Mustadrak al-Hakim — Hadith 769

حدثنا أبو العباس محمد بن يعقوب، أخبرنا الرَّبيع بن سليمان، أخبرنا الشافعي، أخبرنا عبد المجيد بن عبد العزيز، عن ابن جُريَج، أخبرني عبد الله بن عثمان بن خُثَيم، أنَّ أبا بكر بن حفص بن عمر أخبره، أنَّ أنس بن مالك قال: صلَّى معاويةُ بالمدينة صلاةً فجَهَرَ فيها بالقراءة، فقرأ فيها "بِسْم الله الرَّحمن الرَّحيم﴾ لأُمِّ القرآن، ولم يَقرَأْ ﴿بِسْم الله الرَّحمن الرَّحيم﴾ للسورة التي بعدها، حتى قَضَى تلك القراءة، فلما سلَّم ناداه مَن سَمِعَ ذلك من المهاجرين والأنصار من كلِّ مكان: يا معاويةُ، أسَرَقتَ الصلاةَ أم نسيتَ؟ فلما صلَّى بعد ذلك قرأَ ﴿بِسْم الله الرَّحمن الرَّحيم﴾ للسورة التي بعد أمِّ القرآن، وكبَّر حين يَهوِي ساجدًا (1).
هذا حديث صحيح على شرط مسلم، فقد احتَجَّ بعبد المجيد بن عبد العزيز، وسائرُ الرواة متفَقٌ على عدالتهم، وهو عِلَّة لحديث شعبة وغيره عن قتادة عن أنس قال: صلَّيتُ خلفَ النبي ﷺ وأبي بكر وعمر وعثمان فلم يَجهَروا ببِسْم الله الرحمن الرَّحيم، فإنَّ قتادةً على علوِّ قَدْره يدلِّس ويأخذ عن كل أحدٍ، وإن كان قد أُدخِلَ في الصحيح حديثُ قتادة، فإنَّ في ضدِّه شواهدَ: أحدها ما ذكرناه. ومنها:

Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates that Sayyiduna Mu'awiyah (may Allah be pleased with him) led a prayer in Madinah in which he recited aloud. He recited "In the name of Allah, the Most Gracious, the Most Merciful" for Surah al-Fatihah, but did not recite Bismillah for the surah after it. When he gave the salam, the Muhajirun and Ansar who were present called out: "O Mu'awiyah, did you steal from the prayer, or did you forget?" After that, when he led the prayer, he recited Bismillah for the surah after Surah al-Fatihah as well, and he said the takbir when going down into prostration.
This hadith is sahih (authentic) on the condition of Imam Muslim, and it is strong evidence against the narration of Qatadah which mentions not reciting it aloud.

Grading: This narration is weak because of 'idtirab' (inconsistency) in both its chain and its text.

وهو في "الأم" للشافعي 2/ 245، ومن طريقه أخرجه ابن المنذر في "الأوسط" (1349)، والدارقطني (1187)، والبيهقي في "السنن" 2/ 49، و"معرفة السنن والآثار" (3086).
Reference / Source: This narration is in al-Shafi'i's book 'al-Umm' 2/245, and via him it was narrated by Ibn al-Mundhir in 'al-Awsat' (1349), al-Daraqutni (1187), and al-Bayhaqi in 'al-Sunan' 2/49 and 'Ma'rifat al-Sunan wa al-Athar' (3086).
وهو عند الدارقطني أيضًا - ومن طريقه البيهقي في "السنن" - من طريق عبد الرزاق، عن ابن جريج، بهذا الإسناد. وهو في "مصنف عبد الرزاق" (2618) لكن سقط منه أنس بن مالك فصار من رواية عبد الله بن أبي بكر بن حفص مرسلًا، كذا وقع في "المصنف": عبد الله بن أبي بكر بن حفص، وهذا غلط، والمحفوظ فيه - كما قال قاسم بن قطلوبغا في "ثقاته" (5746) - أنه من رواية بن عبد الله بن حفص وكنيته أبو بكر.
Details of the narration: This narration is also with al-Daraqutni, and via him al-Bayhaqi narrated it in 'al-Sunan', through the chain of Abd al-Razzaq from Ibn Jurayj. It is also in 'Musannaf Abd al-Razzaq' (2618), but there the name of Anas bin Malik has dropped out, so it has become a 'mursal' narration of Abd Allah bin Abi Bakr bin Hafs.
Technical note / Defect ('illah): In the 'Musannaf' the name appears as "Abd Allah bin Abi Bakr bin Hafs", which is a mistake, whereas the preserved (mahfuz) version is what Qasim bin Qutlubugha said in his book 'al-Thiqat' (5746): that it is the narration of "Ibn Abd Allah bin Hafs", whose kunya is "Abu Bakr".
