب به مرفوعًا. قلنا: ومسلم الزنجي وإن كان ضعيفًا يعتبر به.
Reference / Source: It was recorded by Abu Awanah (7789), Ibn Adi in "al-Kamil" (6/ 310), al-Fakihi in "al-Fawa'id" (84) and Abu Tahir al-Mukhallis in "al-Mukhallisiyyat" (2692) via Muslim bin Khalid al-Zanji, from Ibn Jurayj, from al-Zuhri, from Sa'id bin al-Musayyab, as marfu'.
Grading: Although Muslim bin Khalid al-Zanji is weak, his narration is taken into consideration (acceptable in supporting reports).
وقد ذهب بعض الحنابلة وبعض الشافعية: إلى أنَّ من أراد أن يضحي فدخل العشر من ذي الحجة، يجب عليه أن يمسك عن قص الشعر والأظفار، وهو قول إسحاق وسعيد بن المسيب.
General principle: Some Hanbalis and Shafi'is hold that whoever intends to offer a sacrifice, once the ten days of Dhu al-Hijjah begin, is obliged to refrain from cutting his hair and nails. This is also the view of Ishaq bin Rahwayh and Sa'id bin al-Musayyab.
وقال الحنفية والمالكية، وهو قول بعض الشافعية والحنابلة: يسن له أن يمسك عن قص الشعر والأظفار. انظر "الموسوعة الفقهية الكويتية" 5/ 170.
General principle: According to the Hanafis, the Malikis and a group of the Shafi'is and Hanbalis, it is "sunnah" (recommended) for the one offering a sacrifice not to cut his hair and nails.

وقال ابن عبد البر في "التمهيد" 17/ 235: واختلف قول الشافعي في ذلك، فمرة قال: من أراد أن يضحي لم يمس في العشر من شعره شيئًا ولا من أظفاره، وقال في موضعٍ آخر: أُحبُّ لمن أراد أن يضحي أن لا يمس في العشر من شعره ولا من أظفاره شيئًا حتى يضحي لحديث أم سلمة، فإن أخذ من شعره وأظفاره فلا بأس، لأنَّ عائشة قالت: كنت أقتلُ قلائدَ هدي رسول الله ﷺ [بيديَّ، ثم يبعث بها وما يُمسك عن شيء ممّا يمسك عنه المحرم حتى ينحر هديه] الحديث. [رواه البخاري (1702) ومسلم (1321)].
Reference / Source: Ibn Abd al-Barr writes in "al-Tamhid" (17/ 235) that al-Shafi'i's statements on this issue differ. In one place he said that the one intending to sacrifice should not touch his hair and nails during the ten days of Dhu al-Hijjah. In another place he said: I like that he should not cut his hair and nails, but if he cuts them there is no harm, because according to the hadith of A'ishah (may Allah be pleased with her) (al-Bukhari 1702, Muslim 1321), after sending off the hady the Messenger of Allah (peace and blessings be upon him) did not refrain from the things that a person in ihram refrains from.
ثم نقل ابن عبد البر عن الإمام أحمد: فذكرته (يعني حديث أم سلمة هذا وحديث عائشة في قتل القلائد) ليحيى بن سعيد فقال يحيى: ذاك له وجه، وهذا له وجه؛ حديث عائشة إذا بعث بالهدي وأقام، وحديث أم سلمة إذا أراد أن يضحي بالمضر، قال أحمد: وهكذا أقول. قيل له فيمسك عن شعره وأظفاره؟ قال: نعم، كلُّ من أراد أن يضحي، فقيل له: هذا على الذي بمكة؟ فقال: لا بل على المقيم. وقال: هذا الحديث رواه شعبة عن مالك عن عمرو بن مسلمٍ عن سعيد ابن المسيب عن أم سلمة عن النبي ﷺ، ورواه ابن عيينة عن عبد الرحمن بن حميد عن سعيد ابن المسيب عن أم سلمة رفعه إلى النبي ﷺ. قال: وقد رواه يحيى بن سعيد القطان عن عبد الرحمن ابن حميدٍ هكذا ولكنه وقفه على أم سلمة. قال: وقد رواه محمد بن عمرٍو عن شيخ مالكٍ، قيل له: إنَّ قتادة يروي عن سعيد بن المسيب: أنَّ أصحاب النبي ﷺ كانوا إذا اشتروا ضحاياهم أمسكوا عن شعورهم وأظفارهم إلى يوم النحر، فقال: هذا يُقوّي هذا، ولم يره خلافًا، ولا ضعَّفه.
Note / Clarification: Ibn Abd al-Barr quoted from Ahmad that he reconciled the hadiths of Umm Salamah and A'ishah: the hadith of A'ishah is for the one who sends off the hady, and the hadith of Umm Salamah is for those who sacrifice in the towns.
Important point: Ahmad said that everyone who intends to sacrifice should refrain from (cutting) hair and nails, and that this ruling is not for the person in Makkah but for the "resident" (muqim).
Technical note / Defect ('illah): He further clarified that this hadith was narrated as marfu' by Shu'bah from Malik and by Ibn Uyaynah from Abd al-Rahman bin Humayd, while Yahya bin Sa'id al-Qattan reported it as mawquf. The narration of Qatadah from Sa'id bin al-Musayyab, that the Companions would refrain from (cutting) hair and nails after buying their sacrificial animals, supports this position.
